CHAPTER 10.LONGTERMCAREADMINISTRATORS

SUBCHAPTER1. LICENSINGOF LONGTERMCAREADMINISTRATORS

490:10-1-3.Requirementsforinitiallicensurefornursing/skillednursingfacility(includesICF/MR) administrator (alsoknownasnursinghomeadministrator)

(a) InadditiontothegeneralrequirementsfoundinthisChapter,eachapplicantforinitiallicensureshall meettherequirementsinthisSection.

(b)Eachapplicantshallprovide,orshallcause tobeprovided,writtenevidencesatisfactorytotheBoard ofthefollowing:

(1) "OfficialProof'[see490:10-3-1.1.(relatingtoevidencerequirements)]ofsuccessful completionofaformalprogramorprogram(s)ofstudy,wherein applicantreceived,at a minimum,abachelor'sdegree:

(A)applicantreceivedabachelor'sdegreefromacollegeoruniversityaccreditedbyone oftheregionalaccreditationorganizationsrecognizedbytheU.S.Departmentof EducationandtheBoardiftheapplicant'sdegreeisfromaschooldomiciledintheUnited States;or

(B)if theapplicantreceivedhisdegreefromacollegeoruniversitydomiciled outside theUnitedStates[and,assuch,thecollege/universitydoesnotfallunderthe accreditationpurviewofanyofthesix(6)regionalaccreditationorganizationsrecognized bythe U.S.DepartmentofEducationandbytheBoard],applicantshall,at applicant's expense,causeadegreeequivalencyevaluationofhisdegreetobeperformedandthe resultssentdirectlytotheBoard.TheBoardshallassesstheresultsofthisdegree equivalencyevaluationand,atitssolediscretion,determineifapplicant'seducation and/or degreeareequivalent,ataminimum,toabachelor'sdegreeearnedfroma regionallyaccreditedcollegeoruniversity;

(2)Receiptofapassingscoreonthenational "NAB" NHAexaminationconductedbytheNational AssociationofLongTermCareAdministratorBoards(NAB) as discussed in paragraph 10-3-2 of this document.

(3) ReceiptofapassingscoreontheOklahomaStateStandardsexamination withinthetwenty-four(24)monthsprecedingthemonthinwhichtheBoard willbetakingactiontolicensethe applicant,andifapplicantisnotlicensedduringthis24-monthtimeperiod,applicantwillhaveto payallrequiredfeesandre-taketheexaminationpriortoanyfuturelicensingattempts;

(4)SuccessfulcompletionofAdministratorUniversitywithinthetwenty-four(24)months precedingthemonthinwhichtheBoardwillbetakingactiontolicensetheapplicant,andif applicantisnotlicensedduringthis24-monthtimeperiod,applicantwillhavetopayallrequired feesandre-takeAdministratorUniversitypriortoanyfuturelicensingattempts(ifthecandidate hasadegreeinlongtermcareadministrationfromaninstitutionaccreditedbyNAB,the AdministratorUniversitymaybewaived);

(5)Successfulcompletion oftheAdministrator-in-Training(AIT)program(ordocumentationofan equivalentinternshipaspartofadegreeinlongtermcarefromaninstitutionaccreditedbyNAB) within thetwenty-four (24)monthsprecedingthemonthinwhichtheBoardwillbe takingaction tolicensetheindividual,andifapplicantisnotlicensedduringthis24-monthtimeperiod,applicant willhavetopayallrequiredfeesandcompleteanotherAITprogrampriortoanyfuturelicensing attempts;and

(6) Paymentoftherequiredfee(s).

(7) An applicant with the HSE credential/qualification will have been verified through/by NAB. This means the Board has been assured by NAB that the applicant has:

(i) met or exceeded the minimum education requirement,

(ii) passed the NAB NHA exam as well as the NAB RCAL exam and NAB HCBS exam and

(iii) met or exceeded the requirement for AU and AIT, either by experience or education, and shall only be required to take and pass our State Standards examination and pay the required fees to be licensed as a NHA in Oklahoma.

(c)TheBoard,atitssolediscretion,maywaivetheAdministratorUniversityrequirementand/orthe Administrator-in-TrainingrequirementiftheapplicantwaspreviouslylicensedinOklahomaasalongterm careadministrator,wasingoodstandingwiththeBoardwhileapplicantwaspreviouslylicensedin Oklahoma,andhasbeenactiveinlongtermcareforatleasttwo(2)ofthelastfive(5)years.

(d)AftertheBoard'sstaffhasdeterminedthatallrequirementsforinitiallicensurehavebeenmet,an applicantmayapplyfora"temporary"license. TheExecutiveDirectormayreviewandapproveor disapprove issuanceofatemporarylicenseafteranapplicationhasbeenmade andadditionallicensure feespaid. AnapprovedtemporarylicenseshallexpireatthenextregularlyscheduledmeetingoftheBoardwhentheapplicationforlicensure(nolongertemporary)mustbeapprovedordisapprovedbytheBoard.

490:10-1-3.1.Requirementsforinitiallicensureforresidentialcare/assistedliving(RC/AL) administrators

(a) InadditiontothegeneralrequirementsfoundinthisChapter,eachapplicantforinitiallicensureas anRC/ALadministratorshallmeettherequirementsinthisSection.AdministratorsholdinganRC/AL licensemayserveasanadministratorineitheranRCForALF.

(b) EachapplicantforinitiallicensureasanRC/ALadministratorshallprovide,orshallcausetobe provided,writtenevidencesatisfactorytotheBoardofreceiptofahighschooldiploma(orGED)ora higherlevelofeducation. When theapplicantisprovidingproofofeducationbeyondhigh schoolor GED,thesamelevelof"proof"detailedinparagraph10-1-3(b)isrequired.

