Tobacco (Grands Prix Events) Regulations 2004

1.Objective

The objective of these Regulations is to prescribe the restrictions which are to apply to the advertising of tobacco products at the 2004Cinzano Australian Motorcycle Grand Prix at Phillip Island and the 2005 Foster's Australian Grand Prix at Albert Park.

2.Authorising provision

These Regulations are made under section 43 of the Tobacco Act 1987.

3.Definitions

In these Regulations—

"Australian Grand Prix" means—

(a)the 2005 Foster's Australian Grand Prix; or

(b)a function or event associated with the 2005 Foster's Australian Grand Prix—

to be held at Albert Park on or after 3 March 2005 and before 7March 2005;

"Australian Motorcycle Grand Prix" means—

(a)the 2004 Cinzano Australian Motorcycle Grand Prix; or

(b)a function or event associated with the 2004 Cinzano Australian Motorcycle Grand Prix—

to be held at Phillip Island on or after 15October 2004 and before 18 October 2004.

4.Restriction of Displays at Australian Motorcycle Grand Prix

Displays of the whole or part of a trademark or brand name of a tobacco product or the name of the manufacturer or distributor of a tobacco product in connection with the Australian Motorcycle Grand Prix comply with section 10(1) of the Tobacco Act 1987 if the displays are restricted to—

(a)signs or objects—

(i)on or within the site of the Australian Motorcycle Grand Prix; or

(ii)on the outside of any road, sea or air vehicle used in the Australian Motorcycle Grand Prix or on any participant in the Australian Motorcycle Grand Prix—

that are permitted by section 18 of the Tobacco Advertising Prohibition Act 1992 of the Commonwealth; and

(b)the period from and including 10 October 2004 to and including 20 October 2004.

5.Restriction of Displays at Australian Grand Prix

Displays of the whole or part of a trademark or brand name of a tobacco product or the name of the manufacturer or distributor of a tobacco product in connection with the Australian Grand Prix comply with section 10(1) of the Tobacco Act 1987 if the displays are restricted to—

(a)signs or objects—

(i)on or within the site of the Australian Grand Prix; or

(ii)on the outside of any road, sea or air vehicle used in the Australian Grand Prix or on any participant in the Australian Grand Prix—

that are permitted by section 18 of the Tobacco Advertising Prohibition Act 1992 of the Commonwealth; and

(b)the period from and including 25 February 2005 to and including 8 March 2005.

6.Expiry

These Regulations cease to have any force or effect on 31 March 2005.

The Tobacco (Grands Prix Events) Regulations 2004, S.R.No.122/2004 were made on 5 October 2004 by the Governor in Council under section 43 of theTobacco Act 1987, No.81/1987 and came into operation on 5 October 2004.

The Tobacco (Grands Prix Events) Regulations 2004 will sunset on 31 March 2005: see regulation 6.
