TENDER NOTICE

Sealed Cover Tender/Quotations are invited from the reputed contractors for the Minor Repair Work to maintain the Govt. buildings in NPL, Police Colony located at NPL & Govt. Buildings under the possession of 1st Bn. DAP in Delhi/New Delhi for Annual Maintenance Contract for the financial year 2018-19. The Contractors will have to deposit earnest money of Rs. 8,00,000/-. The tender should be sent through registered/Speed post/Courier service or can be dropped personally in the sealed tender box kept in Estate Branch, Barrack No. 04 (Double Storey), 1st Bn. DAP, NPL, Kingsway Camp, Delhi -110009 upto04.06.2018 at 1300 hrs. The Technical Bid of Tenders will be opened on same day i.e04.06.2018 at 1500 hrs.in the office chamber of DCP/1st Bn. DAP situated at 2nd floor, Admn. Block, 1st Bn.DAP, NPL, Kingsway Camp, Delhi -110009. The Terms and Conditions and detailed specifications can be obtained either from the office of the undersigned on any working day from 21.04.2018 to 01.06.2018 or downloaded from Delhi Police Website No Tender Form will be entertained after the expiry of stipulated period i.e. after 1300 hrs. on01.06.2018.

The cost of the tender form containing terms & conditions is Rs. 500/- each.

TERMS & CONDITIONS

(1)The tendering firm should be registered under GST and a copy of valid GST Registration should be enclosed, alongwith Latest Tax Clearance Certificate/Copy of Challan vide which the latest tax was deposited.

(2)The Tendering Firm should be registered in Govt. Department i.e. PWD/MCD/ DDA/NDMC/CPWD etc. A copy of the Registration Certificate should be enclosed with technical bid.

(3)The average annual financial turnover of the bidder during the last 03 years, ending 31th March of the previous financial year, should be Rs. 78,00,000/- only as per CVC guidelines dated 17.12.2002 for which the bidder shall enclose the requisite documents, TDS Certificate, Form No.16 from Govt. Department

(4) The conditions laid down in CVC guidelines dated 17.12.2002 for pre-qualification criteria related to previous experience in similar work shall be strictly followed as per following manner:-

For Civil/Electrical Works:-

Experience of having successfully completed similar works during the last 7 years ending last day of month previous to the one in which applications are invited should be either of the following:-

i)Three similar completed works costing not less than the amount equal to Rs.1,04,00,000/-.

Or

ii)Two similar completed works costing not less than the amount equal to Rs.1,30,00,000/-

Or

iii)One similar completed work costing not less than the amount equal to Rs.2,08,00,000/-.

The bidders shall submit a certificate from the concerned Govt. Department to the effect that the contractor has executed the work satisfactorily clearly mentioning the amount of work executed against each financial year.

(5) The Tender documents can be obtained from the office of DCP/1st Bn.DAP, NPL, Kingsway Camp, Delhi on payment of Rs.500/- (non-refundable) on any working day from 10 AM to 5 PM. Alternatively, the tender documents can also be downloaded from the websites of Delhi Police i.e. In case the tender form is downloaded, then the tendering firm shall have to attach a bank draft of Rs.500/- (non-refundable) on account of cost of tender documents in favour of DCP/1st Bn. Delhi Armed Police, Delhi, failing which the tender shall not be accepted.

(6)The Bidders shall submit tender in two bid system i.e.

(i)Technical Bid consisting of all technical documents as per Annexure-A.

(ii)Financial Bid indicating item wise net price for the items mentioned in the Financial Bid inclusive of all taxes as per Annexure-B.

(iii)The technical bid and the financial bid should be sealed by the bidder in separate covers duly superscripted and both these sealed covers are to be put in a bigger cover which also be sealed and duly superscripted.

(7)The quoted price shall be inclusive of installation/commissioning and removal of old articles. There shall be no extra charges for these items.

(8)A copy of Tender Documents and Terms & Conditions duly signed by the bidder(s) may also be attached with Technical Bid.

(9)The prices shall be quoted for each item/work separately as per price bid format inclusive of all taxes and the rates offered by the firm should be in accordance with the DSR and prevailing market rates and the firms offering unjustifiable rates shall be disqualified. In case it is found that the bidder is trying to sabotage the tender process, the bid of the firm will be rejected straightway.