(c)Eachapplicantforinitiallicensureas aRC/ALadministratorshallprovide,orshallcausetobeprovided, writtenevidencesatisfactorytotheBoardofthefollowing:

(1)Currenttrainingcertification,where"current"isdefinedasbeingcompletedwithinthe twenty-four(24)monthsprecedingthemonthinwhichtheBoardwillbetakingactionto licensetheindividual:

(A) throughtrainingfromaninstitutionofhigherlearningwhoseprogramhasbeen approvedbytheBoard;or

(B)receiptofanationallyrecognizedassistedlivingcertificateoftrainingand competencyforassistedlivingadministratorsthathasbeenreviewedandapprovedbythe Board;

(C) Sourcesofcertificationare requiredtobereviewedandapprovedbytheBoard. Approvedtrainingsourcesshallincludeanexpirationdateontheircertificationwhichshall betwoyearsafterthedateofthecompletionoftheirtraining.

(D) Applicants for training shall provide or cause to be provided to the approved training entity evidence that they have met at least one of the following pre-requisites to enter training:

(i) At least one (1) consecutive year of health care experience, OR

(ii) At least thirty (30) college semester hours in a healthcare related field
of study, OR

(iii) A Bachelor’s degree in any field of study.

(2)ReceiptofapassingscoreontheOklahomaStateStandardsexaminationforRC/AL administratorswithinthetwenty-four (24)monthsprecedingthemonthinwhichtheBoardwill be takingactiontolicensetheapplicant,andifapplicantisnotlicensedduringthis24-monthtime period,applicantwillhavetopayallrequiredfeesandre-taketheexaminationpriortoanyfuturelicensingattempts;

(3)Receiptofapassingscoreonthenational "NAB" RC/ALexaminationconductedbythe NationalAssociationofLongTermCareAdministratorBoards(NAB) as discussed in paragraph 10-3-2 of this document,and

(4)Paymentoftherequiredfee(s).

(5)Trainingcertificationrequiredin(bc)(1)aboveisaprerequisitetobeingabletotaketheState Standardsexamination;apassingscoreontheStateStandardsexamisaprerequisitetotakethe NAB RC/AL Exam.

(d)TheBoard,initssolediscretion,maywaivere-completionofthetrainingrequirement iftheapplicant waspreviouslylicensedinOklahomaasanRC/ALadministrator,wasingoodstandingwiththe Board while applicantwaspreviouslylicensedinOklahoma,andhasbeenactiveinlongtermcareforatleasttwo (2)of thelastfive(5)years.

(e)AftertheBoard'sstaffhasdeterminedthatallrequirementsforinitiallicensurehavebeenmet,an applicantmayapplyfora"temporary"license. TheExecutiveDirectormayreviewandapproveor disapproveissuanceofatemporarylicenseafteranapplicationhasbeenmadeandadditionallicensure feespaid. Anapprovedtemporarylicenseshallexpireat thenextregularlyscheduledmeetingofthe Boardwhentheapplicationforlicensure(nolongertemporary)mustbeapprovedordisapprovedbythe Board.

490:10-1-3.3.Requirementsforinitiallicensureforresidentialcare (RC)administrators

(a) InadditiontothegeneralrequirementsfoundinthisChapter,eachapplicantforinitiallicensureas anRCadministratorshallmeettherequirementsinthisSection.AdministratorsholdinganRClicense may serveasanadministratorinanRCFandmaynotserveinanyotherfacilitytype.

(b) EachapplicantforinitiallicensureasanRCadministratorshallprovide,orshallcausetobeprovided, writtenevidencesatisfactorytotheBoardofreceiptofahigh schooldiploma(orGED)orahigherlevelof education. WhentheapplicantisprovidingproofofeducationbeyondhighschoolorGED,thesamelevel of"proof'detailedinparagraph10-1-3(b)isrequired.

(c)EachapplicantforinitiallicensureasaRCadministratorshallprovide,orshallcausetobeprovided, writtenevidencesatisfactorytotheBoardofthefollowing:

(1)Currenttrainingcertification(completedwithinthetwenty-four(24)monthsprecedingthe monthinwhichtheBoardwillbetakingaction tolicensetheindividual)throughtrainingfroman institutionofhigherlearningwhoseprogramhasbeenapprovedbytheBoard;

(2)ReceiptofapassingscoreontheOklahomaStateStandardsexaminationforRC administratorswithinthetwenty-four(24)monthspreceding the month inwhich theBoard willbetakingactiontolicensetheapplicant,andifapplicantisnotlicensedduringthis24-month time period,applicantwillhavetopayallrequiredfeesandre-taketheexaminationpriortoany futurelicensingattempts;

(3)Paymentoftherequiredfee(s).

(4)Trainingcertificationrequiredin(bc)(1)above isaprerequisite tobeingabletotaketheState Standards examination.

(d)TheBoard,initssolediscretion,maywaivere-completionofthetrainingrequirementiftheapplicant waspreviouslylicensedinOklahomaasanRCadministrator,wasingoodstandingwiththeBoardwhile applicantwaspreviouslylicensedinOklahoma,andhasbeenactiveinlongtermcareforatleasttwo (2)ofthelastfive(5)years.

(e)AftertheBoard'sstaffhasdeterminedthatallrequirementsforinitiallicensurehavebeenmet,an applicantmayapplyfora"temporary"license.TheExecutiveDirectormayreviewandapproveor disapprove issuanceofatemporarylicenseafteranapplicationhasbeenmadeandadditionallicensure feespaid.AnapprovedtemporarylicenseshallexpireatthenextregularlyscheduledmeetingoftheBoard whentheapplicationforlicensure(nolongertemporary)mustbeapprovedordisapprovedbytheBoard.

