The Rules & Regulations Policies Governing Grove Isle @Vero Beach Condominium Association, Inc.

These Rules & Regulations Policies are based on the Articles of Incorporation, Declarations, Bylaws and Amendments thereto of Grove Isle @Vero Beach Condominium and Grove Isle East Condominium andapplicable Florida statutes and case law.

They provide fair, reasonable and consistent rules and regulations to ensure the safety and peaceful enjoyment of allOwners or Valid Lessees and their respective visitors to our Grove IsleCommunity.

I. ROAD SAFETY POLICY

All Drivers shall:

a. obey the 20 mph speed limit;

b. come to a complete stop at all stop signs;

c. comply with all posted signs;

d.signal for all turns;

e. yield to pedestrians;

f. hold a valid driver’s license;

g. comply with requests by Gate House Security Guards; and,

h. MAKE “ONLY” A RIGHT TURN WHEN EXITING GROVE ISLE.

Walkers/Joggers/Pet Walkers shall walk FACING the traffic; carry lighted flashlights and wear light colored clothing at dawn, dusk, evening and when visibility is poor; use existing sidewalks; walk

single file when vehiclesapproach; and, not gatherin groups in the road.

Pet Walkers shall use a leash no longer than 6’ long; have complete control of the pet at all times; and, removeand properlydispose of pet feces. Pet feces shall not be deposited in lakes.

3. Cyclists and wheel chair users shall ride WITH the traffic and illuminate cycles and wheel chairs withlights and/or reflectors.

II. SMOKING POLICY

A. Smoking of tobacco productsis PROHIBITED as follows:

1. in the INTERIOR of AND WITHIN 30 FEET of both Clubhouses; Management Office building; and, Gatehouse.

2. WITHIN 30 FEET of all sides of all condominium buildings and all villas.

3. in and on all Recreational Facilities.

B. Smoking of tobacco productsis PERMITTEDbeyond the 30 FOOT area described above and inside a condominium unit/villa unit and/or a vehicle, PROVIDED, all doors and windows are closed during the smoking period and all debris is removed from any Common Element and Limited Common Element used for smoking.

III. BOATING/KAYAK/CANOE POLICY

A. Boat, Kayak and Canoe Registration Policy.

1. ONLYOwners or Valid Lesseeswho have filed a completed Vessel Registration Form (VRF)and have received from the

Manager a Vessel Registration Tag and affixed same to her/his vessel shall use Boat Launching Facilities and the Fish Cleaning Station. (Acopy of the VRF is attached as Form 1.)

2. The Rules of Use governing the Boat Launching Facilities are clearly stated on the posted signs, including a map of the route to be followed to gain access to the Indian River, a Florida waterway. All Owners and Valid Lessees must obey the posted Rules of Use .

3. No boat, canoe and/or kayak shall be admitted at the Gatehouse without a Vessel Registration Tag properly affixed to it.

4. There is no permanent parking and/or docking facilities forRegisteredboats, canoes and kayaks brought into Grove Isle. Short term docking and parking of licensed boat trailers at the River Edge Clubhouse is available with written permission of the Manager, at the sole discretion of the Manager,on an as needed basis.

B. Kayak and Canoe Storage Slip Policy

1. ON AN ANNUAL BASIS, Owners or Valid Lessees are eligible for assignment of 1 ofthe 42 kayak and canoe storage slips, based on the following procedure:

a. submission to the Manager, each January, of the RESERVATION REQUEST FORM (RRF). (A copy of the RRF is attached as Form 2.).

b. only requests submitted on the RRF will be processed.

c. each RRFwill be date and time stamped, as received by the

Manager, in order to establishassignment priority.

d. the Board will complete the assignment of the slips no later than 10 business days after each January 31st.

e. the Manager will deliver written slip assignment notices, via e-mail or USPS, as indicated on the RRF by the applicant, no later than 5 business days thereafter.

