SUBJECT: Update - Health Care Reform (HCR)

Thank you to the colleges/divisions that have hosted HRS presentations regarding Health Care Reform and its impact to NMSU hiring practices. Based on feedback we received during our presentations, HRS is making a few modifications to the proposed employment categories and allowable FTEs for students/grad students. Also, please know that we anticipate a go-live date of June 3 for aHR Services webpage dedicated to providing current information regarding HCR compliance and Frequently Asked Questions.

The first modification is that the non-regular variablefaculty and staff employment categories will not be created. Instead the non-regular temporary category will be expanded to include employment from .01 FTE to .74 FTE. This modification allows easier processing of temporary faculty/staff hired for multiple jobs or across departmental lines. It also allows greater flexibility for the employment period up to one year rather than requiring a quarterly employment cycle. However, temporary employees who work short periods of time (occasional) should be re-hired each time they work instead of a full year at a time. Additionally, changes have been made to allow multiple jobs for term employees provided the total FTE does not exceed 1.0.

The most vocal feedback we received indicated there is a significant need to allow students/grads to work 40 hours during the summer and academic breaks. Approval was obtained from administration to allow students to work 40 hours during academic breaks (including summer) and grads to work 1.0 FTE during the summer.However, since this change will require hiring managers to be responsible for closely monitoring time to ensure students do not reach the 30-hour threshold, we are requesting that a single plan be submitted by each college, division, community college indicating how this will be managed within their units. We are asking that plans be submitted to by June 14, 2013.

Although HRS fully supports the decision to increase student FTE we continue to encourage hiring managers to limit student employment to 30 hours (.75 FTE) during academic breaks whenever possible. Please know that allowing employment of 40 hours during these periods increases the likelihood that a student may reach the full-time (30 hour average) threshold.