490:10-1-4.Requirementsforlicensure by endorsementforlongtermcareadministrators

(a) InadditiontothegeneralrequirementsfoundinthisChapter,eachapplicantforlicensure by interstateendorsementasanursinghome long term care administratorshallmeettherequirementsofthisSection.

(1) TheBoardpermitslicensureforcandidatesforNursingHomeAdministratorsfromother jurisdictionswhohavemetthefollowingminimumrequirements.

(A)SubmissiontotheBoardof"OfficialProof"ofsuccessfulcompletionofaformal program(s)ofstudyand,at aminimum,receiptofabachelorsdegreethatmeetsthe requirementssetforthin490:10-1-3.;

(B)SubmissiontotheBoardofevidenceofcurrentlicensure,ingoodstanding,asalong termcare/nursinghomeadministrator,andsubmissionofproof thatapplicanthas:

(i) servedfulltimeastheadministrator-of-record forthepasttwo(2) consecutive yearsinajurisdictionregulatedbyalicensingauthority.;or

(ii)beenactiveasalicensednursinghomeadministratorinajurisdiction regulatedbyalicensingauthority foratleasttwo(2)ofthepastthree(3) consecutiveyears;

(C) SubmissiontotheBoardofproofofinitiallicensureasalongtermcare/nursinghome administrator,includingactiveNABNHAExamscores,andproofthatsuchlicenseisin

goodstandingwiththatlicensingauthority;

(D)SubmissiontotheBoardoffulldisclosureofany/allpendingdisciplinaryactionsor currentinvestigationsagainstapplicantaswellas anysanctionsimposedagainst applicant'slongtermcare/nursinghomeadministratorlicenseoragainstanyprofessional licensehepresentlyholdsorhaseverheldinanyotherStateorjurisdiction, including,but notlimitedto:revocation;suspension;'voluntarysurrender';otherlicensurerestriction(s) thatlimitedapplicant'spracticeundersuchlicense;ortheassessmentofmonetary penalties orfinesortheassessmentofadditionalCEUsbythelicensingentity asaresult ofdisciplinary proceedings. Lossofaprofessionallicenseduetononrenewalorfailureto obtaintherequirednumberofannualCEUhoursisexceptedfromthefullandcomplete disclosureotherwiserequiredherein;

(E) Documentationrelatedtocurrentorpreviouslicensureshallbesubmitteddirectlyto theBoardby thestate-appointedauthority(ies)regulatingtherespectivelicense(s) OR by NAB when the applicant has the HSE credential/qualification;and

(F)Paymentoftherequiredfee(s).

(2)TheBoard,initssolediscretion,shallassessthemagnitudeofanydisciplinaryactiontakenby otherlicensingauthoritiesinitsdeterminationofapplicant'seligibilityforanOklahomalicense.

(3)Inaccordancewithprovisionsdetailedin59O.S.4100.5(B)and(C),the Board will expeditethe approvalprocess for endorsementapplicantswherethe license requirementsofthe otherstate aresubstantiallyequivalentto Oklahoma requirements. AllapplicantsdeterminedeligibleforOklahomalicensurebyendorsement,the spouseofanactivedutymilitarymember,aspousesubjecttoamilitarytransferorsomeonewho leftemploymentinanotherstatetoaccompanytheperson'sspousetoOklahomashallbe requiredtosit forandreceiveapassingscoreontheOklahomaStateStandardsexaminationand paytherequiredlicensefeebeforealicenseisgrantedbytheBoardthroughapprovalofthe ExecutiveDirector. Onlythoseapplicantstowhomthisapplieswitharecordofanyformof disciplinaryaction byanotherlicensingauthorityoranyotherpossiblenegativeindicatorshallbe requiredtobeapprovedbyavoteoftheBoard. Itshallbethesoleresponsibilityoftheapplicant tonotifystaffifthisexpeditedpathwaytolicensureperTitle59provisionsappliestothemand to providesatisfactoryevidenceofthesame. ATemporaryLicensemaybeissued(feesshallnotbe waived)forthosetowhomthisapplies,attheirrequest,uponacompleteapplicationandall qualificationsbeingmetexcepthavingpassedtheapplicableStateStandardsExamination. The Temporarylicenseshallexpireafterno morethansixty(60)daysfromthedateofissuanceand mayonlybeissuedonetimeperapplicant.

(b) InadditiontothegeneralrequirementsfoundinthisChapter,eachapplicantforlicensure by interstateendorsementasaresidential care/assisted living (RCAL) administratorshallmeettherequirementsofthisSection.

(1) TheBoardpermitslicensureforcandidatesforRCALAdministratorsfromother jurisdictionswhohavemetthefollowingminimumrequirements.

