"1.5.1ThisAwardappliestoemployeesforwhomclassificationsandwageratesareprescribedbythisAwardintheclassificationstructure,includingbutnotlimitedtothefollowingwork:

4.Bydeletingclause5.1.3andinsertingthefollowinginlieuthereof:

"5.1.3Theclassificationstandardsextendacrossaworkandskillrangetypicallyperformedbyemployeesrepresentedinthefollowingareas. Thelistisnotexhaustive.

5.Bydeletingclause5.3.3andinsertingthefollowinginlieuthereof:

"5.3.3Workingwithinskillandsafetylimits

TheCouncilmaydirectanemployeetocarryoutsuchdutiesasarewithinthelimitsoftheemployee'sskill,competenceandtrainingconsistentwiththeclassificationstructureofthisAward,providedthatsuchdutiesarenotdesignedtopromotedeskillingandareinaccordancewiththeWorkplaceHealthandSafetyAct1995.

(a)FurthertoAgreementreachedon26April1988,suchtasksmayinclude,butarenotlimitedto:

(i)minormaintenanceandrepairs,includinguseofpoweredandotherhandtools;

(ii)minorfieldrepairs,partreplacements;replacingwheelsonsmallmobileplant,lightbulbsandothercomponentsofequipmentutilisedbytheteamtoensureworkcancontinueinasafeandproductivemanner;

(iii)oxy-acetyleneandassociatedtasks,asrequired,bysuitablyskilledemployees;

(iv)towingofmovableplanttoandfromworksites;

(v)smallpaintingjobs,workonpipesanddrains;

(vi)minormaintenanceonpumpsandbleedingcompressors;

(vii)minormulti-skillinginscientificandanalyticalservices.".

6.Bydeletingclause5.3.5andinsertingthefollowinginlieuthereof:

"5.3.5Roleevaluationprocess

WhenDivisionsorBusinessUnitsrestructureworktomeetbusinessneeds,ordecidetoexpandoperationsintonewareasorupdateexistingworkplacestatementsaschangesbecomenecessary,theworkplacestatementshallbereferredtotheCorporateWagesGradingCommitteeforevaluation. Givingconsiderationtoemployeeconsultation,workplacestatementquality,corporategradingconsistencyandequity. UpdatingexistingWorkplaceStatementsneedtobeagreedbybothmanagementandtheUniontoensurethestatementreflectsworkpracticesrequiredbyCouncil,beforebeingsubmittedtotheCorporateWagesGradingCommittee.

TheCorporateWagesGradingCommittee,including2managementrepresentativesandaUnionrepresentativeandchairedbyanHRConsultant,shallutilisetheagreedroleevaluationproceduretoassessandassignaGradeleveltotherole.".

7.Bydeletingclause5.4.2andinsertingthefollowinginlieuthereof:

"5.4.2Casualperformanceemployees

(a)TheperformanceratesindicatedcoverfrontofhouseandstageemployeesatBrisbaneCityCouncilvenues,includingCityHall.

FrontofHouseemployeesperformworkincludingushering,monitoring,cloakroomattendants,programsellers,tickettakingandselling,doorattendants,galleryushers,commissionairesandstagedoorkeepers.

(b)EmployeesshallbeengagedonacasualperformancebasisforaminimumengagementperiodindicatedinthePerformanceRateTableexceptwhereclause4.4.1isappliedbytheemployer. ThePerformanceRateequalstheminimumengagementperiodmultipliedbytheappropriateclassificationhourlyrate(38hourweek)towhichisaddedthe23%casualloading.

(c)ACasualPerformanceEmployeeshallbepaidoneOSEgradehigherthanwouldapplyundertheaboveclassificationforanyperformancethattheyareinchargeofandsuperviseotheremployees.

(d)AllworkMondaytoSaturday,shallbepaidattheordinaryperformancerate. Workaftermidnightandbefore6.00a.m.,MondaytoSaturday,andallworkonSundaysshallbepaidatdoublethebaserate. Workonpublicholidaysshallbepaidat2anda-halftimesthebaserate.

(e)Workmaycontinueforadditionalperformancesonthesameday,afterwhichovertimemayapplyattherateoftimeandhalfforthefirst3hoursanddoubletimethereafter. Anunpaidmealbreakofbetween30to60minutesshallbeprovidedwithin4-6hoursofthestartofworkonanyengagement,withapaidbreakandmealallowanceifovertimeisworkedformorethanonehour.".

