Summary of CC&Rs
The information which follows is provided to supplement the governing documents of the Association which you should have received as a new homeowner prior to the closing on your home. If you are renting and have any questions on the governing documents, please contact The Property Management Group or a member of our HOA Board.
1. Animals: The subject of animals is covered in the CC&R’s. Generally each Owner/Renter is permitted to have two cats and/or dogs, but no more than three in total, provided they are not kept, bred or maintained for any commercial purpose. All dogs must be kept under leash or controlled at all times and it is the responsibility of each pet owner to clean up after their pets. The Board is given great latitude in determining whether or not a particular animal is a nuisance, particularly in the case where the animal is objectionable to any of the owners of adjacent dwellings. (FINES OF $25-$50 PER OCCURANCE WILL BE ASSESSED FOR VIOLATIONS—Article X, Section 5.)
2. Architectural/Landscape Improvements and Control:Any additions or improvements to existing structures or landscaping must be presented for approval to the Architectural/Landscape Committee. No changes can be made in colors of structures or rock colors in landscaping that do not meet CC&R restrictions. All changes must be in harmony with existing structures and landscaping. When adding to the structures on their properties, homeowners must take into consideration the impact on views of adjoining lots, or existing and proposed landscaping. Landscaping must conform to the approved list of plants put out by the Starr Pass Master Association. The HOA maintains common areas and each homeowner is responsible for his own property, including walls. 3. Assessments:Assessments levied by the Association are used exclusively for the improvement and maintenance of Common Areas and for all purposes set forth in the governing documents. The annual assessments are due and payable in twelve equal monthly installments. which are due on the first of each month. Payments not made by the 10th of each month are subject to a $10 late fee. If payments are not made, a lien shall be made against your property.

4. Dwelling and Landscaping Maintenance:Each owner is required to maintain, repair and repaint his or her dwelling unit, including perimeter walls and other improvements on a lot, in a manner and with such frequency as to keep that dwelling unit in an attractive, well-kept and maintained condition in conformity with all other dwelling units in the Subdivision. The Architectural/Landscaping Committee is responsible for monitoring compliance with this mandate. If the Committee observes a failure to comply with these provisions of the CC&R’s, you will be notified in writing of the particular condition that is non-compliant, and will be given a reasonable amount of time to return your property to an acceptable condition. Failure to take the necessary action may make it necessary for the Association to undertake the correction and bill you for the cost. Article V, Section 7.
5. Garbage and Recycle Disposal:The City of Tucson provides garbage and recyclable pickup on Saturday morning. Recyclable items include paper, glass, plastic and metal cans. A special container is provided for these items. It is advisable to have your refuse curbside by 6:00 a.m. (GARBAGE CANS ARE TO BE KEPT OUT OF SIGHT FROM STREET VIEW EITHER IN THE GARAGE OR BEHIND WALLS. VIOLATIONS WILL BE ASSESSED AT $25-$50 PER OCCURANCE—Article X, Section 8 & 16.)
6. Meetings:The Annual Meeting of the Homeowners Association will be held during the third week of January or on another date designated by the Board (not more than 30 days before or after this week). A timely notice will be issued covering the date, place and time of the meeting. Board meetings are held on an as-needed basis but no less than four times per year.
7. Occupancy/Renting of your Property:Occupancy of any home is limited to not more than two unrelated people, whether a house is owned or rented, without special permission from the Board. Violations of this policy will result in a fine of $50 per day. (Covers new leases/extensions after August 5, 1999.) Please inform the Board when you have rented your property so that a welcome packet, containing the rules and regulations of the Association, can be given to the renter. CC&Rs Summary Paragraph 8-11
8. Parking:As provided for in the governing documents of the Association, rules exist on the parking and storage of various kinds of vehicles, boats, etc. Violation of these rules can result in a fine of up to $50 for each violation. Article X, Section 4.
Vehicles: No vehicle shall be kept or stored on any lot other than those vehicles primarily and currently used for the transportation of persons, unless it is parked or stored in an enclosed garage (with the garage door shut) when not in use. Automobiles and Trucks under ¾ ton can be parked in driveways. Parking lots are intended for use by visitors and/or residents and are not to be used for storage of vehicles. (CARS PARKED ON STREETS AND/OR BLOCKING SIDEWALKS ARE SUBJECT TO BEING TOWED OR FINED). Pursuant to City law we are required to keep our streets and sidewalks free of parked cars.
Trailers: No trailers, boats, motor homes, recreational vehicles or other similar vehicles shall be kept or stored unless they are kept within an enclosed garage. (RV’s, BOATS, TRAILERS OWNED BY RESIDENTS ARE ALLOWED UP TO 48 HOURS FOR LOADING AND UNLOADING BEFORE AND AFTER TRIPS.)
9. Lights, Sounds, Odors:No annoying lights, sounds or odors which are unreasonable shall be emitted by the occupant of a house. (FINES OF $50 PER OCCURANCE WILL BE ASSESSED—Article X, Section 20.)
10. Violations:Any violations of our CC&R’s that result in fines will be assessed against the property owner. Unpaid fines will result in a lien against your property including legal fees. Article X, Section 20.
11. Enforcement:Complaints should be directed to the Property Manager. Enforcement procedures will be as follows, unless otherwise covered in the CC&R’s:
Courtesy Reminder: 10 days to correct violation
2nd Notice (Certified): 5 days to correct violation
Final Notice (Certified): Appear at next Board meeting and issuance of fine
Continued disregard for the CC&R’s will be treated as issuance of a Final Notice with Board appearance mandatory and fines issued.