2. Assigned slip Owners or Valid Lessees shalluse only the slip assigned.

3.Ownerswho have sold her/hisunit, villa or Garden Home OR who no longer wish to use the assigned slip OR Valid Lessees who no longer havea Valid Lease with an OwnerOR who no longer wish to use the assigned slip, must immediatelynotify the Manager, in writing, via e-mail or USPS, and must remove her/his kayak/canoe from the slip within 5 days thereafter.

4. Vacated slips will be assigned based onthe remainingRRFs for that year.

5. OWNERS OR VALID LESSEES SHALL REMOVE HER/HIS KAYAK OR CANOE FROM THE ASSIGNED SLIP AND STORE IT SECURELY IN THE EVENT OF A SEVERE STORM, HURRICAN AND/OR TORNADO.

6. Owners or Valid Lessees who accept a slip assignmentassume all risk for the storage of the kayak or canoe and indemnify and hold harmless the Association from any and all damage and/or injury caused by and/or resulting from her/his use of the storage slip, including damage to the kayak or canoe while in the slip.

IV. ALCOHOLIC BEVERAGE POLICY.

All events conducted in/on theRecreation Facilitieswhich are sponsored by the Associationorits authorizedCommittees and

Clubsare prohibited from furnishing, serving, distributing and/or providing alcoholic beverages at all such events. Attendees at all such events, 21 years of age and over, may bring alcoholic beverages to such events for her/his personalconsumption.

V. GENERAL USE OF THERECREATION FACILITIES POLICY

A. The Recreation Facilitiesare used at the sole risk of the user.

B. Only Owners or Valid Lesseesand their respectivevisitors shall use the Recreation Facilities.

C. All other persons usingthe Recreation Facilities shall be deemedto be trespassers and shall be legally removed from Grove Isle.

D. All posted signs must be followed.

E. Children under the age of 16 years must be accompanied by and supervised byOwners or Valid Lessees or her/his appointed responsible adult.

F. Owners and Valid Lessees are liable to the Associationfor all personal and real property damage and all injuries topersons

caused by and/or resulting from their actions and the actions of their visitors.

VI. USE OF SWIMMING POOLS AND SPA POLICY

These pool and spa rules are based on Florida Statutes, Chapters 514.001; 515.23; 64E-9; 64-E-9.004(14); 64E-9.008(7) (8) (9); 64E-9.10(10);(14)(a)(b)(c)(d); & (15); 64E-9.0035(1)(a)(1); and Form

(DH 1704); Insurance Risk Factors; fines to violators; and the cost

and inconvenience to the entire Grove Isle Community for draining the pools and spa in the event of contamination. They are applicable to Grove Isle Pools because Grove Isle is a condominium community of more than 35 units.

A. There is never a lifeguard on duty. Use of the pools/spa are at the sole risk of the user.

B. All posted signs must be followed.

C. Pool hours are from 7:00AMto 10:30PM. Continuous use of the spa is limited to 15minute intervals. Use of the spa is prohibited for persons who are pregnant.

D. Main Clubhouse pool capacity is 65 persons; spa capacity is 5 persons; River Edge Clubhouse pool capacity is15 persons.

E. USERS MUST SHOWER EACH TIMEBEFORE ENTERING.

F. Proper swimming attire is required.

G. Use is prohibited by persons who:

1. take substances which cause drowsiness, dizziness, nausea,

incontinence and/ordiarrhea.

2. have a communicable disease;a skin rash; skin disease; and/or open wounds;

3. wear adult diapers;

4. have any condition which could result in contamination of the pools/spa.

H. Children 3 years old and under and any child who is not toilet trained is prohibited from using the pools and spa.

I. Animals are prohibited in the enclosed pools/spa areas.

J. GLASSWARE, BEVERAGES AND/OR FOOD ARE PROHIBITED IN THE RIVER EDGE CLUBHOUSE POOL PURSUANT TO FLORIDA STATUTES.

K. Glassware, beverages and/or food are prohibited within 8 feet of the Main Clubhouse pool and the spa pursuant to Florida Statutes.