(10)The tendering firm should engage only those skilled /semi-skilled and unskilled employees who are registered with Employee Provident Fund Organization (EPFO) and Employees State Insurance Corporation (ESIC). The document regarding employee’s registration with EPFO and ESIC should be submitted with tender documents. The payment of bills will be made only after verifying the social security cover provided to the staff. The firm who will not deposit the registration certificate of Firm/Employees with EPFO and ESIC, the bid of the firm will be not entertained and rejected in straightway. To effectively and efficiently maintain Govt. Buildings in NPL, Police Colony located at NPL and Govt. building under the possession of 1st Bn. (11)The Tender must contain the Name, Office & Residential Address including Telephone Number(s) of the firm or person with their signatures. Unsigned Tender shall not be accepted and rejected straightway.

(12) Tender envelope(s) must be sealed and supper scribed “TENDER FOR MINOR REPAIR/MAINTENANCE WORK” in Govt. Buildings in NPL, Police Colony located at NPL and Govt. building under the possession of 1st Bn.DAP in Delhi/New Delhi., which shall be addressed to Dy. Commissioner of Police/1st Bn.DAP, NPL, Kingsway Camp, Delhi-110009. The tender may be put in the“Tender Box” placed in Estate Branch, DCP/1st Bn.DAP Office Complex, NPL, Kingsway Camp, Delhi-110009 or thetendercan also be sent through Registered Post/Speed Post/Courierlatest by 04.06.2018 at 1300 hrs. Late bids shall not be accepted. The bids shall be opened on the same day i.e.04.06.2018at 1500 hrs. in the presence of bidder. In case, the tenders are not opened on the stipulated date and time due to some administrative reasons or due to holidays etc., the same shall be opened on the next working day at the same time.

(13)The Tender Committee/Purchase Committee so nominated shall examine the Technical aspects of the Tenders. It’s decision shall be final and the Tenderer(s) should not have any objection in this regard.

(14) No enquiry shall be made by Tenderer(s) during the course of examination of the Tender, after the opening, till final decision is taken by the competent authority.

(15)The unacceptable articles shall be subject to replacement at the risk and responsibility of the Contractor without any extra cost.

(16)Tenderers shall indicate their rates inclusive of all taxes in clear/visible figures & words and shall not alter/overwrite/make cutting in their quotations. If any, alteration/over-writing/cutting etc. is noticed, the rates offered by the firm for particular item shall not be considered.

(17)If the performance of any repair/maintenance work fail to meet the contract specification(s) and do not fulfill the requirement(s), then the firm shall be liable to replace re-work, free of cost within the shortest possible period. In case of any defect/fault noticed after the work is executed, the tenderer shall attend the sameimmediately. If he fails to do so, the defect/fault shall be executed from the open market and the cost thereof shall be recovered from the payment claimed by the firm.

(18)In case, the successful tenderer violate/breach any of the terms & conditions of the tender or contract/supply order, an explanation of the company/firm can be called by issuing Show Cause Notice. If the reply of Show Cause Notice is not found satisfactory, strict legal action as per law will be taken, besides forfeiture of EMD/Security Deposit and blacklisting the firm.

(19)Any lapse in the performance of contract on the part of contractor will make him liable for the termination of contract without assigning any reason and forfeiture of the performance security andalso should be blacklisted from Delhi Police Department.

(20)The goods/articles should be of ISI Mark, where applicable.

(21)A good quality wood be used for doors/windows and frame works.

(22)Conditional tenders shall not be accepted and shall be rejected straightway.

(23)All Tender(s) in which any prescribed condition is/are found incomplete, in any respect, shall be rejected by the Committee, without assigning any further reason.

(24)The contract shall be awarded to L-1 bidder for a period of one year for the financial year 2018-19. However, if there are several L-1 bidders for the works mentioned in the tender document, all L-1 bidders may be asked to furnish explicit willingness to work at lowest rates arrived at during the tender process. Those bidders, who furnish their willingness, shall be included in a panel of contractors who may be assigned work in the 1st Bn. proportionately.

(25)The Committee also reserves the right to relax any of the condition(s), or reject any or all tenders altogether without assigning any reasons, with the approval of competent authority.

(26)All procedure for the minor repairs/maintenance work laid down shall be adhered to strictly as per CPWD Manual and the instructions on the subject.

(27)The tendering agency should deposit Earnest Money of Rs. 8,00,000/-( Rs. Eight Lakh) only in the shape of Account Payee Bank Draft/FDR/Bankers Cheque/ Bank Guarantee from a Commercial Bank in favour of Dy. Commissioner of Police/1st Bn.DAP, Delhi. If, it is found during the tender process or at later stage, that the EMD has been prepared from the bank account, other than the account of the participating bidder, the bid shall be rejected straightway and disciplinary action shall be initiated for concealing the facts. No tender shall be accepted without Earnest Money. Earnest Money shall bear no interest. The EMD shall be valid for 60 days beyond bid validity period from opening of bid.