8.Bydeletingclause5.5andinsertingthefollowinginlieuthereof:

"5.5Allowances

5.5.1All-purposeoperationalallowance

Thefollowingallowanceisprovidedinrecognitionofthepotentialdiscomfortarisingfromtheworkingenvironment,thewearingofpersonalprotectiveequipmentandadditionalresponsibilitiestoensuresafeworkingpractices,andshallnotberepresentedasencouragementorcompensationforworkinginunsafeconditions.

Whilstengagedonanyorallofthefollowingactivitiesanemployeeshallbepaidanall-purposeallowanceattherateof$21.30perweektobetreatedaspartoftheordinaryweeklywageforthepurposesofthisAwardtocompensatefortheworkingenvironmentsandconditionsassociatedwithsuchactivities:

(a)Workatquarries,gravelpits,crushingplants,screeningplantsandsimilarplantswheresuchplantsareinoperation. Theallowanceshallnotapplyiftheplantsareoperatedinawetprocessmethodorothermethodsthatpreventtheoccurrenceofadustnuisance.

(b)Construction,reconstruction,alteration,repairand/ormaintenanceworkasdefinedatclause5.5.1c),including:

(i)Climaticconditionswhereworkingintheopenonalltypesofwork;

(ii)Thephysicaldisadvantagesofhavingtoclimbstairsorladdersandincludingworkatheightsabove7.5mfromtheground;

(iii)Dustblowinginthewindonconstructionsites;

(iv)Sloppy,muddyorwetconditions;

(v)Dirtyconditionsandhandlingdirtymaterialsincludingbitumen,tar,asphalt,andtarredmaterial;

(vi)Drippingsfromnewlypouredconcrete;

(vii)Workingonalltypesofscaffoldotherthanasingleplankorbosun'schair;

(viii)Thelackofusualamenitiesassociatedwithfactorywork;

(ix)Workinginwateruptoadepthnotexceeding750mm;*

*Employeeswhoarerequiredtoworkinwatertoadepthexceeding750mmshallalsobepaidinaccordancewithclause5.8.4.

(c)Allworkperformedonsiteontheconstruction,reconstruction,alteration,repairand/ormaintenanceof:

(i)pipelines,culverts,boxculverts,bridges,overpasses,underpasses,andconcreteworkincidentalthereto;

(ii)kerbing,channelling,roads,trafficislands,concretewalls;

(iii)landreclamation;

(iv)ornamentallakes,concreteornamentalgardens,andretainingwalls,wharves,piers,jetties,buildingsorsimilarstructures,butonlyforthepurposesofconstructionbyBridgeCarpenters,ForepersonBridgeCarpenters,FormFramers,and/orSettersandFormSettersAssistants;

(v)watertowers,watertreatmentworks,watermains(includingrepairtotrunkmainsand/orreticulationmainsofgreaterthan304mmindiameterandworkinginwaterofsuchdepthaswillovertopthetoecapofanormalboot),waterservices;

(vi)reservoirs,dams,barrages,weirsorsimilarstructures;

(vii)sewerageandseweragetreatmentworks,includingwhilstmakingconnectionstolivesewers.

(d)Workatrubbishdumps,landfills,wastecollectionandtransferstations,includingburning-off,containmentofgrassfiresandbushfires.

(e)Cleaningofstormwaterchannels,pipes,tunnelsandotherdrainsanduseofmechanicalgullyeductors,pickingupstreetrefuse,emptyingrubbishandlitterbins;removaloflitter,dumpedmaterialandanimalmatterfromparks,restorationofvandalisedordamagedequipment,andrecoveryoperationsfollowingstorms,floodsandbushfires;cleaninglavatoriesandothercitycleansingactivities.

(f)Vegetationandpestcontrolincludingtreemaintenance,treelopping,treeclimbing,(includinguseofchainsawsfromcherry-pickers),totalextractionoftreesandremoval,groundseleradication,weedcontrol,mosquitoandpestcontrol,involvinguseofherbicides,insecticidesandotherpoisonousortoxicsubstances,includingworkingfromaboatoraquaticweedharvesteronwateroraerialspraying.(Employeeswhoareengagedinhandlingandusingprescribedpesticidesandherbicidesshallbelicensedasrequiredunderrelevantlegislation).