(A)SubmissiontotheBoardof"OfficialProof"ofsuccessfulcompletionofaformal program(s)ofstudyand,at aminimum,receiptofa high school diploma; meeting the requirements of proof for abachelorsdegree meetingthe requirementssetforthin490:10-1-3 exceeds the high school diploma minimum requirement.;

(B)SubmissiontotheBoardofevidenceofcurrentlicensure,ingoodstanding,asalong termcare/RCALadministrator,andsubmissionofproof thatapplicanthas:

(i) servedfulltimeastheadministrator-of-record forthepasttwo(2) consecutive yearsinajurisdictionregulatedbyalicensingauthority.;or

(ii)beenactiveasalicensedRCALadministratorinajurisdiction regulatedbyalicensingauthority foratleasttwo(2)ofthepastthree(3) consecutiveyears;

(C) SubmissiontotheBoardofproofofinitiallicensureasalongtermcare/RCALadministrator,includingactiveNABRCALExamscores,andproofthatsuchlicenseisin goodstandingwiththatlicensingauthority;

(D)SubmissiontotheBoardoffulldisclosureofany/allpendingdisciplinaryactionsor currentinvestigationsagainstapplicantaswellas anysanctionsimposedagainst applicant'slongtermcare/RCALadministratorlicenseoragainstanyprofessional licensehepresentlyholdsorhaseverheldinanyotherStateorjurisdiction, including,but notlimitedto:revocation;suspension;'voluntarysurrender';otherlicensurerestriction(s) thatlimitedapplicant'spracticeundersuchlicense;ortheassessmentofmonetary penalties orfinesortheassessmentofadditionalCEUsbythelicensingentity asaresult ofdisciplinary proceedings. Lossofaprofessionallicenseduetononrenewalorfailureto obtaintherequirednumberofannualCEUhoursisexceptedfromthefullandcomplete disclosureotherwiserequiredherein;

(E) Documentationrelatedtocurrentorpreviouslicensureshallbesubmitteddirectlyto theBoardby thestate-appointedauthority(ies)regulatingtherespectivelicense(s);and

(F)Paymentoftherequiredfee(s).

(bc)Thereisno licensurebyendorsementallowancefor licensurefor the RC/ALlicense,theRClicense ortheAdultDayCareLicense. Alloutofstatelicensureapplicationsfortheselicensuretypesshallbe treatedasinitial licensures withtheexceptionofindividualswhopreviouslypasseda required theNABRC/ALNAB sanctioned exam, shallnotbe requiredtore-takethatexam, howevertheseindividualsmustprovideproofofhavingpassed thatexamif/when requiredto meetOklahomalicensurerequirements.

(cd)Inaccordancewithrequirementsdetailedin59O.S.4100.5(A),itshallbeincumbentontheapplicant tonotifyOSBELTCAStaffduringtheapplicationprocessiftheapplicantisthespouseofamilitaryservice memberonactivedutyinOklahoma,orisclaimingpermanentresidencyinthestateforsix(6)months priortoactivedutyorduringtheperiodofactiveduty. Staffwillexpeditetheprocesstotheextent possible. Approvalof thelicensewillbeinaccordancewithOAC 490:10-1-4(a)(4)above.

SUBCHAPTER3. APPLICATIONFORLONGTERMCAREADMINISTRATOR LICENSURE

490:10-3-2.Nationalexamination

(a)“NAB Examination(s)” refers to the required examination(s) for a particular license type. Prior to July 2017, NAB conducted only two examinations – one for the NHA and one for the RCAL license types. Many administrators will have single scores from those exams on file. After this date, the examinations were broken into two (2) parts consisting of a “Core” examination and a “Line of Service” or “LOS” module exam, with three (3) different LOS exams possible – the existing NHA and RCAL with HCBS (Home and Community Based Services) being the third LOS “module” added. The “Core” examination items are those items that according to NAB’s periodic professional practice analysis have been determined to be “core” to all lines of service as an administrator where the LOS exams or modules are specific to those lines of service. NAB’s HSE credential, for example, would require that one will have passed all four (4) of these exams (the “Core” and all three LOS exams). Other licenses may require the Core and a corresponding
LOS exam be passed, but viewed as a single exam requirement. It is also possible to simply have a requirement for the Core exam wherein the LOS exams available may not be viewed as wholly compatible with the license/certification type. When one speaks of the NAB Exam, they would typically be referring to the “whole” requirement for an exam or series of exams for the specified license type or credential which explains why it’s possible to be referenced in singular or plural.

(b) Anindividualapplyingforaninitiallicensemustreceiveapassingscoreontheapplicableexam,either theNursingHome Administrator("NHA")examination (Core and NHA module)ortheResidentialCare/Assistedliving("RC/AL") exam (Core and RCAL module),administeredbytheNationalAssociationofLongTermCareAdministratorBoards(NAB) (neitheris applicabletoResidentialCareorAdultDayCareadministratorapplicants). TheBoardmay waivethis requirementiftheapplicantprovidesevidencethathehassuccessfullypassedtheappropriateNAB examinationataprevioustime. TheNAB'sRC/AL(ResidentialCare/Assistedliving)examdoesnotmeet therequirementsfor anursinghomeadministratorlicense. An applicant showing proper evidence of having the HSE credential shall be considered to have shown evidence that he passed both the NHA and RCAL exams as well as the HCBS exam. An applicant who tested prior to the implementation of the Core and LOS modules shall be considered to have passed the Core as well as either the NHA or RCAL module (or both) depending on the test(s) taken and passed.

(bc)AnapplicantforlicensurebyendorsementwhohaspreviouslypassedtherequiredNAB examination willnotberequiredtoretaketheexamination if the applicantprovidesevidenceofapassingscore.

(cd) Anindividualapplying foraprovisionallicenseshallnotberequiredtopasstheapplicableNAB examination tobeprovisionallylicensed.

(de)Feesforallnationalexaminationsshallbeinan amountprescribedbyandaredueandpayabletothe NABoritsauthorizeddesignee.

SUBCHAPTER5.DISCIPLINE

490:10-5-3.Disciplinaryaction

(a)This subchapterappliestoalllongtermcareadministrators,certifiedassistant administrators(CAAs),any person applying for licensure or certification, unlicensed persons acting as administrators without a license or certification, andanypersonactingas administratorwitharevoked, suspended, surrendered,lapsedorvacatedlicense.

