2.Notification

1.Thecouncilwillconsiderrestricteddiscretionaryactivityresourceconsentapplicationsforframeworkplans(includingamendmentstoanapprovedframeworkplanorareplacementframeworkplan)withouttheneedforpublicnotification,howeverlimitednotificationmaybeundertaken,includingnoticebeinggiventoanyowneroflandwithinsub­precinctAwhohasnotprovidedtheirwrittenapproval.

3.Frameworkplans

1.Aresourceconsentapplicationforaframeworkplan,amendmentstoanapprovedframeworkplanorareplacementframeworkplanmust:

a.applytoallorpartofsub­precinctA,or

b.applyonlytolandthattheapplicantisthelandownerof,ortositesinmultipleownershipwherethelandownersmakeajointapplication,and

c.complywiththegeneralrulesapplyingtoframeworkplansspecifiedinclause2.6and2.7.3ofthegeneralprovisions

3.Incircumstanceswhereanapprovedframeworkplanapplies,anysubsequentapplicationtoinfringethebuildingheight(clause4.1oftheCityCentrezonerules)andmaximumfloorarearatio(clause4.20oftheCityCentrezonerules)developmentcontrolswillrequireanapplicationtoeitheramendtheframeworkplanoranapplicationforanewframeworkplan.Intheseinstances,theactivitystatusofthedevelopmentcontrolinfringementwillapply.

4.Developmentcontrols

ThedevelopmentcontrolsintheCityCentrezoneapplyintheQuayParkprecinctunlessotherwisespecifiedbelow.

4.1 Building height

Purpose:managetheheightofbuildingstoachievepolicies4and5oftheQuayParkprecinct.

1.Buildingsmustnotexceedtheheightsshownonprecinctplan2­4.

4.2Buildingfrontageheight

Purpose:managethefrontageheightofbuildingstomaintainpedestrianamenityandmaintainlowbuildingheightsaroundpublicopenspace.

1.Oneveryfrontageidentifiedonprecinctplan1,buildingsmustnotprojectbeyonda45degree recessionplanemeasuredatallpointsalongthefrontageofthesitefrom18mabovemeanstreetlevel.Thebuildingsetbackmustbeanemphaticorasteppedprofileofatleasttwostoriesandmustnotbe aliteralregressionofthe45degreeangle.

4.3Siteintensity

Purpose:managethescale,formandintensityofdevelopmenttomaintainthecharacteroftheQuayParkprecinct.

1.Thebasicandthemaximumfloorarearatiopermittedwithintheprecinctis3:1.

2.ExcludedfromthecalculationofthebasicandmaximumfloorarearatioareparkingareasincorporatedwithinthebuildingtoanequivalentFARof1:1.

5.Assessment­Restricteddiscretionaryactivities

5.1Mattersofdiscretion

FordevelopmentthatisarestricteddiscretionaryactivityintheQuayParkprecinct,thecouncilwillrestrictitsdiscretiontothefollowingmatters,inadditiontothemattersspecifiedfortherelevantrestricteddiscretionaryactivitiesintheCityCentrezone.

1.Frameworkplan,amendmentstoaframeworkplanandareplacementframeworkplan

a.integrationofthedevelopmentwithneighbouringareas

b.therelationshipoflandform/sitecontourswithbuildinglevels

c.thelocation,physicalextentanddesignofstreetsandpedestrianconnections

d.thelocation,physicalextentanddesignofopenspace

e.thelocationandcapacityofinfrastructureservicing

f.thestagingofdevelopmentandtheassociatedresourceconsentlapseperiod

5.2Assessmentcriteria

FordevelopmentthatisarestricteddiscretionaryactivityintheQuayParkprecinct,thefollowingassessmentcriteriaapplyinadditiontothecriteriaspecifiedfortherelevantrestricteddiscretionaryactivitiesintheGeneralCoastalMarineandCityCentrezones.

1.Frameworkplan,amendmentstoaframeworkplanandareplacementframeworkplan

a.Integrationofthedevelopmentwithneighbouringareas

i.Wheretheframeworkplanisforaparticularsiteorsub­precinctwithinawiderprecinct,the

frameworkplanshoulddemonstratehowthedevelopmentachievestheoverallobjectivesoftheprecinct,includingtheintegrationofstreets,pedestrianconnections,openspacesandotherinfrastructurethatwillservethedevelopment.

ii.

Therelationshipoflandform/sitecontourswithbuildinglevels

•Theproposedfinishedcontourlevelsacrossthesubjectlandareashouldavoidvariationsbetweenthegroundfloorleveloffuturebuildingsandadjoiningexistingandproposedpublicopenspace(whereinformationisavailable).Wheregroundfloordwellingsorvisitoraccommodationisproposed,someminorvariationbetweenthegroundfloorlevelandthelevelofadjoiningpublic openspacemaybeacceptabletoprovidefortheprivacyofresidentsconsistentwiththeassessmentcriteriaforgroundfloordwellingsintheCityCentrezone.

c.Thelocationandformofbuildings(buildingfootprintsandenvelopes)

i.Buildingfootprints,profilesandheights(asopposedtodetailedbuildingdesign)shouldestablishanintegrated,legibleandhighqualitybuiltformandspatialframeworkacrossthesubjectlandareawhilealso:

•avoidingmonotonousbuiltformwhenviewedfrompublicopenspacethroughvariationinbuildingfootprints,heightandform.

