THIS AGREEMENT, which is hereby acknowledged, dated the ______day of ______, 2017 made by and between Serenity Farm Gypsy Horses, hereinafter referred to as "STABLE" and ______hereinafter referred to as "OWNER." These parties warrant that they have the right to enter into this AGREEMENT.

  1. Fees: In consideration of $225.00 per horse per month paid by Owner of said horse for pasture board or $300.00 per horse per month for Full board. Pasture Board mean horses live in the pasture. Full Board means Horse comes into the barn at night and stays in the stall during bad weather at the barn owner’s discretion. Fees are due in advance by the 5th day of each month, if received after the 5th a late fee of $50.00 will be incurred. STABLE agrees to start boarding of said horse beginning ______, 2017 on a month-month basis. All partial months’ board will be pro-rated at a daily rate of $7.00 per day for pasture board and $10.00 per day for Full board. Please initial which board type desired below:

NOTE: The above board fees does not include veterinary, farrier, or any other services beyond those identified in this Agreement. The costs and charges for these services must be paid exclusively by Owner, and Owner agrees to pay for them.

  1. Right of Lien: OWNER is put on notice that STABLE has and may assert and exercise a right of lien, as provided for by the laws of the State of Michigan for any amount due for the board and keep of horse (s), and also for any storage or other charges due hereunder, and further agrees STABLE shall have the right, without process of law, to attach a lien to your horse (s) after three (3) months of non-payment or partial payment and STABLE can then sell horse (s) to recover its loss.
  1. Standard of Care: It is agreed upon that the STABLE will provide normal and reasonable care to maintain the health and well-being of said horse. This will include scheduling of farrier services with the farrier that Stable chooses, feeding of round bales or square bales as needed at the discretion of the STABLE, and providing adequate water supply in pasture boarding lots. Stable will use the same judgement on reasonable care on owners horses as stable would provide for their own horses. Special arrangements are at the discretion of STABLE. A stall can be rented in case of injury or necessity for an extra $10.00 per day. For the general wellbeing of horses at Stable, Owner agrees to make his/her own arrangements to have horse(s) regularly vaccinated and dewormed. Stable does have Veterinary Services and Farrier Services, that owner can use when they are scheduled, at the owners expense, payment due at the time of services. Dewormed should be given to all horses at the same time according to Stables deworming protocol as recommended by stables vet.
  1. EMERGENCIES. Should Stable determine that Owner’s horse(s) have become injured or are ill, Stable will notify Owner as soon as possible. However, if Owner is unable to be reached, or does not immediately inform Stable regarding measures to be taken, or if the horse(s)’s health requires emergency action, the right to contact a veterinarian or to furnish other advisable attention is within Stable’s discretion, and Stable will, under these circumstances, act as Owner’s agent to procure veterinary or other attention, but not for payment of fees.

