FIRBRE RECOVERY PROCESS

ROLES AND RESPONSIBILITIES

The District Manager is responsible for:

  1. Conducting a “Preliminary District Review” of the current availability and use of residual fibre.
  2. Maintaining a Register of Secondary Users.
  3. Establishing the Area of Interest and implement the Information Sharing Stage (only if there is a clear demand for and a supply of economical Residual Fibre that is not being used).
  4. Informing appropriate Primary Harvesters that they are expected to being sharing information with Secondary Users.
  5. Conducting a Fibre Recovery Review (only if business to business negotiations between Primary Harvesters and Secondary Users are not successful).
  1. Using one or more of the following legislative tools, if through the Fibre Recovery Review (#5) it is determined that the use of Residual Fibre could be enhanced by using one or more of the legislative tools:
  1. Establishing a Fibre Recovery Zone by initiating the requirement for PH to begin to provide notices under Section 79.1 if the Forest Act;
  2. Issuing one or more Fibre Recovery Tenures to the SU(s).
  3. Issuing Do Not Destroy Orders and issuing one or more Fibre Recovery Tenures to the SU(s)
  4. Issuing a standalone Do Not Destroy Order to the PH(s).
  1. Monitor for compliance and enforce if necessary.

Primary Harvesters are responsible for:

  1. Begin the sharing information with secondary users ifnotified by the District Manager to do so.
  2. Attempt to negotiate business to business relationships and agreements with Secondary Users that have expressed an interest in Residual Fibre that is not being used.
  3. If successfully negotiated, enter into formal agreements with and coordinate operations with Secondary User for the removal and use of Residual Fibre.
  4. Providing input to the District Manager in regard to any Preliminary Review the District Manager may conduct.
  5. Begin to provide notices to the District Manager if ordered (under section 79.1 of the Forest Act) by the District Manager. These included notices to be sent when harvesting commences on a new block (Notice of intent to abandon timber);or with harvesting on a block is completed (Notice confirming abandonment of timber).
  6. Participating in any District Fibre Recovery Review that may be conducted by the District Manager.
  7. Comply with all legislative and contractual requirements under the licence.
  8. Meet hazard abatement obligations on a specific block if no Fibre RecoveryTenure is issued to secondary user over the block.

Secondary Uses are responsible for:

  1. Seeking out and attempting to negotiate business to business relationships and agreements with Primary Harvesters for the removal and use of Residual Fire that the Primary Harvester is not using.
  2. Providing input to the District Manager in regard to any Preliminary Review the District Manager may conduct.
  3. Ensuring they are on the Register of Secondary Users maintained at the District Office.
  4. Reviewing information shared by Primary Harvesters regarding proposed future harvesting operations and the potential for using Residual Fibre.
  5. NotifyingPrimary Harvesters if they are interested in using any Residual Fibre that the Primary Harvester has indicated may be available.
  6. Attempting to negotiate business to business relationships and agreements with Primary Harvesters for the removal and use of Residual Fire that the Primary Harvester is not using.
  7. If successful, coordinating operations with Primary Harvesters for the removal and use of Residual Fibre under the Primary Harvester’s original cutting authority.
  8. Informing the District Manager, where appropriate, that attempts to negotiate business to business relationships with Primary Harvesters have been unsuccessful.
  9. Participating in any District Fibre Recovery Review that may be conducted by the District Manager.
  10. Applying for and entering into Fibre Recovery Tenures offered/advertised by the District Manager.
  11. Comply with all legislative and contractual requirements under a licence including hazard abatement obligations formally transferred under the Wildfire Act and Regulation.