Thepaymentsprescribedinclause5.5.1shallbeinfullcompensationforallcurrentenvironmentalandworkingconditionsnotspecificallycompensatedfororallowedforinanyotherprovisionofthisAwardandinlieuofpreviouslylistedAwardpaymentspertainingtotheaboveactivities.

Employeesshallnotbeentitledtothisallpurposeoperationalallowancewheretheyare:

inreceiptofanadditionaldisabilitypaymentorsiteallowanceforaspecificproject;

involvedintheoperationofadam,weirorbarrage,orontheconstructionormaintenanceoftouristfacilities,gardening,grasscuttingorotheragriculturaloperationsatadamweirorbarrage;

engagedinworkonCemeteries:

Providedfurtherthatemployeesofseweragetreatmentplantsandseweragepumpingstationsshallnotreceivepaymentpursuanttoclause5.5.1.

5.5.2BrisbaneWaterallowances

ThefollowingprovisionsonlyapplytotherelevantemployeesemployedwithinBrisbaneWater.

(a)Watertreatmentplantandwaterstorageemployee'ssection

(i)Employeesengagedinthecleaningoutofsedimentationbasinsshallbepaid$1.04($1.01asfrom15/8/05)perdayinadditiontotheirordinaryrates:

Providedthatinlieuofthispayment,whenengagedincleaningoutbasinswheretheminimumdepthofsiltmeasuredafterdrainingoutis600mmormoreontheinletsideofthebasin,suchemployeeshallbepaidattherateoftimeanda-halffortheperiodworkedinthebasin.

(ii)Employeesrequiredtointernallycleanthealumstoragetanksshallbepaidattherateoftimeandone-halfforalltimesospentinsuchtanks.

(iii)Employeesrequiredtointernallycleanlimemixingtanksshallbepaidattherateoftimeanda-halfforalltimesospentinsuchtanks.

(b)Sewermaintenancesection

(i)Extrapaymentsforworkinmainsewer - Inadditiontothenormalrateprescribedfor 'Maintenanceperson(Sewerage)',sewermaintenanceemployeesandganger,whenengagedonworkinthemainsewer,ashereinafterdefined,andwetwellsofseweragepumpingstationswherethedepthisgreaterthan4.5m(forthepurposesofclause5.5.2(b)depthshallbemeasuredfromtheupperfaceoftheslaborflooroverthewetwelltothebottomoftheinsideofthewetwell),shallbepaidanallowanceof$2.73($2.65asfrom15/8/05)perdaywhichshallbetreatedaspartofthetotalwageandtakenintoconsiderationforthepurposeofcomputingovertime:

(ii)Providedinlieuofthesaidallowancesuchemployeesshallbepaidanallowanceof$7.13($6.92asfrom15/8/05)perdayforanydayduringwhichtheydonotqualifyforthepenaltyprescribedforemployeesengagedonlivesewerworkinvolvingpersonalcontactwithliveorrawsewage:

(iii)ProvidedfurtherthatnotwithstandinganythingelsewherecontainedinthisAward,sewermaintenanceemployeesandgangershallworkasrequiredinthemainsewerashereinafterdefinedbetween11.00p.m.onSunday,Monday,Tuesday,Wednesday,Thursdayand7.00a.m.onMonday,Tuesday,Wednesday,ThursdayandFriday,respectively,withhalfanhourforamealforwhichnodeductioninpayshallbemade,atordinaryratesofpay(notbeingovertimeorotherpenaltyrates),plusanallowanceasaboveprescribed;butforeachemployeeshallbepaid$14.40($13.98asfrom15/8/05)inadditiontosuchordinaryratesandallowance.

Forthepurposesofclause5.5.2,themainsewershallbedefinedas:

themainsewerfrommaintenancehole63,EagleFarmpumpingstationtomaintenancehole132oppositetheHockingStreetsyphon;

theNormanCreeksewerfromitsjunctionwiththemainseweratmaintenancehole102,JamesStreet,tomaintenancehole35,VultureStreet,East;

theBreakfastCreekSewerfromitsjunctionwiththemainseweratmaintenancehole94,BreakfastCreekRoad,tomaintenancehole3inAbbotsfordRoad;

anyothersewerasdeterminedfromtimetotimebytheEngineerforWaterSupplyandSewerage.

