The Snow Foundation Community Bus

The bus has been provided through the generous support of The Snow Foundation and is administered by YWCA Canberra MURA Lanyon Youth and Community Centre. The bus is made available to community groups and organisations on a fair and equitable basis to support the activities and programs of respective groups.

There are a number of terms and conditions associated with use of the Bus. By signing this cover sheet and initialling each of the following pages (a requirement of hire) you have agreed to abide by the terms and conditions outlined. If you have any questions or would like any of the terms and conditions explained to you please contact the Community Centre Manager on 6294-4633 prior to hire.

Use of the vehicle

This bus is for the use of community groups, where necessary evidence of community status will be required.

The driver of the vehicle must:

  • Not carry more passengers than may be accommodated by the seat belt restraints provided in the vehicle;
  • Not use the vehicle when it is damaged or unsafe;
  • Not allow the vehicle to be used for any illegal purpose, race, contest or performance test of any kind
  • Not be under the influence of alcohol, drugs or have a blood alcohol content that exceeds the legal limit in the state or territory in which the vehicle is driven;
  • Not allow the vehicle to be used to carry passengers for payment of any kind;
  • Not use the vehicle to transport goods, any flammable, explosive or corrosive substances.
  • Pay for any unauthorised repairs to the vehicle for damages incurred during the hiring period.
  • Not tow an approved trailer without written permission (obtain prior to hire).
  • Ensure Steering wheel lock provided is fitted when the bus is left unattended.

Registered Drivers

During hire the bus may only be driven by Driver or Drivers (two drivers may be nominated) identified within the hire contract. A nominated Driver must hold valid, unrestricted light rigid class license in order to drive the vehicle. The license is checked for validity by noting the following:

A photocopy (front and back) of nominated Driver/s licence will be taken and held on file prior to keys

being issued.

RestrictionThe minimum age for the driver of the vehicle is 25. Exceptions may be negotiated in advance on an individual basis. If additional insurance excess is required for a driver under 25 years of age over the period this cost will be met the Driver and/or user group.

Individuals with Learner’s permits, Provisional or Probationary licences may not operate the vehicle. No one with a suspended, revoked, expired or cancelled license will be able to drive the vehicle.

Deposit

A $500 deposit is required for all bookings; this is refundable when the bus and keys are returned in the correct conditions.

Additionally, a $50 non refundable payment is required for all bookings traveling interstate.

Picking up and returning the Bus

Unless otherwise arranged the bus need to be picked up during office hours. No hire will be permitted without a fully completed and signed Bus Usage Contract (this form)

The bus should be returned prior to 6pm (Monday to Friday usage) or by 10am on the Monday morning following weekend use. On return staff will ensure the bus is parked within the garage, the bus is locked, the garage is alarmed, locked and the keys returned to Centre staff member. Under no circumstances should the keys be locked in the bus, hidden within the garage or on the premises. Return of bus outside of office hours is not permitted.

Condition of the bus

When you hire the bus it will be

Clean and tidy

Have a full tank of diesel fuel

Be free of damage

Have a log book entry that corresponds with the odometer reading

Please inspect the bus prior to leaving the Centre. If the bus is not in the condition described above please advise a member of staff and have the issue noted prior to leaving the Centre.

*Please note the Bus uses Diesel Fuel

When you return the bus it will be

Clean and tidy

Have a full tank of diesel fuel (filled at your expense)

Be free of damage

Have a log book entry that corresponds with the odometer reading

A $100 fee, plus the cost of fuel to fill the tank, will be charged to a user group who does not return the bus with a full tank. This invoice must be paid in full prior to any future hire being permitted.

If the bus is damage during your hiring either the cost of the repairs of the excess will be taken from the deposit depending on which is cheaper.

Passenger Behaviour

Passengers travelling in the bus have the following responsibilities to ensure safe use and travelling.

  • To wear a seat belt at all times
  • To ensure the bus is clean and tidy at all times.
  • Not smoke in the bus
  • Not to damage the inside or outside of the vehicle in any way (including graffiti)
  • Not ask the driver to stop where it is illegal or unsafe to do so

General Driving

It is responsibility of the Driver to ensure that the bus is driven in a safe manner appropriate to the conditions and obey all road laws.

Parking fines: Parking fines are the responsibility of the user and must be paid by the due date. Where there is a dispute about the validity of any fine, it is the responsibility of the user to remedy with the appropriate motoring authority upon receiving their infringement notice. Any subsequent administrative charges will also be the responsibility of the user.

Speeding Fines: Any speeding or other fines issued whilst the bus is booked to you will be passed on to the licensed driver as indicated by the licence attached to this form. This is done through a Statutory Declaration that is completed by the YWCA and the Snow Foundation detailing the driver’s licence number and address shown on the licence, this is forwarded to the relevant transport authority who then issues an infringement notice directly to the nominated driver.

Off Road Driving: The vehicle may not be operated on non-paved roads, driving of vehicle on beaches is not permitted. The vehicle is not to be driven onto ferries or across bodies of water without prior approval.

Travelling on toll roads: The cost of tolls is the responsibility of the hirer. You can either pay cash as a casual toll user(where this is available) or through an ‘E Pass’ system you can register and obtain a temporary pass that entitles you to travel on all toll roads in Australia- the Sydney Harbour tunnel and Bridge, Cross city tunnel, Eastern distributor, the M5, Westlink M7, M2, Lane Cove tunnel and Falcon Street Gateway. If interested in an obtaining an E Pass, a staff member is able to provide you with general information and contact details of the company involved.

Accidents and Break Downs

The bus is comprehensively insured, however, the liability for the excess on the insurance policy is the responsibility of the user and must be paid promptly.

If involved in an accident with another vehicle, you must exchange details with the other Driver and report the incident to the Police at the earliest opportunity.

If involved in a single vehicle collision (eg. you back into pole) you must note the time, date, physical location and name of the Driver at the time of the accident. When returning the bus you must explicitly advise the Community Centre Manager of the incident/damage.

In the event of any accident, the Driver may be required to lodge a statutory declaration as part of any insurance claim that may be lodged.

AGREEMENT TO TERMS AND CONDITIONS

I have read, understand and accept the terms and conditions of use outlined and will abide by them at all times during the hire period. I understand that I must provide a $500 deposit each time i hire the bus, and this contract ends on 31 December 2013.

RTA E-Toll pass

From Sunday 8 July, if you are visiting Sydney or only use the Sydney Harbour Tunnel or Bridge occasionally and do not have an electronictag, you will be able to register for an E-Toll pass.

Each time you use the Sydney Harbour Tunnel or Bridge, your number plate will be photographed and matched to your E-Toll pass registration details. Additional fees apply for using a pass.

You can register for a pass before or up to 48 hours after your trip.

If you use the Sydney Harbour Bridge or Tunnel without a tag or a pass, make sure you travel in the lane marked with the red and white ‘e’ symbol and register for an RTA E-Toll pass within 48 hours or you will receive a toll notice.
