Themeeting of theBMW Committee No. 1 constituted for deciding Authorization under the BMW Rules, was held on 01.11.2012. For the present meeting, decisions recommended agenda wise are as follows:

Decision on Agenda 1:

Monthly format for record of Bio-Medical Waste, to be circulated in Hospitals having 100 & above beds has been finalized with minor modifications. It was also decided that possibility of tracking the waste may be explored so as to ensure that entire Bio-Medical Waste reaches CBWTF.

Decision on Agenda 2 :

On the basis of the office order no. DPCC/(3)(7)(2)/Admn - 06/9086-9094 dated 06/03/2012, and the fact that the Authorization/Consent application of all 3 CBWTFs are pending, a decision was taken in the Public interest w.r.t. 3 CBWTFs for grant of Authorization under BMW Rules, as well as renewal of Consent under Air/Water Act for 3 months on submission of a Bank Guarantee(valid for 6 months) for an amount of 10 times their Annual fees for CTO subject to minimum of 2 lacs and the requisite documents. During this period all the deficiencies observed are to be rectified & decisions conveyed by DPCC / conditions imposed in Authorization & Consent are to be complied with, failing which BG shall be forfeited and Authorization/Consent shall be revoked.

Minutes of meeting held in chamber of Chief Secy. Delhi on 22.4.2010 were discussed and it was decided that these minutes were in relation to new upcoming CBWTFs after the Chief Secretary, Delhi, meeting. The Committee was apprised of the numerous RTIs and Complaints which are being received regarding these CBWTFs. The Committee was also apprised about section 14 of Bio-Medical Waste Management Rules regarding which few RTIs/ Complaints have came and letter from CPCB has also been received. It was conveyed that the matter has been already settled administratively in the file as Rule 14 does not prohibit setting up of BMW treatment plants at Private lands. It was decided that DPCC lab will carry out monitoring of these 3 CBWTFs at the earliest. Also, as already decided by the Chairman, DPCC, the quarterly monitoring of all these 3 CBWTFs will be carried out by DPCC Lab.

