THE PROVISION OF DISTRICT LIBRARY SERVICES

WITHIN THE North Central Library DISTRICT

THE NEGOTIATION PROCESS:

This agreement was developed by the District Executive Committee, which met on May 18, 2016. The members of the District Executive Committee are:

A majority vote of the District Executive Committee will recommend the agreement for consideration of the member libraries. The agreement must then be approved by the District Library Center and a majority of the member libraries. Upon ratification by the majority of the member libraries and subsequent approval by the Office of Commonwealth Libraries, the agreement will be in effect for all public libraries in the North Central Library District.

PARTIES TO THIS AGREEMENT:

District Library Center:James V Brown Library is the District Library Center for the public libraries in Bradford, Clinton, Columbia, Lycoming, Montour, Potter, Snyder, Sullivan, Tioga and Union counties, and part of Northumberland County known as the North Central Library District.

Library Systems: Library systems include the Lycoming County Library System, Union County Library System, Potter-Tioga Library System, and Bradford County Library System.

Member Libraries: Member libraries are those public libraries that qualify for and participate in the State Aid Program administered by the State Library of PA. Member libraries include membersand branches of the member libraries. Member Libraries receive all district services.

Affiliate Libraries: Affiliate libraries are those public libraries located within the geographic boundaries of the North Central Library District which do not meet state standards for public library service and which do not qualify for or participate in the State Aid Program administered by the State Library of PA.

Signatories: Signatories to this agreement are the representatives of the District Library Center and the member libraries, with written approval of Office of Commonwealth Libraries.

CONDITIONS:

This agreement is in effect from July 1, 2016, through June 30, 2017.

This agreement is predicated upon receipt of District Library Center aid in the amount of $387,828. Any change in funding greater than +/- 10% shall require all parties to agree to an amended service plan.

District funds are to be used to provide services, as described in this agreement, to the public libraries in the district, and all residents of the district.

North Central Library District Centeris entitled to an administrative fee up to 5%.

MEMBER LIBRARY RESPONSIBILITIES:

Comply with standards for public library services set by the State Library of Pennsylvania. Libraries unable to comply with the standards shall submit a statement to the State Librarian and to the District Library Center Administrator, detailing areas of non-compliance and outlining remedial efforts. If a library does not meet standards and fails to make a good faith effort to meet standards, then the District Library Center reserves the right to limit district services offered to that library.

File all annual reports, and other documents required by the Office of Commonwealth Libraries or the District Library Center in a timely manner.

Comply with procedures for District Services.

Participate in the District Advisory Council, District Librarians meetings, and other District meetings.

Participate in District planning and review efforts.

Promote the use of District services to their customers.

Provisions for the District Negotiated Agreement are found in 9301 Education Code(24 PA.C.S.) – Public Library Code, Act of Nov. 1, 2012, P.L. 0, No. 210 §9338 (c)(2) and §141.22(c)

Terms of the agreement:

1. The District Library Center provides a District Consultant Librarian to advise member libraries; to act as a liaison between member libraries, the District Library Center and the Office of Commonwealth Libraries; and coordinate District-wide projects.

2. The District Library Center will fund Interlibrary Loan Service providing service through the OCLC Interlibrary Loan Subsystem and Access Pennsylvania.

3. The District Library Center will maintain a collection of current relevant materials including collection development staff to support the needs of interlibrary loan.

4. The District Library Center will provide support staff for collection development of Overdrive materials and support with member libraries for training on ebook technology.

5. The District Library Center will provide support staff for reference services to support the reference services of the provided by the member libraries.

6. The District Library Center will provide a District Administrator.

7. The District Library Center will provide one full-time technology consultant to provide training and support.

8. The District Library Center will provide web site services for member libraries.

9.The District Library Center will provide one Chief Financial Officer to oversee finances, develop financial reports, and provide assistance in human resources and financial management.

10. The District Library Center will provide one Technical Services Librarian with an MLS degree to provide support on cataloging, and also process all district materials.

11. The District Library Center will provide one part-timeYouth Services Consultant with an MLS degree and expertise in programming.

12. The District Library Center will provide Marketing and Public Relations support.

13. The District Library Center will provide no fewer than four (4) continuing education programs annually.

14. The District Library Center will provide electronic resource programs for library staff and the public.

  1. The District Library Center will review and file all annual reports and other state-required forms.

FAILURE TO PERFORM

In the event that a member library or libraries feel that the District Library Center is failing to perform in accordance with the terms of this agreement, a written complaint shall first be registered with the District Consultant. The District Consultant will attempt to resolve the issues in concert with the District Center Administrator. Should the District Library Center be unable or unwilling to resolve the issue to the satisfaction of the member library or libraries, a liaison from the Office of Commonwealth Libraries will meet with the complainant, the District Library Center Administrator, the District Consultant, and, if deemed advisable, the District Advisory Council. Failure to resolve the issue at this step shall result in the involvement of the Deputy Secretary of Education, and Commissioner for Libraries, with appeal to the Governor’s Advisory Council on Library Development. It is clearly understood that among the consequences of District Library Center nonperformance are possible loss of District Library Center designation and/or return of District Library Center aid.

In the event that a member library fails to comply with the responsibilities listed above, the District Library Center, working in consultation with the Office of Commonwealth Libraries liaison, shall have the right to limit or suspend District Library Center services to said member library to the extent permitted by law.