(iv)Employeesengagedonlivesewerworkinvolvingpersonalcontactwithliveorrawsewageshallforallworksoperformedbepaidanadditionalamountequaltoonehalfofordinaryrates.

(v)Thesaidadditionalpaymentshallbemadeasforaminimumperiodof4hoursonanyordinaryworkingday,MondaystoFridaysinclusive:

ProvidedthatforworkonSaturdays,Sundaysorpublicholidaysemployeesshallbepaidinadditiontoanyotherrateofpaymentprescribedanadditionalpaymentofonehalfofordinarytime:

Providedfurtherthattheprovisionsofclause5.5.1(Allpurposeoperationalallowance)(previouslyConstruction,reconstruction,alteration,repairand/ormaintenanceworkallowance)shallnotapplytoemployeeswhenengagedonlivesewerwork:

Providedfurtherthatinrespectofthetimesduringwhichthesaidextrapaymentismadetheallowancesasprescribedbyclauses5.8.3and5.8.4shallnotbepayable.

(c)Seweragepumpingstations

(i)LabourersatEagleFarmPumpingStationandatotherMechanicalandElectricalinstallationsshallbepaidonthesamebasisastradespersonsintheseareasanallowanceof$3.28perweektocompensatefortheextraordinarywearandtearonoverallsandbootscausedbythenatureoftheworkcarriedoutonlivesewerageinstallationsoronworkwhichhasbeenbroughtfromalivesewerageinstallationoronworkwheretheuseofalumorchlorinewouldeffecttheirclothingorfootwear.

(ii)Suchadditionalallowanceof$3.28perweekshallnotbepayableduringperiodsofannualleaveorlongserviceleaveandshallnotbeconsideredtobepartofthewagerateforthecalculationofovertime.

(iii)WhereanEngineercertifiesthatthisworkisdirtya13.65c(13.25casfrom15/8/05)perhourdirtmoneypaymentshallbemade.

(d)Sewerageandwastetreatmentplantemployees

(i)Inadditiontopaymentforworkdoneonpublicholidaysforovertime,anallowancefor$5.31($5.16asfrom15/8/05)perdayforeachSaturday,Sundayorpublicholidayshallbepaidascompensationtooperatorsdirectedtoworkatsewagetreatmentplantsonanyoftheaforementioneddays.

(ii)TheclassificationoftreatmentplantsshallbedeterminedbytheDivisionalManager,BrisbaneWater.

(iii)Employeesrequiredtoenter,cleanandinspectdigestersatsewagetreatmentplantsshallbepaid69.3c(67.3casfrom15/8/05)perhourforthetimesoworkedinadditiontotheratesprescribedbythisAward.

(e)Watersupplyandseweragelabourers - general

(i)Whereemployeesareengagedinrepairstotrunkmainsand/orreticulationmainsof304mmdiameterorover,andarerequiredtoworkinwaterofsuchdepthaswillovertopthetoecapofanormalboot,theyshallbepaid46c(45casfrom15/8/05)perdayinadditiontotheordinaryratesprescribed.

(ii)Sewerageconstructionworkersengagedinmakingconnectionstolivesewersshallbepaid46c(45casfrom15/8/05)perdayinadditiontotheirordinaryrateofpaywhilesoemployed.

(iii)Sandblasterswhilstworkinginvalvepits,theroofsofwhichhavenotbeenremoved,shallbepaidanallowanceof40.65c(39.45casfrom15/8/05)perhour.

(iv)Employeespreparingepoxycompoundsforpainting,andpaintingwithepoxycompounds,shallbepaidanallowanceof42.25c(41.00casfrom15/8/05)perhourwhilstsoengaged.

5.5.3Rodentcontrol

(a)Anemployeewhoisrequiredtosupplyadogforuseinratdestructionandsuppliesaproficientratkillingdogshallbepaidanallowanceof$22.17perweekforeachdoguptoamaximumof2dogs.

(b)Suchallowanceshallbepaidtotheemployeeconcernedduringabsencesonannualleave,paidsickleaveorwhilstreceivingworkerscompensationpayments.

(c)Provided,however,ifanysuchdog,throughnofaultoftheemployee,iskilledduringthehoursofemploymentonratdestructionwork,theemployershallreimbursetheowneranamountof$105.60.

