TOWN BOARD MEETING

October 12, 2010

6:00 P.M.

PRESENT: Councilpersons: Kevin Armstrong, Cheryl Boyd, Leonard Govern, Luis Rodriguez-Betancourt, Supervisor Bruce Dolph, Hwy. Supt., Walt Geidel, Attorney Frank Wood, and Town Clerk Ronda Williams

RESOLUTION #83 APPROVAL OF MINUTES

A motion was made by Councilman Armstrong, seconded by Govern approving the minutes of September 14, 2010 as presented. All in favor, motion carried.

FLOOR TIME: Beatrice Bennett took the floor and donated a photo collage of Beerston. Mrs. Bennett explained to the Board the process she went through to obtain the photos from the Department of Environmental Protection and the process to publish her book “The Den”. Supervisor Dolph thanked Mrs. Bennett for her donation and hard work and stated the collage will hang in the Walton Town Hall Boardroom.

Ross Vogt took the floor to express his dismay with the work on Oxbow Hollow and Budine Hill Road. Mr. Vogt questioned if the work was complete? Superintendent Geidel stated, all but the oil and stone. Mr. Vogt questioned the Board if they knew what the quality of life was? He suggested addressing it in the Town’s next contract. Mr. Vogt stated the dust was a problem for the residents. No one was able to open his or her windows, hang out wash, or wash your car. Superintendent Geidel agreed that the dust was a problem and informed the Board that the Highway Department went out and addressed the issue. Mr. Vogt quested if there was a punch list for the job? He stated that fruit trees were damaged and the size of the stone used was raised above the road. Superintendent Geidel stated the size of stone used was downsized from the original specifications, stating that the DEP requested that the size of stone fall within the 10-year flood plan.

Mr. Vogt informed the Board that the contractor told him the project would be done within a week. He stated that it took a couple of months but only seen 6-7 days of actual work. Mr. Vogt suggested cutting down on the number of days in the next contract.

SUPERINTENDENT OF HWY. REPORT:

Reported that he estimates the Town of Walton sustained $25,000.00 in flood damage but there was no significant damage.

Supervisor Dolph thanked Walt Geidel and his highway crew for taking a very aggressive stance in taking care of our roadways prior to the anticipated rain. Supervisor Dolph stated that because of the Town of Walton’s proactive approach; the Town and Village of Walton had less damage.

Superintendent Geidel informed the Board that his crew spent the summer cleaning sluice pipes and believes it paid off.

Reported that he has submitted the closeout paper work for the South River Road project.

Reported that the CWC projects are complete and is finishing up with the in-kind service work.

Requested permission to post the following roads as seasonal limited use: Chase Brook from Town of Tompkins town line to Town of Tompkins town line and Beers Brook from Russ Gray Pond to NYS Route 206.

RESOLUTION # 84 SEASONAL LIMITED USE ROADS

A motion was made by Councilman Govern, seconded by Rodriguez-Betancourt granting Superintendent Geidel permission to post Chase Brook Road from the Town of Tompkins town line to Town of Tompkins town line and Beers Brook from Russ Gray Pond to NYS Route 206 as seasonal limited use roads. All in favor, motion carried.

Reported that he estimates 20 miles of road to be done next year costing approximately $500,000.00. He asked the Board for their thoughts on purchasing the stone this year at the current price. Councilman Armstrong commented that the company would not be so busy at this time of year and would allow the highway department and early start. Councilman Rodriguez-Betancourt proposed to get half the quantity. The Board was in agreement to purchase the stone now since the price is locked in until March.

Reported that he and Councilman Govern attended a meeting in Narrowsburg, NY on Gauging Stations and Map Overlay. Councilman Govern stated that the Village of Walton had minimal damage this time because of the debris removal work done by the Town of Walton.

TOWN CLERK’S REPORT:

Reported to the Board a one-day seminar on Personnel Management and Labor Relations is being offered in Newburgh and the Town of Clay.

Reported that the Walton Town Justice Department has asked permission to submit a grant up to $30,000.00 through the Justice Court Assistance Program.

RESOLUTION # 85 JUSTICE COURT ASSISTANCE PROGRAM GRANT

A motion was made by Councilman Rodriguez-Betancourt, seconded by Boyd granting the Walton Town Justice to apply for a grant up to $30,000.00 through the Justice Court Assistance Program. All in favor, motion carried.

Reported that the Department of Ag. & Markets have sent out the September dog renewals a month late so no updated report at this time.

SUPERVISOR’S REPORT:

Reported that the Union Contract has been signed by both parties and will be on file in the Town Clerk’s Office.

Reported that Rally NY has inquired about the use of Left Pines Brook, Chipmunk Hollow, Marvin Hollow, Dunk Hill Road, Dunk Hill Spur, Beers Brook Road, Houck Mountain and Palmer Road to hold a road rally race. Supervisor Dolph stated they would attend the November meeting.

Supervisor Dolph asked the Board if anyone had questions on the Tentative Budget? With no questions he suggested moving the Tentative Budget to the Preliminary and set a public hearing date.

RESOLUTION # 86 2011 PRELIMINARY BUDGET

A motion was made by Councilman Armstrong, seconded by Govern to move the Tentative Budget to the Preliminary Budget. All in favor, motion carried.

RESOLUTION #87 2011 BUDGET PUBLIC HEARING

A motion was made by Councilman Govern, seconded by Rodriguez-Betancourt to hold a public hearing on November 9, 2010 for those wishing to come before the Board to speak in favor or against the Preliminary Budget. All in favor, motion carried.

A motion was made by Councilman Armstrong, seconded by Boyd approving the vouchers as presented for payment. All in favor, motion carried.

EXECUTIVE SESSION:

RESOLUTION #89 EXECUTIVE SESSION

A motion was made by Councilman Armstrong, seconded by Govern to enter into executive session for the purpose of Union Negotiations and Personnel Issue. All in favor, motion carried.

Entered Executive Session at 6:35 p.m.

Regular Session at 7:00 p.m.

With no further business before the Board, the meeting was adjourned at 7:00 p.m.