(b)TheBoardmaytakeactionagainstalicensedadministrator oranunlicensedpersonactingas administrator,andmaydenyaninitialapplication;denyanapplicationforreinstatement;denyalicensure byendorsementapplication;denyarenewalapplication;suspendorrevokealongtermcareadministrator licenseorcertification,aprovisionallicense,apreceptorcertification,anassistantadministrator's certification, or anAITinternshiptrainingpermit;warn;censure;reprimand;imposeadministrativefinesand/orcostsincludingattorneyfees,imposeprobation oruseother remediesthat maybeconsideredto belessthansuspensionorrevocationuponsatisfactoryevidenceofanyofthefollowing:

(1)Obtainingorattempting toobtainalicenseorcertificatebyfraud,deceit,ormisrepresentation; or misrepresenting one’s self as holding a license or certification when they do not.

(2)Convictionoforapleaofguiltyornolocontenderetoanyfelonyortoanymisdemeanor involvingmoralturpitude.

(3)Useoflegally-prescribedorillegaldrugs(narcoticsorotherdangerousdrugs)oralcoholorthe dependenceonlegally-prescribeddrugsorillegaldrugsoralcohol,orgambling,ifsuchuseor dependence,orsuchgambling,orthebehaviorsrelatedtoorresultingfromsuchuseor dependencecompromisetheindividual'sabilityorcapacitytofulfillhisdutiesorresponsibilitiesin thelongtermcarefacility,orifthesameconstitute(s)a criminaloffense.

(4)Commitmenttoamentalinstitutionorjudicialdeterminationof incompetence.

(5) Grossnegligence,ornegligencethatconstitutesadangertothehealth,welfareorsafetyof theresidentsorthepublic.

(6) Physicalorverbalabuseofaresidentormisappropriationofaresident'sfundsorproperty; failuretoreportanallegationofphysicalorverbalabuseofaresidentormisappropriationofa resident'sfundsorpropertytoappropriatestateauthoritiesasrequiredby law.

(7)Fraudulent,deceptiveordishonestconductinthemanagementofalongtermcarefacility,or otherconductunbecomingtoapersonlicensedor subjectto licensureunderthislawwhen,in thejudgmentoftheBoard,suchconductisdetrimentaltothebestinterestofthelongterm care field,thelongtermcareadministratorprofessionand/orthepublic.

(8)ExceptasotherwisepermittedinthisChapter,concurrentlyservingoractingasthe administratorofmorethanone nursingfacility or assisted living facility;orexceedingtheconditionsplacedon administratorsofICFs/MRwith16bedsorlessasstatedinthisChapter;orotherwiseserving asanadministratorbeyondthescopeoftheirlicensedauthority.

(9) FailuretocomplywithStateorfederalrequirementsapplicabletothefacility.

(10) FailuretocomplywithrulesandrequirementsforadministratorsestablishedbytheBoard, includingtheAdministratorCode ofEthicsandAdministratorResponsibilitiesadoptedbythe Board.

(11) Evidence thattheadministratorhaspaid,given,hascausedtobepaidorgivenoroffered topayortogivetoanypersonacommissionorothervaluableconsiderationforthesolicitation orprocurement,either directlyorindirectly,oflongtermcarefacilitypatronage.

(12)Intentionalretaliationordiscriminationagainstanyresidentoremployeeforcontactingor providinginformationtoanyStateofficial,licensingagency orregulatoryagency.

(13)Failuretoprovideverificationofcontinuingeducationhours.

(14) Sexualabuse,sexualharassment,orsexualexploitationofanyresident,employee,trainee, volunteer,consultant,orvisitortothefacilityinwhichthelicenseepractices.

(15)Falsificationofanyrecords or documentsrelatingtotheoperationofalongtermcarefacility;falsification ofrecords or documents submittedtotheBoardoranyotherstateorfederalagency;falsificationofaresident's records,orcausingaresident'srecordstobefalsified.

(16) Useofthelicensee'sprofessionalstatus,title,position,orrelationshipasalongtermcare facilityadministratortocoerce, improperlyinfluence,orobtainmoney,property,orservicesfrom aresident,resident'sfamilymember,employee,visitor,oranypersonservedbyordoingbusiness withthefacilitythatemploystheadministrator.

(17)Interfering with,refusingtoparticipatein,orimpedinganyinvestigation,inspection,or disciplinaryproceedingauthorizedbyStatute.

(18)Violationofanydisciplinaryorder,consentagreement,termofsuspension, condition, stipulation,oranyotherlimitationimposedonthelicenseebytheBoard.

(19)Unlicensedpractice,practiceonarevoked,suspended,orlapsedlicense;orpracticeona provisionallicensewithouttheuseofanon-siteconsultantorpractice asaCertifiedAssistant AdministratorwithouttheoversightofanAdministrator-of-Record.

(20) FailuretopayfeesorfinesestablishedorimposedbytheBoard.
(21)Knowinglyaiding,assisting,oradvisingaperson tounlawfullypracticeasanadministrator withoutarequiredlicense.

(22)Failuretoadequatelysupervisean assistantadministratorand/orfailuretoassurethatthe assistantadministratorcomplieswithstateandfederalrequirements applicabletothefacility.