  1. Stable Rules: Owner hereby acknowledges receipt and understanding of the current STABLE Rules, which are incorporated by reference in full, as if fully set forth herein. OWNER agrees he/she and his/her guests and invitees will be bound and abide by these Rules, and accepts responsibility for the conduct of his guests and invitees according to these Rules. STABLE may revise these Rules from time to time and OWNER agrees any revision shall have the same force and effect as current Rules. Failure, as determined in STABLE’s sole discretion, of OWNER or OWNER’s guests and invitees to abide by STABLE Rules may result in STABLE declaring OWNER in default hereunder and result in termination of this AGREEMENT.
  • If you turned on a light, turn it off when you are finished using that area.
  • If you turn off an electric fence, turn it on when you are finished in that area.
  • Keep the aisle clean of tack, brushes, halters, hoof pickings or manure if you or your horse put it there, pick it up please.
  • Owner leaving halters and blankets on their horse must understand that there is risk when leaving these items on the horse. Stable prefers they are not left on and are not responsible for injury caused by these items. Owner responsible to put on and remove, Owner responsible for injuries to their horse that could happen from use of blanketing and leaving halters on in pasture.
  • All vehicles must be parked in the parking designated areas.
  • No visitors are allowed in the stalls.
  • Boarders may enter the pasture to retrieve only the OWNER horse.
  • No boarder may enter the pasture where a stallion is turned out.
  • OWNERs may not handle any horse whither it be a boarders or leased other than their own.
  • Do not feed your horse other than treats you provide. If you believe your equine needs its grain rations increased, please notify the STABLE. Feeding your equine outside of the habitual feeding period can cause colic on your horse as well as in horses around yours which are not being fed at the same time.
  • Do not give treats to any horse other than your own unless written permission is on file with the stable.
  • Do not ride on without safety equipment. The stable will not be held responsible for any injury, accident and/or death occurring because you failed to use proper safety equipment or safety precautions.
  • All injuries, accidents, and damages must be immediately brought to our attention. Any unreported incidents will be the responsibility of the OWNER or leaser.
  • All riders and Handlers must wear proper footwear, no flip flops, etc. For your own protection.
  • All handlers and Riders must sign Liability wavier prior to handing horse on Stables Property.
  1. INDEPENDENT TRAINERS, CLINICIANS, and INSTRUCTORS. All independent trainers, Handlers, Clinicians and Instructors work with Stable. No outside trainer, handler, clinician or instructor is permitted without Stables approval. Use of trainer or handler working with Stable may be hired for additional pricing through the Stable.
  1. Risk of Loss: During the time that the horse (s) is/are in the custody of STABLE, STABLE shall not be liable for any sickness, disease, theft, death or injury which may be suffered by the horse. This includes, but is not limited to, any personal injury or disability the horse may receive while of STABLE’s premises. OWNER fully understands and hereby acknowledges that STABLE does not carry any insurance on any horse s) not owned by STABLE, including, but not limited to, such insurance for boarding or any other purposes, for which the horse(s) is/are covered under any public liability, accidental injury, theft or equine mortality insurance, and that all risks relating to boarding of horse (s), or for any other reason, for which the horse (s) is/are in the possession of STABLE, are to be borne by OWNER.
  1. Hold Harmless: Said OWNER agrees to hold harmless STABLE, its employees, volunteer and owner from any claim resulting from damage or injury caused by said horse to any person or other equines and agrees to pay legal fees incurred by STABLE in defense of a claim resulting from damage by said horse.

Owner shall be solely responsible for all acts and behavior of Owner’s horse(s) at all times during the term of this Agreement. In no case shall the Stable be liable for the acts and behavior of the horses.

  1. EXCESSIVE DAMAGE. Owner agrees to reimburse Stable for excessive damage to Stable’s barns, facilities, and/or equipment caused by Owner or his/her horse.

WARNING Under the Michigan Equine Activity Liability Act (1994 P.A.351), an equine professional is not liable for an injury to or the death of a participant in an equine activity resulting from an inherent risk of the equine activity.

  1. TERMINATION OF AGREEMENT.
  2. BY STABLE. Stable reserves the right to refuse to continue boarding Owner’s horse(s) for any reason. Stable will give Owner at least 30 days’ notice to remove horse(s) from the Stable. In extreme situations (as determined by Stable at its sole discretion that includes, but is not limited to, the horse(s) health, dangerous or destructive propensities of horse(s) or Owner, or others), Stable reserves the right to give Owner three (3) days’ notice. After Owner has paid Stable in full for all fees and expenses, and has removed horse(s) from Stable, Owner’s obligations to Stable under this Agreement will be concluded.
  3. BY OWNER. Upon at least thirty (30) days’ notice to Stable, Owner may terminate this Agreement for any reason. Owner agrees to pay Stable all fees and expenses incurred up to the termination date and until the horse(s) are removed from the Stable’s custody and control.
  4. In the case of a default by one party, the other party shall have the right to recover legal fees and expenses, if any, incurred as a result of said default. Any payment due under this AGREEMENT shall be due and payable by the fifth day of the month and immediately in the event of termination. Failure to make any payment by said due date shall place OWNER in default hereunder. Acceptance by STABLE of any late payment shall not constitute a waiver of subsequent due dates or determinations of default.