(28)Firm(s) whose rates are accepted will have to deposit 10% as Performance Guarantee (Security Money) depending on the value of work awarded to each after finalization of the tender in the shape of Account Payee Bank Draft/FDR/Bank Guarantee from the Commercial Bank in favour of Dy.Commissioner of Police/1st Bn. Delhi Armed Police, New Delhi within 07 days from receipt of letter in this regard, before the Contract is awarded to the successful bidder(s) failing which contract shall be cancelled and Earnest Money deposit will be forfeited. The performance security may be valid for a period of 60 days beyond the date of completion of all contractual obligations.

(29)The successful tenderers will execute/sign the agreement with Deputy Commissioner of Police/1st Bn.DAP, Delhi.

(30)Bidders would not be permitted to alter or modify their bids after expiry of the deadlines for receipt of bids.

(31)After completion of work as per work order, the Contractor will obtain the END USER CERTIFICATE from the allottee of Govt.Quarter, Care Taker of Govt. Buildings/Sites dulyverified by the Committee.

(32)The Contactor will deposit the old replacement materials such as door/windows glass, grill, panes, plumbing/sanitary materials and electric articles etc. in the General Store/1st Bn.DAP, Delhi on their own, without charging any transportation charges.

(33)The Contractor will submit the bills, after completion of entirework, along with a copy of work order and photographs before & after execution of work.

(34)The payment shall be released, subject to allocation of budget by MHA and availability of funds with Delhi Police. However, no advance payment shall be given to any agency on any ground whatsoever.

(35)Performance and conduct of every Contractor is to be watched by the Estate Officer i.e. DCP/1st Bn.DAP. The Contractor is liable to be removed from the approved list if the Contractor who fail to abide by the terms and conditions or fail to work within the specified time period or make any false declaration to the Estate Officer i.e. DCP 1st Bn.DAP or any ground which, in the opinion of the Estate Officer, is not in the interest of Delhi Police.

(36)The Estate Officer i.e. DCP/1st Bn. shall frequently check the quality and quantity of minor work directly as well as through monitors.

(37)If the successful Tenderer(s) is found in breach of any condition at any stage during proceeding/contract period, the legal action as per rule/law shall be initiated and EMD/Security Money as required shall be forfeited.

(38)In case the successful Tenderer(s) fails to complete the works within specified time period, payment shall not be released and action as per Terms & Conditions shall be taken, besides debarring/blacklisting the firm concerned for further dealing in this Department. He will also be liable to pay 20% of the total work order as a penalty. The penalty amount would be deducted from thepending bills or from the performance security, as the case may be.

(39)The bid should be valid for a period of 1 year from the opening of tender.

(40)The period of the contract is for 1 year for the financial year 2018-19 which can be extended till finalization of new contract with the approval of competent authority as per Rule 225 of GFRs, 2017.

(41)In the case of dispute or difference arise between the company/firm and the Department relating to any matter connected with this contract, the same shall be settled through amicable negotiations between a maximum of two (2) officers nominated by the competent authority of Delhi Police and two (2) employees nominated by the contractor, failing which the dispute shall be submitted to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, and the Arbitrator’s decision shall be final and binding. All disputes are subject to the jurisdiction of the Courts in the N.C.T. of Delhi.

(42) All the firms participating in the tender must submit a copy of list of their owners/partners/directors etc. and a Certificate to the effect that the firm is neither blacklisted by any Govt. Department nor any Criminal Case is registered against the firm or its owner or partners or directors anywhere in India alongwith Technical Bid. The tender will be rejected straightway without assigning any reasons if the Firm/Contractors/Owners involved in any criminal case, declared black listed by any Govt./Semi Govt. department/agencies etc.

(43) The successful tenderer(s)/ bidder(s) shall attend and rectify/replace/restore extremely essential and emergent services requiring immediate attention related to plumbing and electrical or any other urgent minor work having a definitive bearing on quality of life of a resident on the same day positively, failing which, action shall be initiated against the firm concerned as per rule.

(44) Any new Government levies/taxes imposed or increase in taxes after the contract date shall be paid as per actual against submission of documentary evidence and in case of decrease thereof, the same shall be adjusted by the contractor as per revised slabs.In case, the tax rates are reduced after release of payment, the same shall be adjusted against future bills or from the performance security of the contractor.