(23) Conductthatviolatesthesecurityofanylicensureexaminationmaterials.
(24) Coercionorharassment,ortheattempt tocoerceorharass,ortheuseofanyotherform ofuninvitedsolicitationdirectedtowardaresidentofalongtermcarefacilityortowarda memberoftheresident'sfamilyortheresident'sguardianforthepurposeofattemptingto persuadetheresidenttochangelongtermcarefacilities.
(25)FailuretonotifytheBoardofachangeofname,businessorpersonalmailingaddress(es),or changeofemploymentwithinfifteen(15)calendardaysof theoccurrence.
(26) Coercionorharassmentof,ortheattempttocoerceorharass,amemberoftheBoard,a BoardemployeeoranauthorizedagentorrepresentativeoftheBoardasrelatedtoanymatteror issueoverwhichtheBoardhasjurisdiction.
(27)ExclusionbytheDepartmentofHealthandHumanServicesOfficeofInspectorGeneralfrom participationinanycapacityintheMedicare, Medicaid,andallFederalhealthcareprogramsas definedinsection1128B(f)oftheSocialSecurityAct.

(c) WhentheBoardplacesalicenseinprobationarystatus, itmayrequirethelicenseetohavea "consultant"administratorduringtheprobationaryperiod.Theconsultantshallagreetothetermsof theconsultantroleasdefinedin490:10-1-S(c)(2),meetthequalificationsin490:10-1-S(e),andagreeto therequirementsofaconsultantaslistedat 490:10-1-S(f)(1)and(2).

(d)TheBoardmaystipulaterequirementsforreinstatementindisciplinaryordersthatareconsistentwith OAC490:10-1-11requirementsforreinstatementfromsuspendedstatus.

SUBCHAPTER7.ADMINISTRATORUNIVERSITY

490:10-7-3.Generalprovisions

(a)TheBoardiscommittedtoprovidinglearningopportunities toindividualsinterestedinpursuing acareer inlongtermcareadministration,andenhancingthedevelopmentoflicensedadministrators. To furtherthisobjective,theBoardhasestablishedanAdministratorUniversity(AU)fornursinghome administratorand Certified Assistant Administrator (CAA) applicantswithcurriculumdesignedspecificallytoeducateindividualswithknowledgeand skillsthatmayassisttheminbecomingasuccessfulnursinghomeand/orICF/MRadministrator or CAA. TheBoard willperiodicallyreviewandapproveorestablishtrainingforresidentialcare/assisted livingandadultday careadministratorsasdeemednecessary.

(b)EffectiveAugust1,2006,individualsapplyingtobecomenursinghomeadministratorsshallsuccessfully completeAdministratorUniversity (AU)priortobeinglicensed. Effective January 1, 2019, individuals applying to become Certified Assistant Administrators shall successfully complete AU prior to being certified.

(c)AdministratorswhoarealreadylicensedintheStateofOklahomaasanursinghomeadministratormay enterAdministratorUniversityattheirownexpenseforenhancedtrainingifclassroomspaceisavailable.

(d)UponmutualagreementoftheBoardandlicensee,specificclasses ortheentireAdministrator Universitycurriculummaybeimposedasapenaltyfortheviolationofrulesand/orstandardsestablished bytheBoard.

(e)TheBoardmayalsodesignatecertaindaysorclasseswithinthecurriculumaseligibleforcontinuing education(CE)creditandmaychargeanappropriatefee(asaworkshop)foradministratorstoattendona spaceavailablebasis.

(f) TheapplicationfeeandAdministratorUniversityfeeprescribedbytheBoardatOAC490:1-7-2shallbe submittedduringtheonlineapplicationprocesspriortoadmissiontoAdministratorUniversity.

(g)An applicantforlicensurewhosuccessfullycompletesAdministratorUniversity(AU)willnot haveto repeatAdministrator UniversityifheissuccessfullylicensedinOklahomaasalongtermcare administratorwithintwenty-four (24)monthsafterthecompletionofAUwhichismarkedbythe scheduleddateofclassforthatparticularclass.

(h)Ifapplicantfailstobecomelicensed/certified asanOklahomalongtermcareadministratorduring this24-monthtimeframe,applicantwillhavetopayallapplicablefeesandrepeatAdministrator Universitypriortoanyfuturelicensing/certificationattempts.

SUBCHAPTER8. ADMINISTRATOR INTRAINING(AIT)INTERNSHIPPROGRAMFORNURSINGHOMEADMINISTRATORSAND CERTIFIED ASSISTANT ADMINISTRATORS

490:10-8-2.Application

(a)TheapplicantshallsubmittotheBoardanapplication,whichshallcontainsuchinformationasname, education,employmenthistory,informationpertainingtomoralcharacter,anyotherinformationtheBoard requires,andanaffidavitstatingthattheapplicant,ifgrantedalicense,willobeythelawsoftheStateand therulesoftheBoard,andwillmaintainthehonoranddignityoftheprofession.Theapplicationfor licensureand/ortoattendAUmeetsthisrequirement.

(b)TosatisfytheBoard'srequirementforevidenceverifyingeducationaldegree(s)conferredorhours of post-secondaryeducationcompleted,theapplicantshallmeettherequirementsfoundatOAC490:10-3-1.1.

(c)TheapplicantwillbesubjectedtoacriminalbackgroundcheckasdescribedinthisChapterpriorto beginninganAITinternship.

(d) AfeeasprescribedbytheBoardatOAC490:1-7-2shallbesubmittedwiththeapplication.

(e) AnapplicantwhosuccessfullycompletesaBoard-approvedAITinternshipwillnothavetorepeat the internship if he is successfullylicensed/certifiedasalongtermcareadministrator/CAAinOklahomawithinthe twenty-four (24)monthsfollowingthemonthinwhichhefirstbeganhisinternship,andifapplicantfails tosecurelicensure/certificationwithinthis24-monthtimeframe,applicantwillhavetopayallapplicablefeesand serveanewAITinternshippriortoanyfuturelicensing/certificationattempts.