L. Diving/jumping into the pools/spa and use of pool toys, rafts, tubes and floats are prohibited.

M. Radios, i-Pads, i-Phones, i-Pods and Tablets are permitted ONLY if used with ear buds.

VII. PERSONAL USE OF CLUBHOUSES FOR SOCIAL EVENTS POLICY

The Main Clubhouse and the River Edge Clubhouse shall be reserved for personal use, only byOwners or Valid Lessees,in accordance with the terms and conditions of thePERSONAL USE OF CLUBHOUSE RESERVATION FORM, a copy of whichis attached as Form 3.

VIII. REFUSE DISPOSAL AND RECYCLING POLICY

1.Refuse Disposal.

A. All refuse shall be properly secured in plastic garbage bags and disposed of in any of the dumpsters located throughout Grove Isle.

B. If a dumpster is full,another dumpster shall be used. Refuse bags maynot be left outside of a dumpster nor in the Common Elements nor in the Limited Common Elements.

C. Hazardous Waste items, including but not limited to, electrical appliances, computers, i-pads, i-phones, televisions, batteries, motor oil, paint, paint cans, paint brushes, paint rollers, paint roller

trays, pesticides and tires and all refuse which is too large to fit into

a dumpster shall be disposed of at the Indian River County Landfill,

located at 959 1st Place (1st and Old Dixie Highway), Vero Beach, FL.

2. Recycling.

A. Paper recyclable items, including but not limited to, newspapers, inserts, catalogs, magazines, brochures, phone books, envelopes, junk mail, brown paper bags, corrugated cardboard, shredded paper, paper plates and cups and food boxesSHALL ONLY be placed in the blue recycle bin labeled “CARDBOARD & MIXED PAPER ONLY”.

B. Glass, plastic and metal recyclable items, including but not limited to, jars, bottles, aluminum cans, plates and trays, steel cans, aerosol cans, juice and mike cartons, liquor/wine/beer bottles, plastic utensils and plastic containers SHALL ONLY be placed in the blue recycle bin labeled “COMINGLED ONLY”.

C.Recyclable items which aretoo large to fit in the proper recycle bins shall be disposed of at the Indian River County Landfill, the

address for which is shown at Item 1.C. above.

D. If the proper recycle bin is full, another proper recycle bin shall be used. Recyclable itemsshall not be placed in an improper bin nor outside of a bin nor in the Common Elementsnor in the Limited Common Elements.

E. ALL CARDBOARD BOXES SHALL BE BROKEN DOWN. Those too large to fit in the proper recycle bin, AFTER BEING BROKEN DOWN, shall be tied securely and placed next to the recycle bin labeled “CARDBOARD & MIXED PAPER ONLY”.

IX. WILDLIFE INTERACTION POLICY

A. Florida Administrative Code, Title 68, of the Fish and Wildlife

Conservation Commission regulates all activities involving Wildlife. Chapter 68A-4.04-4.081 of the Code prohibits feeding, importing, buying, selling, possessing and releasing wild animals. Commission officers have the authority to investigate and prosecute offenders. Civil and criminal penalties can be imposed on proven violators.

B. Contact with rabid wild animals is physically dangerous.

C. Leaving food for wild animals attracts rodents, wild animals and insects.

D. The Grove Isle WILDLIFE POLICY is:

DO NOT TOUCH AND DO NOT FEED WILD ANIMALS.

X. NATURE TRAIL/BUTTERFLY GARDEN/OBSERVATION DECK POLICY

1. Nature Trail.

A. Smoking is prohibited on the Nature Trail and Butterfly Garden.

B. Pets, except for service animals, are not permitted.

C. Vehiclesare not permitted, unless authorized by the Manager.

D. Plants and flowers are for all to enjoy and may not be removed.

2. Observation Deck.

A. Smoking is prohibited on the Observation Deck.

B. All food items, personal belongings and all refuse resulting from use of the Observation Deck, no matter how minute, shall be removed and disposed of in accordance with the REFUSE DISPOSAL AND RECYCLING POLICY set forth above at Article VIII.