The unit has been establised on the land given by DHS as per their agreement. The authorization and CTO has been granted/ extended provisionally from time to time. Consistent complaint are being received against the unit from the neighbour hood and a committee has been constituted by DHS for looking into complaints. 3. A court case is also pending against the unit in Hon'ble High Court since 2008. 4. Regular inspections and correspondence has been on with the CBWTF for efficient management of BMW. 5. The committee appointed by DHS has reported that in the long run it is not advisable to run the facility at present site. 6. In the meetings taken by Chief Secretary it has been principally agreed that the facility has to be shifted. A proposed site has been identified about 750 m away from the existing site. 7. As per decision of meeting dated 27.09.2011 authorization and CTO were extended upto 06.11.2012. 8.Monitoring report of DPCC lab shows that Particulate Matter and Bio-Assay Test are not meeting the prescribed norms. Therefore, Show Cause Notice u/s 5 of EPA Act & for cancellation of the Authorization under BMW Rules & revocation of CTO under Air & Water Acts, has been issued to the unit on 09.02.2012.
Reply received on 28.02.12 along with Monitoring Report for the incinerator & Effluent Analysis Report of ETP from empanelled Lab of DPCC, conducted on 17th Feb, 2012 which indicates that unit is meeting the prescribed standards. A meeting was called with all three CBWTFs in the office of Member Secretary on 10.04.2012 regarding installation of online monitoring system. All the three CBWTFs have agreed to install online monitoring system by 31st July 2012. / Issue Letter conveying that authorization is valid subject to installation on line monitoring system by 31st July, 2012 / 1.Letter issued. 2. On line monitoring system installed. The data displayed on URL can be viewed through Log in & password. 3. The unit was inspected on 04/10/12 and various deficiencies were observed.
4. Before any SCN would be issued, the unit based upon the inspection submitted its reply on 08.10.12 along with a affidavit regarding rectification of deficiencies. 5. As the reply of the unit did not comment on the deficiencies in SCN for the rest of the deficiencies was issued on 18.10.2012. 6. Unit has submitted its reply along with an Affidavit on 26.10.12. Status of rest is as follows: (i)Regarding improvement of flooring , unit agree to do so after High Court Judgement for shifting of the Facility. (ii) Unit has stated that green belt is not possible at present site. (iii) The permission of CGWA for drawing ground water is still awaited. (iv) Unit has submitted that Control System of PLC is equipped with "Diesel Supply Cut-off to Burners" mechanism to maintain only the / Authorization under BMW Rules & renewal of Consent under Air/Water Act granted for 3 months after submission of Bank Guarantee (valid for 6 months) for an amount equal to 10 times of their Annual fees for CTO subject to minimum of 2 lac and submission of SporeTest Report of autoclave and Adequacy Report of ECS. The unit will thereafter comply with the all the decisions conveyed to it / conditions imposed in Authorization & CTO within 3 months, failing which BG shall be forfeited and Authorization/Consent shall be revoked.
prescribed temperature range in Primary & Secondary chamber of incinerator, but the specific reason for the increase in temprature from prescribed limits has not been given in their reply. Present online data reveals that the temprature are still exeeding the prescibed norms. 7.The monitoring of the unit is pending with DPCC Lab. 8. Unit is required to submit adequacy report of Emission Control System (ECS) from any approved consultants from DPCC.
2 / Biotic Waste Solutions Pvt. ltd, 46, SSI Industrial Area, Delhi-33 / NW-408 / Applied on 13.09.12 / Applied on 21.08.12 / Granted / Installed / 1.Consent to Establish under the Air & Water Acts was granted to the unit on 14.05.09. The unit had establised CBWTF on its own and is not a state government sponsored project. 2. The unit has been pressing for central subsidy under the MOEF scheme for setting up CBWTF and the request of the Unit has been forwarded to various concerned organizations time to time. 3. Unit had changed its name from Biotic Solutions to M/s. Biotic and a letter has been issued that earlier granted authorization and consent be treated in the new name. Inspection and monitoring of unit was conducted vide DPCC Lab on 17.01.2012. 4.Monitoring report of DPCC lab shows that Particulate Matter and Bio-Assay Test are not meeting the prescribed norms. Therefore, Show Cause Notice u/s 5 of EPA Act & for cancellation of the Authorization under BMW Rules & revocation of CTO under Air & Water Acts, has been issued to the unit .
Reply received on 28.02.12 along with Monitoring Report for the incinerator & Effluent Analysis Report of ETP from empanelled Lab of DPCC, conducted on 17th Feb, 2012 which indicates that unit is meeting the prescribed standards. It was informed that the level of particulate matter may increase at particular time on account of improper segregation or non-segregation of BMW. A letter was issued on 22. 02.2012 regarding installation of online monitoring system and CBWTF has replied on 29.03.2012 and requested to provide three month time to complete the task. A meeting was called with all three CBWTFs in the office of member secretary on 10.04.2012 regarding installation of online monitoring system. All the three CBWTFs have agreed to install online monitoring system by 31st july 2012. / Issue Letter conveying that authorization is valid subject to installation of on line monitoring system by 31st July, 2012 / 1. Letter issued. 2.Unit has applied for renewal of Authorization & CTO & submitted analysis reports of effluent & emission gas of incinerator along with NMR & spore test report (of DTU , meeting the norms). 3.Unit was inspected on 21.09.12 and several deficiencies were observed. 4. As main file of the unit was under submission w.r.t. issue of subsidy thus a part file was created after the inspection and as approved SCN has been issued to the unit on 08/10/12. 5. Unit has submitted reply w.r.t SCN along with photographs. 6. Unit has informed vide letter 08.10.12 regarding discontinuation of BMW services to CGHS dispensaries & hospitals due to long outstanding dues.
7. The monitoring of the unit is pending with DPCC Lab. 8.No intimation has been given by the CBWTF regarding installation of Online Monitoring System. / Authorization under BMW Rules & renewal of Consent under Air/Water Act, granted for 3 months after submission of Bank Guarantee (valid for 6 months) for an amount equal to 10 times their Annual fees for CTO subject to minimum of 2 lac and an Affidavit regarding rectification of deficiencies observed during inspection on 21.09.12 for which Show Cause Notice No. DPCC/BMW/967 dated 08.10.12 was issued. The unit will thereafter comply with the all the decisions conveyed to it / conditions imposed in Authorization & CTO within 3 months, failing which BG shall be forfeited and Authorization/Consent shall be revoked.
3 / SMS Water Grace BMW Pvt. Ltd, Nilothi Sewage Treatment Plant Complex of DJB, Nilohi, Delhi-41 / W-401 / Granted ( valid upto 07.04.13) / Extension of CTO is Pending ( earliar was valid upto 07.04.12) / Granted / Installed / 1. The unit has been establised on on the land given by DHS as per their agreement. 2.Authorization under BMW Rules and Consent to operate under the Air & Water Acts were issued to the unit on 08.04.11 for a trial period of one year. 3.Representations received from the unit requesting adjacent half acre land to the unit. Unit has also requested for subsidy from State and Central Government for its CBWTF. 4. Monitoring report of DPCC lab shows that Particulate Matter and Bio-Assay Test are not meeting the prescribed norms. Therefore, Show Cause Notice u/s 5 of EPA Act issued. Reply received on 28.02.12 along with Monitoring Report for the incinerator & Effluent Analysis Report of ETP from empanelled Lab of DPCC, conducted on 17th Feb, 2012 which indicates that unit is meeting the prescribed standards. A letter was issued on 22. 02.2012 regarding installation of online monitoring system .After receiving reply a meeting was called with all three CBWTFs in the office of Member Secretary on 10.04.2012 regarding installation of online monitoring system. All the three CBWTFs have agreed to install online monitoring system by 31st July 2012. / One year Authorization granted with the condition that authorization will be valid subject to installation on line monitoring system by 31st July, 2012. / 1. Authorization issued. 2. Unit was inspected on 20.07.12. Deficiencies were observed during inspection

The unit was visited again by officials of DPCC on 21/07/2012 but the inspection could not be carried out as the main gate of the unit was found locked and the security guards denied the inspection. 4. As approved SCN & Directions u/s 5 of EP Act, 1986, for suspension of its operation were issued on 26.07.12. 5.As approved in file, letter has been issued on 13.08.12 to unit giving permission to collect & transport BMW from HCEs for treatment at any of the two other CBWTFs. 6. Unit was again inspected on 13.08.12 & deficiencies observed in previous inspection, were found to be rectified& file was putup accordingly.
7. Meanwhile letters were recd. from M/s Synergy Waste to whom the unit has been sending the waste for / CTO under Air/Water Act granted for 3 months after submission of Bank Guarantee (valid for 6 months) for an amount equal to 10 times their Annual fees for CTO subject to minimum of 2 lacs. The unit will thereafter comply with the all the decisions conveyed to it / conditions imposed in Authorization & CTO within 3 months, failing which BG shall be forfeited and Authorization/Consent shall be revoked.