490:10-8-14.AITInternshipexemptstatus

TheBoard,initssolediscretion,maywaivetheAITinternshiprequiremententirely,orportionsthereof,for thoseapplicantswhoshowevidenceofthefollowing:

(1) Priorsuccessful completionofaformalinternshipprogramthatmeetsorexceedsBoard requirements,suchasinanotherstateorinaNABaccreditedlongtermcaredegreeprogram.

(2) Aregisterednurse(RN)orlicensedpracticalnurse(LPN)withaminimumoftwo(2)years experienceinsupervisioninalicensednursingfacilityorotherlongtermcarefacilitymay,at the solediscretionoftheBoard,beexempt from the nursingdepartment moduleorportions thereof. AnysuchexemptiongrantedbytheBoardshallnotlessenthetotalnumberofhoursthat theintern/traineemustservetocompletetherequirednumberofhoursfortheinternship.

SUBCHAPTER13. STANDARDSFORADMINISTRATORS

490:10-13-2.Administrator responsibilities

(a)Itistheresponsibilityofthelongtermcareadministrator,asthemanagingofficerofthefacilitytoplan, organize,direct,andcontroltheday-to-dayfunctionsofafacilityandtomaintainthefacility'scompliance withapplicablelaws,rules,andregulations.Theadministratorshallbevestedwithadequateauthorityto complywiththelaws,rules,andregulationsrelatingtothemanagementofthefacility.

(b) Longtermcareadministratorslicensed/certifiedbytheBoardshalladheretotheAdministratorCode ofEthicsasadoptedbytheBoard.

(c)NursinghomeadministratorslicensedbytheBoardshallnotconcurrentlyserveas theadministrator­of-record(AOR) ofmorethanonelong termcarefacilityexceptasotherwisepermittedin thisChapter.A licensednursinghomeadministratormayserveas theadministratorofmorethanoneintermediatecare facilityforthementallyretardedwithsixteenorfewerbeds(ICF/MR-16),onlyifsuchfacilitiesarelocated withinacirclethat hasaradiusof not morethanfifteen(15)miles,andthetotalnumberoffacilities andbedsdoesnotexceedthelesser ofsix(6)facilitiesortotallicensedcapacityofsixty-four(64)beds.

(1)An NHA may not concurrently serve as AOR of more than one long term care facility except where authorized in statute and this chapter. Exceptions are discussed at OAC 490: 10-13-2(c) as it relates to ICF/MR-16; OAC 490:10-13-2(d) as it relates to Assisted Living facilities; OAC 490:10-13-2(e) as it relates to an NHA concurrently serving as AOR of a SNF/NF and another facilitywhich includes an Assisted Living Facility, a Residential Care Facility and/or an Adult Day Care Facility; and OAC 490:10-13-3 as it relates to the use of a CAA).

(2) An NHA may not concurrently serve as the Director of Nursing (DON) of a facility while serving as the AOR of a nursing facility.

(3) When functioning under one of these exceptions, the requirement to designate a person in the facility to act on the AOR’s behalf during their absence must be strictly adhered to (see OAC 310, Chapter 675, paragraph (a) for this requirement).

(d) NHA and RCAL Administrators are limited to serving concurrently as AOR of two (2) Assisted Living Facilities with the requirement that the facilities are within sixty (60) miles of each other and have less than one hundred and thirty (130) occupied beds.

(e) An NHA may concurrently serve as the AOR of a SNF/NF and one other facility (Assisted Living, Residential Care or Adult Day Care) provided that the two facilities have the same owner, the facilities are within 15 miles, and the number of occupied beds (or occupied beds and participants) does not exceed 130.

(df)Every person licensed/certifiedasanadministratoranddesignatedthe"Administrator-of-Record" (AOR)shall displaytheappropriate"Certificateof'or"License"inaconspicuousplaceinthefacilityorplaceofbusiness requiringsuchlicense/certification. Certified Assistant Administrators (CAAs), where utilized in this capacity, shall display their certification.

(eg)Each licensed/certifiedadministratorshallupdatetheirlicensurerecord,online,withinfifteen(15) calendardaysfollowingthechangeofhisname,businessand/orpersonalmailingaddress,changein employmentorchangeinemploymentstatus,onlineinthemannerasprescribed or asmay be prescribed by theBoard. TheBoardwillassessalatefeeasprescribedatOAC490:1-7-2ifitisdetermined thattheadministratorfailedtoprovidecurrentcontactinformationwithinthisfifteendayperiod.

(fh)Uponreceiptofsatisfactoryevidencethat"Certificate"or"License"hasbeenlost,mutilated,or destroyed,theBoardmayissueaduplicatereplacementlicenseuponpaymentofafeeasprescribedby theBoardatOAC490:1-7-2.

(gi) Tochangehisnameona"CertificateofLicense",thelicenseemustprovidelegalproofofthename change(e.g.,copyofmarriagecertificate,divorcedecree,etc.)beforeareplacement"CertificateofLicense" willbeissued upon payment of a fee as prescribed by the Board at OAC 490:1-7-2.

(hj)Anadministratorshallnotknowinglyinitiatecontactwithanindividualcurrentlyresidinginalongterm carefacility,orknowinglyinitiatecontactwiththefamilyorguardianofanindividualcurrentlyresidingina longtermcarefacility ,forthepurposeofattemptingtopersuadeachangeinthatindividual'sresidenceto anotherlongtermcarefacility.

