The Minutes of the 204th Meeting of the NRC held from 27th August, 2012 to 29th August, 2012

The 204th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 27th August, 2012 to 29th August, 2012 at NRC, NCTE, Jaipur.

The following were present:

The Regional Director, NRC apprised the Northern Regional Committee about the provision of the NCTE Act, Rules, Regulations and instructions issued from time to time.

With the permission of Chairperson, Dr. Ram Kishor (Convener) presented the Agenda before the Committee. Item-wise decisions taken are as follows:-

AGENDA ITEM NO.- 204.1 / CONFIRMATION OF MINUTES OF 203rd MEETING / NRC confirmed the minutes of 203rd meeting with the modifications that the decision taken by the NRC against agenda item no. 203.38.56 in the case of “(NRCAPP-2533)” be read as “VT be constituted”.
In the decision mentioned against agenda item No. 204.25.2 in the case of “NRCAPP-2351” be read as “VT be constituted”.

·  Three academic sessions is not complete as required under clause 8 (3) of NCTE Regulations, 2009 to apply for additional course.
Hence, NRC decided that the application for the said course be rejected under provision of NCTE, Regulations, 2009 on the above point.

3.  / 204.4.2 / NRCAPP-2199 / SAM HIGGINBOTTOM INSTITUTE OF AGRICULTURE TECHNOLOGY AND SCIENCES-512-ALLAHABAD(UP) / M.P.Ed / The original file of the Institution and reply submitted by the institution, along with other related documents, NCTE Act, 1993, Regulations and Guidelines of NCTE published from time to time has been carefully considered by NRC.
The Committee discussed and considered the case in detail and following observations were made:
·  The land document shows that the land was given for experimental work in connection with Agriculture College only. The change of land use is not for running M.P.Ed. Course.
·  There is no resolution of the society for starting D.El.Ed. Course.
·  Building plan as required under provision (ii) & (iii) of deficiency letter not submitted.
·  Date of registration of land document not mentioned in the affidavit.
·  The institution does not have NAAC certificate as required in clause 8 (4) of NCTE Regulations, 2009 to apply of M.P.Ed. Course.
Hence, NRC decided that Show Cause Notice under section 14/15 (3) (b) of NCTE Act, 1993 be issued to the Institution on the above point and direct the Institution to submit the reply as per the provisions of NCTE Act, 1993 Rules & Regulations within 21 days from the date of issue of Show Cause Notice.

·  NRC confirms its order dated 09.09.2010 withdrawing the recognition for B.Ed. Course.
·  In compliance with the order of the Hon’ble High Court at Judicature at jodhpur in writ petition NO. 11048/2010 dated 02.02.2012, inspectin was conducted under section 17 on 12th & 13th, March, 2012. Show Cause Notice was issued to he institution after considering VTR on 12.06.2012. reply submitted by the institution in response to SCN dated 12.06.2012 is not satisfactory.
(i)  Faculty appointed by the institution for B.Ed. Course has not been approved by the affiliating university.
(ii)  Institution has not submitted details of salary paid to teachers as per clause 4(v)(d)/4(a)(d) of NCTE norms for respective teacher training course with supporting documents.

