GENERAL CONDITIONS

1. Scope of the Work

The work shall consist of applying fertilizer and weed killer as specified hereafter.

2.Quality of the Work

All work shall be subject to inspection by the Office of Parks & Recreation Department and shall meet recognized standards of good workmanship. Unacceptable work shall be promptly corrected by the contractor at his expense with no additional costs incurred by the City.

3.Protection of the Public

The contractor shall assume full responsibility for the protection of the public during the progress of the work and shall be responsible for any damage to any adjacent premises which might result from the progress of the work. The contractor shall be responsible for providing and placing adequate barricades and/or warning signs at all locations where the work is in progress.

4.Payments – Per Application

The contractor shall be paid the total contract price upon completion of the work and its acceptance by the City; and after a sworn statement has been submitted by the contractor that all bills for labor and material have been paid.

5.Insurance

The contractor shall agree to defend, indemnify and save harmless the

City of Holland, including its officers, agents and employees from

any and all liabilities that may result from the contractor's work as

proposed herein. This covenant of indemnification shall include any

reasonable attorney fees and costs incurred in defense of any

actions, claim or liability by the City.

The contractor shall maintain workers compensation insurance on all

employees who work or perform services under the proposed purchase

order or contract. All liability insurance required herein shall name

the City of Holland its officers, agents and employees as additional

insured, and shall be in the form of a comprehensive, general and

automobile bodily injury and property damage policy, and shall

provide that the City receive not less than ten (10) days prior

written notice in the event of cancellation or change in terms

thereof. Said policy shall be for the following minimum limits:

Comprehensive General Liability insurance in an amount not

less than $1,000,000 for injuries, including accidental

death, to any one person, and subject to the same limit for

each person, with a combined aggregate per occurrence of not less than $1,000,000, and property damage insurance in an

amount not less than $1,000,000.

Evidence of an approved insurance policy shall be submitted by the

successful bidder and approved by the City of Holland prior to

commencement of the work as here in proposed. All general liability

insurance shall waive subrogation against the City.

6.Notice

Contractor shall provide the City with a two(2)week advance notice before coming onto any city property for application of weed control or fertilizer so that the City may provide public notice as required by their policy. No work may commence without this notice.

LISTED BELOW ARE SPECIFICATIONS FOR TURF AND WEED CONTROL AND

FERTILIZATION OF DESIGNATED CITY FACILITIES.

SPECIFICATIONS

Pre-Bid Meeting

It is mandatory that each vendor familiarize himself/herself with the project through a field review and review of these contract specifications. Interested vendors must attend the Pre- Bid Meeting at2pm, on Thursday, February 6, 2014 at the Park & Cemetery Building,429 East 24th Street. The Contract Administrator is Park and Cemetery Supervisor, Steve Zwiep. He can be contacted at (616) 928-2465, Monday through Friday, between the hours of 8:00 a.m. - 4:00 p.m.

1.Definitions:

The Department refers to the City of Holland – Parks & Recreation Department.

Vendor refers to any business entity which had bid for, but has

not yet been awarded a contractor with the City of Holland.

Contractor refers to a vendor as defined above which has been awarded a contract by the Department for pesticide, herbicide and fertilizer application at specified city facilities.

Contract Administrator refers to the Parks & Recreation Department employee directly responsible for inspecting and approving for payment all work performed under this contract.

Application refers to a chemical weed control treatment and/or fertilization program.

2.All applications are to be made by a Michigan State Certified Pesticide Applicator. Each company is required to submit copies of their application certification cards and license. Pesticide application must follow Regulation 636. Regulation 637 is critical and must be followed exactly as written. Lawn warning flags will be removed 48 hours after any posted pesticide application. A signed release by all bidders indicating their understanding and compliance with State of Michigan Regulations 636 and 637 will be required.

PUBLIC CONVENIENCE AND SAFETY

1.The contractor shall comply with all federal, state and local laws and regulations governing the furnishing and use of all safeguards, safety devices and protective equipment. It is the contractor’s responsibility to take all necessary measures to protect the life and health of its employees on the job and safety of the public. The Contract Administrator will also direct the contractor regarding the above matter when deemed necessary.

2.Contractor must coordinate with the City on all applications to abide by the City of Holland Public Notification Policy.

3.This contract is subject to annual budget approval by the City Council for Funding for Turf Contractual Services.

4.Payment is based upon a per unit application.

5.The City of Holland will not approve the use of 2,4-D on any of its properties.

6.The City of Holland will not permit the use Phosphates on any of its properties.
