Thank you for your information request received via our website on 29 June 2016. You asked:

I would like to see ALL correspondence between the DfE and IW Council on the issue of the appeal to the High Court and subsequent application for permission to appeal to the Supreme Court against the verdict of IW Council v Platt. Specifically the details of the arrangements on funding the legal fees that the IW Council will and has already incurred.

To be clear I’m not seeking anything that's legally privileged. But correspondence between officials and councillors is not privileged and should be made available.

I’ve already seen some on another foi dating back to last year between the DfE and Steve Crocker and I know there will be lots more since including a letter from the Schools Minister to IW Council.

After giving careful consideration to your request I am able to respond in part by providing you with some of the information you are seeking. I have enclosed two letters, one from Nick Gibbs MP, Minister of State for Schools to Councillor Bacon and one from Juliet Chua, Director, Post-16 and Disadvantage Group to John Metcalfe, Chief Executive of the Isle of Wight Council. I also enclose two emails from the Isle of Wight Council to the Department of Education.

Unfortunately, the Council is not able to give you the rest of the information for the reasons detailed in the refusal notice enclosed.

The Isle of Wight Council in complying with their statutory duty under sections 1 and 11 of the Freedom of Information Act to release the enclosed information, will not breach the Copyright, Designs and Patents Act 1988. However, the rights of the copyright holder of the enclosed information will continue to be protected by the law. If you wish to use this information, you may require approval or licence from the copyright holder.
