AGREEMENTBETWEENAFIRMANDABROKERFORAGENCY

THISAGREEMENTmadeonthe..dayof..BETWEENAB,etc.,afirmcarryingonthebusinessofbuildingcontractorsat.(hereinaftercalledthefirm)oftheonepartandCD,etc.(hereinaftercalledthebroker)oftheotherpart.

WHEREASthefirmwantstosellthepropertydescribedintheScheudleheretoandforthesaidpurposetheservicesofthebrokerarerequired.

ANDWHEREASthesaidbrokerhasshownhiswillingnesstoaccepttheagencyforthesaleofthesaidpropertydescribedintheSchedulehereto.

ANDWHEREASthefirmhasacceptedtopaytothebrokerthepresentratofcommissionof1percent.Ofthesaleprice.

NOWTHEREFORETHISAGREEMENTWITNESSESasfollows:

1. ThefirmherebygivesthebrokerforaperiodofthreemonthsthereoftherighttosellthepropertydescribedintheScheduleheretoatthepriceandonthetermsandconditionshereinaftercontainedinthisagreement.

2. 2.ThebrokerisherebyauthorisedtosellthepropertyonhepriceofRs.1,00,000andoutofthisconsiderationthepurchasershallpayRs.20,000inadvanceasearnestmoneyandthebalanceofRs.80,000shallbepaidwithinamonthhereofbeforetheRegistraratthetimeofregistrationofthesale-deed.

3.ThebrokershallbeauthorisedtosellthepropertyatthepriceofRs.1,00,000andonothertermsandconditionsthatmaybeacceptabletothefirm.

4.ThefirmherebyrepresentsandwarrantsthatthedetailsofthepropertyasdescribedintheScheduleheretoaretrueandcorrectandthesaidpropertyisfreefromallencumbrances.

5.Thefirmherebyundertakestodelivertothepurchaser,withinareasonabletime,asabstractoftitleshowingthatthefirmistheownerofthepropertyandthesaidpropertyisfreefromallencumbrances.

6.Thefirmherebyagreesthatthesale-deedtobeexecutedbythefirmshallbeafullcovenantwarrantydeedfreefromallencumbrances.

Whileeverycarehasbeentakeninpreparingtheabove-mentionedModelAgreement,stillsomemistakesmayhavecreptin.TheModelAgreementareinthenatureofillustrationsandareintendedfortheguidanceoftheusers/persons.AnyoftheModelAgreementmustbeusedbyadjustingthesametosuittotheneedsoftheuser/person.LegalDepartment,GovernmentofGujaratherebydisclaimsanyandallresponsibilityorliabilitythatmaybeassertedorclaimedfrom,orclaimedtohavearisenduetorelianceplacedupontheuseofanyoftheModelAgreementbyanyuser/person.