(d)DogsengagedinrodentcontrolshallbeexemptfromCouncildogregistrationfees.

5.5.4Surveyassistant

WorkcarriedoutbyemployeesassistingSurveyors,whilstworkingonthecarriagewayondeclaredmainroadsinrespectofwhichtheCouncilhasnotrafficauthorityandtheworkiscarriedoutinheavytrafficconditions,shallattractanallowanceof$8.04perdayforanydayorpartofadayonwhichsuchworkisperformed.

5.5.5Toolallowance

BridgeCarpentersandFormsettersusingtheirowntoolsshallbepaid$11.10perweekallowanceinadditiontotheirordinaryratesofpay. Thisallowanceshallnotbepaidwhiletheemployeeisonannualleave.".

5.5.6Firstaid

Anyqualifiedemployeeappointedbytheemployertoperformfirst-aidduties,andwhoworks3daysormoreinanyoneweekshallbepaid$11.50perweekinadditiontotheirordinaryrateofpay.".

9.Bydeletingclauses5.8.1and5.8.2andinsertingthefollowinginlieuthereof:

"5.8.1Alltimelostduetowetweathershallbepaidatordinarytimerates,providedthatemployeesreportforworkandholdthemselvesinreadiness. Thesupervisorunderwhosedirectiontheemployeesareworkingonthatdayshalldecidewhetherornotitistoowettowork. Employeeswhoarepreventedfromperformingtheirnormaldutiesduetowetweathershallperformalternatedutiesortrainingasdirectedbytheiremployerduringsuchperiods.

5.8.2Whenanemployeeisrequiredtoworkintherain,theyshallwearwaterproofclothingasprovidedbytheemployer,wherepracticable. Ifanemployeegetstheirworkclothingwetasaresultofarequirementtoperformworkintherain,regardlessofwearingthewaterproofclothingsuppliedbytheemployer,theemployeeshallbepaidsingletimeinadditiontoordinarytimeorovertimepaymentsforthetimebetweenbecomingwetandchangingintodryclothesoruntiltheemployeeceaseswork,whicheveristheearlier.".

10.Bydeletingclause5.10andinsertingthefollowinginlieuthereof:

"5.10Stand-byallowance

5.10.1Stand-byemployee

Stand-byemployeemeansanemployee,whoisrequiredtobeavailabletoattendtobreakdownsand/orforworkthatcannotwaituntilthecommencementofordinaryworkortoaddressissuesbyremotemonitoringand/oraccess.

Employeesrequiredtobeonstand-byoutsideoftheirordinaryworkinghoursshallbepaidanallowanceattherateof21%ofthebaseOSEGrade5perweek($136.54)foreachweekthattheyarerequiredtobeonstand-by.

Therateofstand-byallowancecurrentlypaidtoBrisbaneWateremployees($22perdayasfrom20May2002)shallcontinueuntilsuchtimeastheweeklyrateapplicableundertheaboveformulaexceeds$154perweek.

5.10.2Calloutprovisions

Allcalloutswillbepaidatdoubletheordinarytimerate,withaminimumpaymentfor3hours,exceptforpublicholidayswhenanytimeworkedinexcessoftheminimumof3hoursshallbepaidattheappropriatepenaltyrate.

Astand-byemployeerequiredtoattendtoworkoutsideordinaryhoursshallbepaidforsuchworkfromthetimeofcontacttocommencethatworkanduntiltheyreturnhomefromthatwork,buttheymustleaveandreturnhomewithinareasonabletime:

Providedthatifanothercalloutoccurswithin3hoursofthepreviouscallout,andtheemployeehasreturnedhome,anotherminimumof3hourswillapply. Ifanothercallisreceivedwhile 'outoncall',overtimepaymentshallcontinueandanewminimumpaymentshallnotapply.

Employeescalledouttoworkovertimefrommidnight,orrequiredtoworkovertimeaftermidnight,shallbepaiddoubletimeforsuchovertime.

Timeanda-halfshallbepaidwhenemployeescommenceworkbetween6.00a.m.andtheusualstartingtime.

Seweragemaintenanceemployeeswillbeallowedaperiodof30minutesaswashingtimeaftertheminimumpaymenthasbeenreached.

