The Dog Control Orders (Prescribed Offences and Penalties, etc.) Regulations 2006 (S.I.2006/)

The Dogs Exclusion Maids Moreton Playing Fields, Buckingham Rugby Club Playing Fields, St Edmunds Church Graveyard, Maids Moreton Allotment Gardens and the Control of Dogs in all Public Spaces of Maids Moreton

Maids Moreton Parish Council hereby makes the following Order:

1.  This Order comes into force on ...... 2014

2.  This Order applies to the land specified in Schedule 1,2 & 3

3.  Offence

3.1 A person in charge of a dog shall be guilty of an offence (Schedule 4 of the above Regulations) if, at any time he/she takes the dog onto, or permits the dog to enter or to remain on, any land to which this Order applies unless

(a)  The owner, occupier or person or authority having control of the land has consented (generally or specifically) to his or hers doing so.

3.2  A person in charge of a dog shall be guilty of an offence (Schedule 3 of the above Regulations) if, at any time the dog is not on a lead (or other accepted form of restraint) in any of the public spaces of Maids Moreton. This includes Church Green, Scotts Lane, the entrance to Chackmore Farm adjacent to Buckingham Rugby Club, all bridle paths and all road side footpaths and public footpaths crossing private land.

3.3  A person shall be guilty of an offence (Schedule 1 of the above Regulations) if, at any time they fail to remove dog faeces deposited by their animal on any road side footpaths, bridle paths and public footpaths crossing private land.

4.  Nothing in this order applies to a person who

(a)  Is registered as a blind person in a register compiled under section 29 of the national Assistance Act 1948, or

(b)  Is deaf, in respect of a dog trained by Hearing Dogs for Deaf People (Registered Charity No 293358) and upon which he/she relies for assistance, or

(c)  Has a disability which affects his mobility, manual dexterity, physical co-ordination or ability to lift, carry or otherwise move everyday objects, in respect of a dog trained by a prescribed charity and upon which he/she relies for assistance.

5.  For the purposes of this order

(a)  A person who habitually has a dog in his possession shall be taken to be in charge of the dog at any time unless at that time some other person is in charge of the dog.

(b)  Each of the following is a “prescribed charity”

(i)  Dogs for the Disabled (Registered Charity No 700454);

(ii)  Support Dogs (Registered Charity No 1088281);

(iii)  Canine Partners for Independence (Registered Charity No 803680.

6.  Penalty

A person who is guilty of an offence under article 3 shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale (currently £1000).

Alternatively, liability for the offence may be discharged by offering those responsible the opportunity to pay a fixed penalty in lieu of prosecution. (£80).

A person shall be guilty of committing an offence under Section 87 of the Environmental Protection Act 1990 where throwing down or dropping or otherwise depositing and leaving dog faeces bags anywhere other than the waste bins specifically provided and marked accordingly. The penalty for committing the offence is a maximum fine of level 4 on the standard scale, currently £2500.