(ik) Anadministratorshallnotknowinglysolicit,orpermitanemployeetosolicitclientsforhislongterm carefacilitythroughcoercionorharassment.Ifanadministratorhasknowledgeofsuchactionsbyan employee,theadministratorshalltake suchstepsasarereasonableandnecessarytostopsuchconduct.

(jl)AnAdministrator,orapplicantforAdministratorlicensure/certification,inconnectionwithalicense/certificate applicationoraninvestigationconductedby theBoardoraninvestigationconductedbythe OklahomaStateDepartmentofHealth,theOklahomaDepartmentofHumanServices,theOklahoma HealthCareAuthority,oranyotheragencyoftheStateorfederalgovernmenthavingregulatory responsibilityoverorrelatingtothedeliveryofcaretopersonsinafacilityoperated or managed by theAdministrator,shallnot:

(1) knowinglymakeafalsestatementofmaterialfact;

(2) failtodiscloseafactnecessarytocorrectamisrepresentationknownbytheAdministrator orapplicantforlicensure/certificationtohavearisenintheapplication orthe matter under investigation;or

(3) failtorespondtoademandforinformationmadebytheBoardorsuchgovernmentagencyor anydesignatedrepresentativethereof.

(m) To enable CEU attribution and uploads by NAB approved CEU providers, all administrators and CAAs will register with the NAB CE Registry.

490:10-13-3.Requirementsforadministrators whoserveastheAdministrator-of-Recordoftwo(2)or morelicensedlongtermcare(nursing)facilities employing Certified Assistant Administratorslocatedwithinafifty(50)mileradiusofeachother, whereinthetotalnumberofoccupiedbedsdoesnotexceedone- hundred-twenty (120)bedsand whereinone-or-moreindividualsis/employedinCertifiedAssistantAdministratorcapacities

(a)The Administrator-of-Record is responsible for ensuring that all minimum requirements delineated herein and in the Nursing Home Care Act (see Title 63, Section 1-1943.1) relating to individuals who wish to serve in the capacity of Certified Assistant Administrator (CAA) are met prior to the delegation of duties and responsibilities to such individual.

(b)TheAdministrator-of-RecordshallprovidequalifiedindividualsservingasaCAAwithadequateauthority andresponsibilitytoadministerthoseaspectsoftheoperationsof thefacilitythat areto bedelegated to them,including the authoritytoactinanemergency.

(c) TheAdministrator-of-Recordshallclearly,andinwriting,developaformaljobdescriptionforthe positionofCAA,whereinthedutiesandresponsibilitiesoftheindividualservingas aCAAareclearly delineated.

(d)TheAdministrator-of-Recordshallprovidesupervision,traininganddirectiontotheCAAanddelegate onlythosedutiesandresponsibilitiesthatmaysafelybe performedbytheindividualfillingthatroleand thatarenototherwiseproscribedbylaw,ruleorstatute.

(e)TheAdministrator-of-Record,beinglicensedbytheBoard, islegallyandultimatelyresponsibleforthe managementandoperationofthefacilityand,assuch,shallmaintainsufficienton-sitepresenceinthe facilitytoeffectivelysupervisetheCAA.

(f)TheAdministrator-of-RecordshallensuretheCAAdoesnotconcurrentlyserveasCAAofmorethan one(1)longtermcarefacility.

(g)TheAdministrator-of-Recordshallspendatleastten(10)hourspercalendarweekon-siteinthe facility,providingguidanceanddirectiontotheCAA,andfurther,suchon-sitesupervisoryvisitsshallnot bemorethanten(10)calendardaysapart.

(h)TheAdministrator-of-Recordshallestablishaclearly-writtenpolicydelineatingwhotheindividual residents,residents'familymembersand/orguardians,andfacilitystaffshouldcontactwhenthe Administrator-of-Recordisabsentfromthefacilityaswellastheprocedurethatistobeutilizedthat clearlyindicates'when'and'how'suchcontactshallbemade.Thepolicyandprocedureshallbeprovided toresidents,residents'familyand/orguardians,andfacilitystaffandshallbepostedinaconspicuous placeinthefacility.

(i)TheAdministrator-of-RecordshallnotdelegatenorcausetobedelegatedtotheCAAanydutyor responsibilitythathasbeenspecifiedin Stateorfederallaw,statute,ruleorregulationasbeingadutyor responsibilitythatcanonlybeperformedbyadulylicensedAdministratororanydutyorresponsibility thatisotherwiseprohibitedbyStateorfederallaw,statute,ruleorregulation.

(j)TheAdministrator-of-RecordshallensurethatnoindividualserveastheCAA ifthatindividualholdsa licensegrantedbythisBoard,butwhichlicenseissuspended,revokedorotherwiserestricted,orifthat individualhasbeen sanctioned(formallyexcludedfromparticipationinfederally-fundedhealthprograms) bytheU.S.DepartmentofHealthandHumanServices(DHHS), OfficeofInspectorGeneral(OIG).

(k)TheAdministrator-of-recordshallensurethatnoindividualservesasaCAAif the facility atwhich the AssistantAdministratoristoserveisnotoneoftwo-or-more facilities at which theAdministratorserves astheAdministrator-of-Record,thathaveatotalbedcomplement nottoexceedone-hundred-twenty (120)occupiedbedsandthatarelocatedwithafifty(50)mileradiusofeachother.

(I)TheAdministrator-of-Recordshallestablisharequirementforthecertifiedassistantadministratorto successfullycompletenolessthantwenty-four(24)continuingeducationclockhours duringeachlicensure periodasaconditionofemploymentand shallberesponsibletoensurethecertifiedassistant administrator(s)workingundertheirlicensehasrenewedtheircertificationwiththeBoardbytheendof eachlicensureperiod.

1