5.10.3Standbyonpublicholidays - leave-in-lieuproviso

Astand-byemployeeshallbeentitledtooneordinaryrosteredworkingdayequivalent,leave-in-lieuforeachpublicholidayonwhichtheyarerequiredtobeonstandby.

Employee'sleave-in-lieubalancesasatdateofagreement,i.e.employee'scurrentbalancestobe 'frozen' andemployeeshaveanoptiontoeither:

(a)Beingpaidoutallaccruedentitlements;or

(c)Transferupto38hoursofthisbalancetothenewleave-in-lieusystem,andfreeze*orpayoutremainder.

From1July2006,employeescanonlyaccrueamaximumof76hoursleaveinlieu,apartfromanyretained('frozen')leave.

Each12monthsafter1July2006,anyLeaveinlieuaccruedduringthelast12months,thatisgreaterthan76hours,willbepaidoutattheemployeesprevailing(current)rate.

Allpayoutswouldbeattheprevailingemployee'srate(i.e.atthetimeofpayment).

*Ifanemployeewishestoaccessanyortobepaidouttheir "frozen" Leaveinlieubalances(priortoresignation),theycanrequestapprovalfromtheirDivisionalManager.

5.10.4Remoteresponse

Astand-byemployeewhoisrequiredtoremainathome(ordesignatedplace)to:

(a)respondtophonecallsormessages;

(b)provideadvice(phonefixes);

(c)arrangecall-outofotheremployees;

(d)remotelymonitorand/oraddressissuesbyremotetelephoneand/orcomputeraccess;

shallbepaid,onehourattheemployee'sordinarytimerateforeachcallreceived,providedthatifanothercallisreceivedwithinthehour,anotherpaymentshallnotbemade.

Wheresuchacallorworkexceedshalfanhour,theemployeeshallbepaidattheappropriateovertimerateforthedurationofthecallortimeworkedontheremotetelephoneand/orcomputeraccess,inlieuofthisremoteresponsepayment.

Iftheemployeeisunabletoresolvetheissueandisrequiredtoleavehometoresolvetheproblem,theemployeeshallbeentitledtopaidovertimeinaccordancewiththeabovecalloutprovisionsinlieuofthisremoteresponsepayment.

5.10.5Nonstand-byemployees - callback(recall)non-continuousovertime

Anemployee,whoisnotonstandby,whoiscalledbacktoworkovertimeafterceasingwork,whethernotifiedbeforeorafterleavingtheCouncil'spremises,orwhowasnotnotifiedbeforecommencementofworkonthatdaythattheywererequiredtoworksuchovertimeandwhoreturnshomeoncompletionofsuchovertimework,shallbepaidforsuchworkfromthetimeofcontacttocommencethatworkuntiltheyreturnhomefromthatwork,buttheymustleaveandreturnhomewithinareasonabletime,attheappropriateovertimerate,withaminimumpaymentof4hoursattheappropriateovertimeratesforeachtimetheyarerequiredtowork:

Providedthat,exceptinthecaseofunforeseencircumstancesarising,theemployeeshallnotberequiredtoworkthefull4hoursiftheworkthattheemployeeiscalledbacktoperformiscompletedinashorterperiod.

Anemployee,whoisnotonstandby,whoisrequiredtoremotelymonitorand/oraccesstoaddressissues,shallbepaidfromtheinitialcontactandshallbepaidaminimumof2hoursattheappropriateovertimeratefortheirrole.

5.10.6Nonstand-byemployees(plannednon-continuousovertime)

Anemployee,whoisnotonstandby,whoisrequiredtoworkplanned(pre-arrangednon-continuous)callbackovertimeafterceasingworkandwhowasnotifiedbeforecommencementofworkonthatdaythattheywererequiredtoworksuchovertime,andwhoreturnshomeoncompletionofsuchovertime,shallbepaidaminimumpaymentof4hoursattheappropriateovertimeratesforeachperiodofovertimetheyhavebeenarrangedtowork:

Providedthat,exceptinthecaseofunforeseencircumstancesarising,theemployeeshallnotberequiredtoworkthefull4hoursifthepreplannedworkthattheemployeeisrequiredtoperformiscompletedinashorterperiod.