XI. ENTRANCE BAYS AND WALKWAYS POLICY

Entrance Bays are defined as Common Elementsin the Declarations.

These areas are governed by the Indian River County Fire Rescue Safety Codes which apply to all means of ingress and egress for buildings and individual living units.

The applicable Code Sections state as follows:

7.1.10.1 – “Means of egress shall be continuously maintained with 36” clear path of travel, and free of all obstructions or impediments to full instant use in case of fire or other emergency.”

7.1.10.2.1 – “No furnishings, decorations, or other objects shall obstruct exists or their access thereto, egress therefrom, or visibility thereof. No storage is allowed under or within 10 feet of exterior stairs.”

7.2.1.1.2 – “Every door opening and every principal entrance that is required to serve as an exit shall be designed and constructed so

that the path of egress travel is obvious and direct.”

7.1.6.4 – “Walking surfaces shall be slip resistant under foreseeable

conditions. The walking surface of each element in the means of egress shall be uniformly slip resistant along the natural path of travel.”

13.7.3.3.5 – “Manual fire alarm boxes shall be installed so that they are conspicuous, unobstructed, and accessible”.

XII. GATEHOUSE SECURITY POLICY

The purpose of Gatehouse Security is to strictly control and

properly identify all visitors entering Grove Isle. The procedures are set forth below and shall be strictly enforced.

1. REQUIREMENTS OF UNIT OWNERS AND VALID LESSEES.

A. Register up to two vehicles with the Manager.

B. Display theGreen Owner Parking Sticker (Green Sticker) OR the Red Valid Lessee Parking Sticker (Red Sticker) on the lowerleft corner of the front windshield of the driver’s side of the vehicle registered with the Manager.

C. Enter Grove Isle through the “OWNERS” gate, using the remote control clicker.

D. Never permit her/his remote control clicker to be used by anyone else to enter Grove Isle.

E. Obtain from and surrender the Red Stickers and remote control clickers upon the termination of the Valid Lease and deliver the Red Stickers to the Manager for cancellation.

F. Call the Gatehouse; give the Security Guard her/his full name and unit number; provide the Security Guard with the name and time of arrival of the expected visitor; and, authorize the Security Guard to admit the visitor.

G. Provide the Gatehouse Security Guard with a written Guest List of 5 or more expected visitors for an specific event.

G. Explain, in advance, to visitors, the visitor policy for entrance into Grove Isle.

If the Gatehouse Security Guard is not notified of expected visitors

as set forth above, the Security Guard will phone the Owner or Valid Lessee to obtain authorization to admit the visitor. If the Security

Guard is unable to obtain proper authorization, the visitor will be denied access to Grove Isle.

2. ACCESS REQUIREMENTS FOR ANYONE USING VISITORS’ GATE.

Anyone entering Grove Isle through the Visitors’ Gate, including Unit Owners or Valid Lessees not using the Owners’ Gate, shall:

A. Come to a full stop at the Gatehouse.

B. Produce a valid photo Driver’s License for inspection.

C. Comply with the instructions of the Security Guard.

D. Be authorized for admittance by the Unit Owner or Valid Lessee.

Any visitor who refuses to comply with the Visitors’ Gate Access Requirementsshall be denied access to Grove Isle.

3. ADDITIONAL REQUIREMENTS FOR SPECIFIC VISITORS.

A. PROCESS SERVERS/BANK INSPECTORS must also show written Court authorization documents.

B. REAL ESTATE AGENTS must also show photo business cards.

C. LAW ENFORCEMENT AGENTSmust also show official Photo IDs and badges. BADGES ALONE ARE NOT SUFFICIENT.

D. PROSPECTIVE BUYERSmust personally comply with all Visitors’ Gate Access Requirements and must also be accompanied by the Real Estate Agent/Broker legally authorized by the Owner/sto show the respective Unit, Villa, and/or Garden Home offered for sale.
