ORDINANCE NO. 15-07

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MANDEVILLE AMENDING THE MANDEVILLE CODE OF ORDINANCES, CHAPTER NINE, HEALTH AND SANITATION, SECTION 9-2(g) TO ADD THERETO SECTION 9-2(h) AND TO REDESIGNATE SECTION 9-2(g) AS 9-2 (i) RELATIVE TO PROHIBITED DEPOSITS ON PRIVATE OR PUBLIC PROPERTY

WHEREAS, the City of Mandeville has always been a clean community and the increase in population has made keeping it clean a greater task; and

WHEREAS, additionally, the increase of pet owners, within the City limits, has added an accumulation of pet waste on private and public property, particularly on the lakefront area; and

WHEREAS, such accumulations of pet fecal matter, if unabated, are eyesores and blights upon the community that undermine the aesthetic value of the area and the value of property in the vicinity; and

WHEREAS, unhealthy or noxious materials on private and public property within the City limits of Mandeville is a matter within the scope of the regulatory authority of this City; and

WHEREAS, the City desires to amend The Mandeville Code of Ordinances to provide greater detail to the present littering ordinance which is codified in Chapter 9, Health and Sanitation, Article I of the City of Mandeville Code of Ordinances.

NOW, THEREFORE, be it ordained by the City Council of the City of Mandeville that Chapter 9, Health and Sanitation, Article I. In General, Section 9-2(g) be amended and shall read as follows:

ARTICLE I. IN GENERAL

Sec. 9-2Prohibited deposits in streets, on beach front, in lake.

(g)It shall be the responsibility of any person who is the owner or otherwise who has the lawful custody of any animal to immediately remove any fecal matter deposited by that animal on any property belonging to another person or upon or in any public roads, sidewalks parking lots, neutral grounds, rights of way or beach front.

BE IT FURTHER ORDAINED, by the City Council of the City of Mandeville that Section 9-2 be amended by adding thereto 9-2(h) which shall read as follows:

Sec. 9-2 Prohibited deposits in streets, on beach front, in lake.

(h)Whoever violates the provisions of Section 9-2 shall, upon conviction, be fined according toSection 1-9 of the City of Mandeville Code of Ordinances.

BE IT FURTHER ORDAINED, that Section 9-2 (g) as contained in the Mandeville Code of Ordinances is redesignated as Section 9-2 (i).

BE IT FURTHER ORDAINED, that the Director of the Public Works Department install the appropriate “Curb your Dog” signs on the Mandeville Lakefront evidencing the City’s litter law and general penalties for those who violate section 9-2.

BE IT FURTHER ORDAINED that the Clerk of this Council be and she is hereby authorized and empowered to take any and all actions which she, in the exercise of her discretion, deems necessary to promulgate the provisions of this ordinance.