6.  / 204.6.1 / RJ-1098 / AADINATH SHIKSHA SANSTHAN, UDAIPUR, RAJASTHAN / B.Ed. / The Northern Regional Committee in its 204th meeting held from 27th – 29th August 2012 considered the Visiting Team Report received from the NCTE Hqrs alongwith all related document of the institution in light of provisions of the NCTE Act, Rules & Regulations.
The Committee after going through all relevant records, VTR viz-a-viz provisions of the NCTE Act, Rules & Regulations, the NRC deliberated and considered the case in detail. The Committee observed the following:-
(i) The Adinath Trust initially established a school on the allotted land. The allotment of land was on lease basis from Rajasthan Urban Empowerment Trust Udaipur for residential purpose. Besides the school, two education courses B.Ed. & Shiksha Shastri are being offered from this building/ premises. The school occupies the ground and first floor. All the facilities i.e. classrooms, labs, library, halls, faculty rooms are being shared.
(ii) The size of classrooms, hall, library, laboratories are not as per NCTE norms and is inadequate and inappropriate for running B.Ed. and Shiksha Shastri programmes. A new building is being constructed but is neither complete nor adequate for teaching learning activities. There is no demarcation of space between the two teacher education courses.
(iii) Furniture provided in classrooms and office (i.e. principals & office staff) is acceptable but faculty rooms (male and female) are too shabby. They need dramatic improvement.
(iv) From the copies of two separate lease deeds executed between the Rajasthan Urban Improvement Trust Udaipur and the Adinath Society, it is observed that the society is in occupations of total land area of 23562 sq.ft. (22508 + 1054). The structure on the above land has been erected in a phased manner and a letter dt. 23.01.2001 of the City Development Authority, Udaipur does mention the construction approval for education purpose building completion certificate dated 6.6.2007 however, does not mention the area of construction.
(v) The ground and first floor of the building are occupied by a school being run by the same society. The second floor of the building is being used to run both the education courses i.e. B.Ed. and Shiksha Shastri. Third floor consists of room which was stated to be used for table tenis. Beside there was a temporary shed being used as canteen and open terrace.
(v) A multipurpose hall of approximates 1200 sq.feet. also exists on first floor where ermined exams of Shiksha Shastri were being conducted. However, there is no demarcation of space between the two courses and above the space provided was inadequate and inappropriate for running the education courses.
(vi) There are no common rooms for students. Two principles are sharing the rooms and in addition and an accountant is also there sharing the room. Corridors are converted into make shift rooms for the staff which is not appropriate.
(viii) Website address could not be accessed because of electricity failure.
(ix) Regarding Labs (a) Science lab need improvement especially for Chemistry Practical. (b) Pyschology lab need drastic change especially equipments. Tools have been obtained and are being used. Equipments inadequate. (c) In Educational Technology lab Irrelevant equipments have been obtained like typewrites whereas useful gadgets like P.A. system not obtained. (d) Other labs/Physical Education – not available. T.T. room is too small and stores used booklets and boxes.
Therefore keeping in view the provisions of the NCTE Act, Rules & Regulations the NRC decides that before taking final decisions the institution is required to submit its representation clearly clarifying the above points/observations alongwith supporting documents.
In addition to the above, the institution is also required to submit the following documents so as to verify the credentials of the institution to run teacher training programme as per provisions of the NCTE Act, Rules & Regulations.
(a)  A duly notarized copy of the demarcated building plan showing land no./plot no./khasra no., total land & built up area prepared by the approve Engineer/Architect certified by the competent govt. authority/local body authority & land and built up area earmarked to teacher training programme.
(b)  A duly notarized copy of the Building Completion Certificate duly issued by the approved Engineer/Architect certified by the competent govt. authority/local body authority (coy of the format is enclosed).
(c)  A list of qualified faculty duly appointed as per the provisions of the NCTE Regulations including qualification, percentage of marks, teaching experience etc. Countersigned by the Registrar of affiliating University alongwith an attested copy of the provisional qualification & experience certificate ( as per the format enclosed).
The institution shall submit the above details/clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.
Hence the NRC decides to issue Show Cause Notice under section 17 of the NCTE Act, to the institution on the above points and direct the institution to submit the reply accompanied with an affidavit as per provisions of the NCTE Rules & Regulations within 30 days.
7.  / 204.6.2 / RJ-620 / S.S. JAIN SUBODH MAHILA SIKSHA PRASHIKSHAN MAHAVIDHYALAYA, OPP. AIRPORT, SANGANER, DISTT. JAIPUR / B.Ed. / The Northern Regional Committee in its 204th meeting held from 27th – 29th August 2012 considered the report of the CBI, Jaipur alongwith all relate d document of the institution in light of provisions of the NCTE Act, Rules & Regulations.
The Committee after going through all relevant records, report of CBI viz-a-viz provisions of the NCTE Act, Rules & Regulations, and the NRC deliberated and considered the case in detail. The Committee observed the following:-
The institution vie letter No. SS/2005-6/1217 dt. 22.06.2005 submitted a letter No. JDA/Jopne-9/05/D-679 dt 21.06.2005 purportedly received from Dy. Commissioner, Zone-9, JDA, Jaipur informing therein that the building had been constructed as per norms and JDA had no objection in allowing the institution to run educational courses. The same has been found forged as verified by the CBI, Jaipur. Therefore the institution has contravened the provision of the NCTE Regulations.
The NRC further noted that as per the provisions contained in clause 7(I-B) of the NCTE Regulations, 2009 “Furnishing any wrong information or concealment of facts in the application, which may have bearing on the decisions making process or the decisions pertaining to grant of recognition, shall result in withdrawal of recognition of the institution besides other legal action against its management, order of withdrawal of recognition shall be passed after affording reasonable opportunity of hearing through a show cause notice to the institution.
Hence, the NRC decides to issue Show Cause Notice under section 17 of the NCTE Act, to the institution on the above points and direct the institution to submit the reply accompanied with an affidavit as per provisions of the NCTE Rules & Regulations within 30 days.
