LOCAL LABOUR CLAUSE

The following clauses are to be included in all capital project tenders.

1.The General Contractor and all subcontractors shall recognize that the community of desires to maximize local involvement in the construction of this project. There are a number of employable local residents available for work employment.

The Contractor and other parties engaged in the work shall recognize, and maintain as far as practical, continuity of employment for local residents.

2.Local resident means a person who has maintained residence in the Northern Administration District for 10 years. Subject to the foregoing, preference will be given in hiring to a person who resides (a) within the community (b) within a forty kilometre (40km) radius of the project site (c) within the Northern Administrative District.

3.The Contractor shall submit at the pre-job project meeting, and at least fourteen (14) days prior to commencement of work, a detailed confirmation of labour required for review and approval by Northern Lights School Division #113.

4.The Contractor shall submit the specific labour requirements and job descriptions to the , at least three (3) working days, excluding Saturday, Sunday and Statutory Holidays, preceding actual labour requirements.

5.The Contractor shall submit notice to the for any labour requirements due to terminations, allowing at least three (3) working days to refer suitable candidates as replacements. The Contractor or subcontractor may submit with these requirements, the name(s) of local persons already selected to fill these positions.

6.The will refer to the Contractor individuals considered qualified to fulfil the positions described in the schedule of labour requirements and description. Subject to Contractor and subcontractor approval as to skills and suitability, such referrals shall be employed in such positions.

7.At the expiration of three (3) working days, if no suitable referrals are employed, the Contractor and/or Sub-contractor may independently employ such individuals as each requires.

8.The Contractor shall include the requirements of this Section with respect to employment recruitment, into all subcontracts requiring manpower services.

9.The Contractor and/or subcontractors may recruit outside the Local Labour Clause if qualified Labour is demonstrably not available. Contractors and/or subcontractors may `name' hire local individuals meeting job requirements. The Contractor or subcontractor shall submit with the employment reports documentation of qualifying local labour independently selected to fill positions on the construction work force.

10.Complaints of Contract non-adherence to these provisions shall be made in writing to the Superintendent of Facilities describing and documenting the infractions that reportedly have occurred.

11.The Contractor shall submit, in writing, to the Superintendent of Facilities, a monthly employment report, indicating person, hours, position of people employed under this Section; including reasons for any terminations of employment.