Wheretheovertimeworkedinaccordancewiththisarrangementexceeds4hours,theemployeeshallbepaidtraveltime,attheordinarytimebaseOSEGrade5rateforthetimefromleavinghometocommencethatworkandforthetimetoreturnhomeaftercompletionofthatwork,orshallbepaidmileageallowancetoandfromtheemployee'splaceofresidencetothesite,whicheveristhegreater.".

11.Byinsertingthefollowingnewparagraphsattheendofclause6.1.3:

"Employeesshallbeallowed10minutesbeforemealtimesandceasingtimesforcleaninghandswhenusingtar,bitumen,redoxidelead,creosote,paintandothersimilardirtymaterials. Theemployershallprovideoilforsuchpurposes.

Sewerageemployeesworkinginmudandwatershallbeallowedaquarterofanhourbeforeacribbreakandknock-offtimeforwashingpurposes,atthediscretionoftheengineer.".

12.Bydeletingtheclause6.1.4andinsertingthefollowinginlieuthereof:

"6.1.4Theordinarystartingandfinishingtimesofvariousgroupsofemployeesorindividualemployees,maybestaggeredprovidedthatthereisagreementbetweentheemployerandthemajorityofemployeesconcerned:

ProvidedthatbyagreementbetweentheUnionandtheemployer,theordinaryhoursmaybeworkedoverafortnightlyperiodof9consecutiveworkingdaysandnotmorethan8hours27minutesmaybeworkedonsuchdaysatordinaryrates. Otherdailyhoursarrangementsasprovidedbyclause6.1.6,thatprovideforashorterworkingweek,orotherflexibleworkingarrangementsarealsoallowed. TherostereddayoffinthesecircumstanceswillnormallybeaFridayorMonday. Itisagreedwhereoperationalneedsrequire,andagenuinebusinesscaseexistsandisexplainedtoemployeesandtherelevantUnion,rostereddaysoff(RDO's)maybearrangedonotherdaysoftheweekthroughagreedrostersorotheragreedarrangements.".

13.Byinsertingnewclauses6.1.7and6.1.8asfollows:

"6.1.7Anemployeerequiredtoworkundergroundorinatrenchexceeding4.6mindepthshallbealloweda30minutecribonthesurfaceinordinarytime(i.e.withoutlossofpay).

6.1.8Annualisationandaveragingofwages

TheemployerandtheUnionconcernedandthemajorityofaffectedemployeesmayaverageorannualiseregularpaymentsasagreedtoprovideamorestableincomeoverarostercycle:

(a)Annualisedwagesmayincludepenalties,allowances,publicholidays,leaveloading,overtimeandotherspecifiedpaymentsasagreedbymanagementandtherelevantUnion.

(b)Averagedpaymentsmayincludeaccruedtime,penalties,allowancesorotherspecifiedpaymentsasagreedbymanagementandtherelevantUnion,overanagreedrostercycleorpayperiods.

(c)Overtimeandotherpayments,notincludedinannualisedwagesoraveragedpayments,willbepaidinaccordancewiththeconditionsprescribedelsewhereintheAward,notattheannualisedoraveragedrate.

(d)Wagepaymentsmadeunderclause6.1.8shallbeweeklyorasotherwiseagreed.

(e)Paymentstocasualsnotspecifiedatclause5.4.2maybemadeonaperformance,orsessionbasis,byagreementbetweentheemployerrelevantUnionandthemajorityofemployeesaffected.".

14.Bydeletingclause6.2.2andinsertingthefollowinginlieuthereof:

"6.2.2Whereworkcommencesat6.00a.m.orlateronaSaturday,suchworkshallbepaidforattherateoftimeanda-halfforthefirst3hoursandatdoubletimethereafter,withaminimumof4hours' workorpaymenttherefore(unlessclause5.10.2applieswhentheminimumshallbe3hoursatdoubletime):

Providedthatwheremorethanoneshiftperdayisworkedallovertimeshallbepaidforatdoubletimerates.Allovertimeworkedbyshiftworkersshallbepaidforattherateofdoubletime.".

15.Bydeletingclause6.2.3andinsertingthefollowinginlieuthereof:

"6.2.3Exceptinthecaseofwatchpersonsandemployeesonferries,allworkdoneonSundaysshallbedeemedovertime,andshallbepaidforattherateofdoubletimewithaminimumof4hours' workorpaytherefore:

6.3.2Whereworkcontinuesbeyond6hoursfromthestartofordinarytime,ortheagreedmealtime,duetoemergentoroperationalneed,alltimesubsequentlyworkedshallbepaidatdoubletimeratesuntilabreakofatleast30minutesispermittedforameal,andnodeductionofordinarypayshallbemadeforthetimesooccupiedoutsidetheagreedmealtime.

