TOWN OF KINDERHOOK
RESOLUTION
At a regular meeting of the Town Board for the Town of Kinderhook, Columbia County, New York, duly held on the 10th day of July 2017, at theKinderhook Town Hall, 3211 Church Street, Valatie, New York 12184, the following Resolution was proposed and seconded:

WHEREAS, owners of real property fronting and/or abutting a private roadway known as Wildflower Road located within the Town of Kinderhook, County of Columbia and State of New York, on September 12, 2016, presented the Kinderhook Town Board with an informal Petition signed by owners of real property fronting and/or abutting Wildflower Road, thereby petitioning the Town of Kinderhook in accordance with New York Town Law §200 to make necessary improvements to the aforesaid Wildflower Road and to have Wildflower Road dedicated as a Town Road, and
WHEREAS, the Town Board, pursuant to the foregoing input from residents, believed it was prudent to proceed with considering the improvementof Wildflower Road and the dedication of Wildflower Road as a Town Road purusant to Town Law §200, the maximum amount to be expended for said improvement being $300,000.00, said sum if approved to be charged against each of the parcels of real property fronting and/or abutting Wildflower Road on a pro-rata basis in accordance with applicable law, and
WHEREAS, the Town Board, pursuant to the foregoing input from residents and upon its own motion, duly resolved on December 12, 2016 pursuant to Town Law §200 that the Town of Kinderhook should proceed with considering the improvement of Wildflower Road and the dedication of Wildflower Road as a Town Road, the maximum amount to be expended for said improvement being $300,000.00, said sum to be charged against each of the parcels of real property fronting and/or abutting Wildflower Road on a pro-rata basis in accordance with applicable law, and
WHEREAS, said Town Board duly adopted an Order on December 12, 2016, reciting in general terms the filing of said Petition and Resolution, the improvement proposed, the maximum amount proposed to be expended for said improvement and dedication of Wildflower Road, and specifying that said Town Board would meet on January 9, 2017 at 6:45 pm at the Kinderhook Town Hall, 3211 Church Street, Valatie, New York 12184, to consider the Petition and Resolution and to hear all such persons interested in the subject matter thereof who appeared at said time and place, concerning the same, and
WHEREAS, certified copies of said Order were duly published and posted according to law, and said Town Board did, at the time and place specified in said order, duly meet and consider the matter of the improvement and dedication of Wildflower Road, and heard all persons interested in the subject matter thereof who appeared at such time and place, concerning the same, and
WHEREAS, following said public hearing, the Kinderhook Town Board held additional meetings with the residents abutting Wildflower Road to determine whether the improvement and dedication of Wildflower Road was in the best interests of said residents and the Town of Kinderhook, and
WHEREAS, the Town Board, as required by Town Law §200, believes it prudent to proceed with another Public Hearing to solicit input from members of the public concerning the proposed highway improvement and dedication,
NOW, THEREFORE, BE IT
RESOLVED, that a Public Hearing shall be scheduled forAugust 19, 2017 at 9:00 am at the Kinderhook Town Hall, 3211 Church Street, Valatie, New York 12184, to consider a proposal to direct the Town Engineer, in consultation with the Highway Superintendent, to prepare definite plans and specifications and to make a careful estimate of the expense to improve and dedicate Wildflower Road up to the maximum sum of $300,000.00, and to hear all such persons who may have an interest in Wildflower Road being so improved and dedicated, with the cost of same being charged against each of the parcels of real property fronting and/or abutting Wildflower Road on a pro-rata basis in accordance with applicable law and the schedule attached hereto as Schedule “A”, and be it further
RESOLVED, that pursuant to the foregong, the Town Board forthe Town of Kinderhook hereby adopts the Order attached hereto as Schedule A.
Upon calling the question of the foregoing Resolution, the following Board members voted "Aye" in favor of the Resolution:

The Resolution having been approved by a majority of the Town Board, the same was declared duly adopted by the Supervisor of the Town of Kinderhook.
