Timeline for MSHSL Investigations and Hearings

Fair Hearing Procedure

  1. School administrator receives information regarding an alleged violation of MSHSL rules and Bylaws.
  2. School administrator must determine if information is credible, valid and reliable.
  3. If yes, then investigation begins. Investigation must be completed within 10 school business days.
  4. At the completion of the investigation the school administrator informs student of eligibility status. If the eligibility status changes—the student is found to be in violation of rules or Bylaws—the student must be notified verbally and in writing.
  5. Within 10 school business days of the mailing of the eligibility notification the student, parent or guardian must request a Fair Hearing.
  6. The school administrator must convene a Fair Hearing within 10 school business days after receipt of the request for a hearing. Student, parent or guardian must be given at least 3 school business days notice beginning with the receipt of the notice of the hearing.
  7. The Hearing Officer or the hearing panel must provide the findings of fact, conclusions and determination of eligibility within 3 school business days of the conclusion of the hearing. The determination shall be sent to the student, parent or guardian and the MSHSL Executive Director.
  8. Within 10 school business days of receipt of the determination of the hearing panel the MSHSL Executive Director shall affirm or overrule the determination.
  9. The student, parent or guardian may appeal the decision of the school level hearing panel or the Executive Director. The student, parent or guardian must request a hearing at the League level. The request for a League level fair hearing must be personally delivered postmarked or emailed within 10 school business days of the receipt of the findings of fact, conclusions and determination from the school hearing panel.
  10. The League will contact the family within 10 businessdays of receipt by the League of the written request for a hearing to indicate whether the rationale warrants a League level fair hearing.
  11. Within 4 businessdays of the League level hearing the Hearing Officer shall make a recommendation to the MSHSL Board of Directors. The recommendation of the League level hearing officer will govern the student’s eligibility until action by the MSHSL Board of Directors or the Executive Director acting on behalf of the Board of Directors.
  12. The Board of Directors will review and officially act upon the matter at the first regularly scheduled meeting following the receipt of the hearing officer’s decision.
  13. The decision of the Board of Directors shall be final.
