ST. CLAIR COUNTY

The City Council of the City of Pell City met in a special called session at the City Hall at 5:00 p.m. on Thursday, October 23, 2014. Present were Council President James McGowan, Councilmembers Jay Jenkins, Dot Wood, Sharon Thomas, and Terry Templin. Those present constituting the entirety of the council, the following business was transacted:

The invocation was led by Councilmember Terry Templin.

The pledge to the American flag was led by Mayor Joe Funderburg.

The City Clerk had roll call for attendance.

At 5:02 p.m., Councilmember Templin made a motion to Suspend the Rules in order to enter into Executive Session for approximately 15 minutes. The motion was seconded by Councilmember Wood and unanimously approved by the council. On roll call vote, those voting aye being: Council President McGowan, Councilmembers Jenkins, Wood, Thomas and Templin. Nays: None. The purpose of the Executive Session was to discuss matters that were controversy and likely to be litigated.

At 5:19 p.m., Councilmember Wood made a motion to resume the meeting. The motion was seconded by Councilmember Templin and unanimously approved by the council.

On motion of Councilmember Templin, seconded by Councilmember Wood, the council approved the following resolution with Councilmember Jenkins voting no:

RESOLUTION NO. 2014 – 4372

WHEREAS, D. Patrick Draper has served as City Manager for the City of Pell City since July 2012; and,

WHEREAS, Mr. Draper has submitted his resignation as City Manager to the City, such resignation to become effective on the 23rd day of October, 2014; and,

WHEREAS, the City desires to retain the services of Mr. Draper for consultation and assistance in connection with the transition of his vacation of the office of City Manager and the orientation of his replacement, pursuant to terms and conditions of the Agreement, which is attached hereto as Exhibit A and incorporated herein by reference.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pell City, Alabama, as follows:

1. That the City of Pell City hereby accepts the resignation of D. Patrick Draper as City Manager for the City of Pell City effective on the 23rd day of October, 2014.

2. That the Mayor be, and he hereby is, authorized to execute the attached Agreement on behalf of the City of Pell City, which is attached hereto as Exhibit A and incorporated herein by reference, authorizing the services of Mr. Draper for consultation and assistance in connection with the transition of his vacation of the office of City Manager and the orientation of his replacement in accordance with terms and conditions of said Agreement.

City Manager Patrick Draper read a statement announcing his resignation from the City. Mayor Funderburg and council members thanked Mr. Draper for his service to the City.

On motion of Councilmember Wood, seconded by Councilmember Templin, the council adjourned subject to the call of the Council President.