•enhancingandactivatingproposedopenspaceareaswithinthesite.

•enhancingtheformandfunctionofexistingandproposedstreets,andlanes(includingthroughsitelinks)withinandoutsideofthesite.

•maximisingviews,outlookandsunlightaccessforfuturesiteoccupants.

•protectingviewstoscheduledheritageplacesi.e.DilworthViewshaftsandAucklandMuseum

d.Thelocationoflanduseactivitieswithinthedevelopment

Thelocationandstagingofanticipatedactivitytypesand/orthelocation,orientationorlayoutofbuildingsshouldavoidormitigatespotentialconflictsbetweenactivitieswithinthesubjectlandarea.

Opportunitiestoestablishcommunityfacilitiesforfutureoccupantsofthesiteandforthewidercommunityareencouragedwithinthedevelopment.

Theframeworkplanshoulddemonstratethatafine­grainedstreetandblockpatternisprovidedwithinsub­precinctAthatenhancesconnectivitybetweentheStrand,QuayStreetandBeachRoad.Theframeworkplanshouldalsodemonstratehowtheproposedstreetlayoutprovideslogical,convenientandattractiveconnectionswithotherstreets,pedestrianconnectionsandopenspaceswithintheprecinct.

Thelayoutofbuildingsshouldensurewell­connected,legibleandsafevehicularandpedestrianrouteswithappropriateprovisionforfootpaths,servicing,infrastructureservicesandlandscapetreatment.

Safe,practicalandefficient24hrthrough­sitelinksareencouragedthroughtheblock.Whereprovided,thethrough­sitelinkmustbeabletocomplywiththerequirementsforthrough­sitelinksintheCityCentrezone.

Thelayoutanddesignofpublicopenspaceshouldmeetthedemandoffutureoccupantsofthesiteandbeofahighquality,providingforpublicuseandaccessibility,views,sunlightaccessandwindprotectionwithintheapplicationarea.

f.Thelocationandcapacityofinfrastructureservicing

i.Stormwater,wastewater,watersupply,electricityandtelecommunicationinfrastructurewillneed

tobeprovidedtoadequatelyservicethenatureandstagingofanticipateddevelopmentwithintheapplicationarea.

ii.

Stormwatermanagementmethodsthatutiliselowimpactstormwaterdesignprinciplesandimprovedwaterqualitysystemsareencouraged.

g.Thestagingofdevelopmentandtheassociatedresourceconsentlapseperiod

i.Theframeworkplanshoulddetailthemethodsbywhichthedemolitionanddevelopmentofthe sitewillbestagedandmanagedtocomplimenttheproposedopenspace,roadandlanenetworkandtoavoid,remedyormitigateadverseeffectsassociatedwithvacantdisusedareasofthesite.

h.Thelocationandphysicalextentofparkingareasandvehicleaccess

i.Parking,loadingandservicingareasshouldbeintegratedwithintheapplicationareatakingaccountoflocationandstagingofanticipatedactivitytypes.

6.Assessment­Development controlinfringements

6.1Mattersofdiscretion

Inadditiontothegeneralmatterssetoutinclause2.3ofthegeneralprovisions,andthespecificmatterssetoutfortheinfringementintheCityCentrezone,thecouncilwillrestrictitsdiscretiontothemattersbelowfortherelevantdevelopmentcontrolinfringement:

a.buildingscaleanddominance/visualamenityeffects

b.effectsonthecurrentorplannedfutureformandcharacteroftheprecinct.

2.Buildingfrontageheight

a.buildingscaleanddominance/visualamenityeffects

b.effectsontheplannedfutureformandcharacteroftheprecinct

c.pedestrianamenityandfunction.

6.2Assessmentcriteria

Inadditiontotheassessmentcriteriainclause2.3ofthegeneralprovisions,andthespecificassessmentcriteriafortheinfringementintheCityCentrezone,thecouncilwillconsidertherelevantassessmentcriteriabelowfortheinfringementlisted.

1.Buildingheight

a.Buildingheightmaybeexceededwhereitwouldprovideanattractiveandintegratedroofformthatalsomeetsthepurposeofthecontrol.

b.Wherebuildingheightisexceeded,policies4and5oftheQuayParkprecinctandpolicy17oftheCityCentrezoneshouldbeconsidered.

2.Buildingfrontageheight

a.ThescaleofthedevelopmentshouldbeconsistentwiththeplannedfuturecharacterofQuayParkasestablishedthroughtheobjectivesandpoliciesfortheQuayParkprecinct.

b.Pedestrianamenityshouldbemaintainedorenhanced.

7.Specialinformationrequirements

1.Anapplicationforaframeworkplan,amendmentstoanapprovedframeworkplanorareplacementframeworkplanmustcomplywiththespecialinformationrequirementsforframeworkplans

inclause2.7.3ofthegeneralprovisions,andprovidethefollowinginformationasaminimum:

a.Plansshowingtheproposedbuildingprofileandheightasviewedfromallexistingandproposedstreetandlanefrontagesandexistingandproposedpublicopenspaces.Buildingprofilemeanstwodimensionalandthreedimensionalbuildingblockelevationsandbuildingcrosssectionsshowing:
