PROVISIONS OF THE AGREEMENT:

  1. The purpose of this agreement is to define the liabilities of each of the parties in relation to granting the right for mobility to the partner university to the teacher for teaching assignments (STA) in the LLP-Erasmus programme.
  2. The agreement shall be effective from the date of signing by both parties and shall expire on ...... The stay in the institution referred to in point 3 must be begun and ended in the period from ...... to ...... (please define the term).

3. The beneficiary undertakes to complete the agreed “Individual Teaching Programme”, constituting an integral part of the agreement, during the stay lasting

4. The Beneficiary shall be granted a grant from the budget of the LLP-Erasmus programme for carrying out mobility referred to in point 3. The granted value of the grant is ...... EUR(say: ...... ). The funding obtained from the budget of the LLP-Erasmus programme (hereinafter referred to as Erasmus) is allocated for covering additional - not the main costs - associated with the mobility and stay in the partner university. The final amount of the grant will be defined by the university on the basis of a certificate confirming the period of stay abroad and, if applicable, documented costs of transport.

5. The grant shall be paid in the form of ...... (please specify the manner of payment of the granted grant).

6. The Beneficiary hereby declares that he/she is familiar with the formal criteria which should be met by academic teachers qualifying for mobility in the Erasmus programme and that he/she meets these criteria. The Beneficiary declares that he/she is familiar with the rules of the programme concerning staff mobility (the annex to the agreement between the university and the National Agency) and that he/she will follow these rules.

7. The Beneficiary declares that he/she has not obtained any other grant to cover the same costs connected with the mobility referred to in point 3 from other Community programmes or other initiatives of the European Commission.

8.The Beneficiary undertakes to update the “Individual Teaching Programme” (if applicable), which constitutes the basis for qualifying the Beneficiary before the mobility to the partner university.

9. The Beneficiary undertakes to submit to the University by ...... /...... /...... :

  • a document issued by the host university confirming the period of stay in the institution and carrying out the programme (together with the number of teaching hours);
  • a report on the stay at the host university according to the template and in the form required by the University;
  • a copy of the ticket with marked date of departure and return and the price – if the costs of transport were (co)funded from the budget of the Erasmus programme.

10. In the case of failure to submit the requested documents referred to in point 9 or in the case of failure to fulfil other provisions of the agreement by the Beneficiary, the University is entitled to terminate the agreement.

11. The Beneficiary undertakes, except for the occurrence of any cause referred to as force majeure (i.e. a situation beyond the control of the Beneficiary relating to a serious illness or unfortunate accident), confirmed in writing by a university coordinator and accepted by the National Agency of the LLP-Erasmus Programme (hereinafter referred to as the National Agency), to:

  • return the whole amount, or part of the received grant in the case of failure to fulfil any of the liabilities resulting from the present agreement;
  • return the whole amount, or part of the received grant in the event of cancelling the agreement.

The amount to be returned shall be defined by the University.

12. The Beneficiary hereby declares that he/she has been informed about the duty to obtain a document entitling him/her to receive healthcare services within the EU and the necessity to insure him/herself (costs of medical treatment, accident or third-party liability insurance) for the period of the trip and stay in the partner university.

  1. All personal data included in the agreement will be transferred pursuant to Regulation (EC) No. 45/2001 of the European Parliament and the Council on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data. The data will be transferred only in relation to the implementation of the agreement and supplementary actions by the University, the National Agency and the European Commission, with the possibility of transferring the data to the authorities responsible for inspection and audit in accordance with Community legislation (the Court of Auditors or the European Anti-Fraud Office (OLAF)).

Upon written application, the Beneficiary may gain access to his/her personal data and correct any information which is incorrect or incomplete. The Beneficiary should refer all the queries concerning the processing of his/her personal data to the University and/or the National Agency. The Beneficiary may file a complaint with reference to the processing of his/her personal data by the University and/or the National Agency to the Inspector General for Personal Data Protection orto the European Inspector for Personal Data Protectionin relation to the use of these data by the European Commission.

14. Introducing any changes to the present agreement requires written form.

15.Any disputes hereto shall be settled in accordance with Polish legislation.

16. The agreement was executed in two identical counterparts, one for each of the parties.