6.3.3Whenemployeesarekeptworkingformorethanonehouraftertheirusualtimeforceasingworktheemployershallprovideamealorallow$9.60inlieuthereofandforeveryadditional4hoursafurthermealshallbeprovidedoranadditional$9.60paidshallpaidtotheemployee.".

19.Bydeletingrenumberedclause6.4andinsertingthefollowinginlieuthereof:

"6.4Restpauses

Anemployeeshallbeentitledtoarestpauseof10minutes' durationintheemployer'stimeinthefirstandsecondhalfoftheemployee'sdailywork. Suchrestpausesshallbetakenatsuchtimesaswillnotinterferewithcontinuityofworkwherecontinuityisnecessary. Thesebreaksmayalsobecombinedsothatonebreakof20minutesistaken,subjecttotheagreementoftheemployerandthemajorityofaffectedemployees.".

20.Byinsertingthefollowingprovisoattheendofrenumberedclause6.5.3(b):

"ProvidedthatwheretheUnionandtheemployeragree,thenagreedratesshallapply.".

21.Byinsertinganewclause7.1.17asfollows:

"7.1.17Turncockssection

(a)Turncocksshallbeallowedtimeoffeachalternativeweekfrom4.30p.m.Thursdayto6.00a.m.Monday. IftheEngineerconsidersitimpracticabletograntleaveonanyweek-end,timeinlieushallbegrantedonthefollowingweek-end.

(b)Turncocksshallbeallowedtimeoffonalternativeholidaysfrom6.00a.m.tomidnight.

(c)Turncocksshallbeallowedonenightoffdutyduringtheweek,from7.00p.m.tomidnight. Asetnightwillnotbeallottedtoanyparticularturncock;thenightoffdutyistobethesubjectofarrangementbetweentheturncockandtheengineer.

(d)WhereaturncockcommencesannualleaveontheMondayfollowingtheirweek-endleave,theyshallbepermittedtoceasedutiesat6.00a.m.ontheSaturdayimmediatelyprecedingsuchMonday,andreportfordutyaftertheexpirationoftheirannualleave.".

22.Byinsertinganewclause7.6.6asfollows:

"7.6.6Methodofdeterminingrateofpayforpublicholidaysandtimelostthroughwetweatherorsickness

(a)Whenoneofthepublicholidaysmentionedinclause7.6fallsinanemployee'spayweek,therateofpayduetosuchemployeeforsuchholidayshallbedeterminedbytheclassofworktheemployeewasdoingontheworkingdaybeforesuchholiday. Thus,ifanemployeeisengagedontheworkingdaybeforesuchholidayandwasdoingworkforwhicharateofwageshigherthanthesubstantiverateisprescribed,theholidaywillbepaidatsuchhigherrate.

(b)Therateofpayforanemployeelosingtimethroughwetweatherorsicknessshallbedeterminedonthesameprinciple.".

23.Bydeletingclause8.1.1andinsertingthefollowinginlieuthereof:

"8.1.1Inanycasewhereanemployee,otherthananemployeeofaDivisionalConstructionSub-UnitofAdministration,isrequiredtotravelbytheemployee'sownmeanstoaWorksite(asdefinedatclause8.1.3)intheemployee'sowntime,atravellingallowanceshallbepaidtosuchemployeeofonehalfhourperdaycalculatedattherateprescribedforOperationalServicesEmployeeGrade5asamendedfromtimetotime.".

24.Bydeletingclause10.1andinsertingthefollowinginlieuthereof:

"10.1Uniformsandequipment

UniformsandprotectiveclothingwillbeprovidedtoemployeesinaccordancewiththeagreedarrangementsprescribedintheBrisbaneCityCouncilCorporateWardrobeProcedure.".

25.Byinsertinganewclause11.5.2asfollows:

"11.5.2PreviouslyagreedshiftworkarrangementsshallcontinuetoapplytoemployeesengagedinBrisbaneWaterforwhomtheprovisionsofclause6.5.3(b)shallnotapply.".
