The commission of the Village of South Charleston convened in regular session from 7:00 P.M. to 7:30 P.M at 35 South Chillicothe Street South Charleston, OH 45368. President Tim Hines called the meeting to order with the following members and visitors present:

I CALL TO ORDER AND PLEDGE

II ADDITIONS CORRECTIONS AND APPROVAL OF THE MINUTES

With a motion by Vice President White and a second by Commissioner McKinney the minutes of the last meeting were approved. 3/0.

III DISCUSSION OF THE BILLS WITH A MOTION TO PAY

The credit to the All-phase bill was explained by Mr. Rice. With a motion by Commissioner McKinney and a second by Vice President White the bills were approved to pay. 3/0.

IV VILLAGE MANAGER'S REPORT

Mr. Rice noted that the packets contained the Mayor's court report. The Village manager held a staff meeting on September 22.

Mr. Rice held an in-service with the police department on Saturday September 26, 2009.

The village manager met with Tom Hale, of the Clark County Community Development Department. The topic of the meeting concerned the revised flood plain maps. Mr. Rice attended the FEMA floodplain workshop on September 30, 2009. The village does not participate in the floodplain plan at this time. If the village participates the village residents have the option of buying flood insurance. Persons living in the flood plain are required to buy flood insurance. The residents in the flood plain would pay at a higher rate. Grants are available for upgrades to properties but would probably no cover the total expense. Vice President White ask what the results would be if the village does not participate. The village residents would not be eligible for flood insurance. The commissioners discussed the pros and cons of the village participation.

The cemetery has been posted with the tags to remove items. Vice President White asked if the items removed would be immediately disposed of. The village manager answered yes. He has talked to several residents that understand the enforcement of the rules.

The chipping was supposed to start this week but the truck used to pull the chipper is presently in the shop. When the truck is repaired the chipping will take place.

This week the cemetery foundations are being poured. The mowing is being finished up. Paint projects are being finished.

V ACTION ITEMS

Ordinance #2009-8 was read. AMENDING ORDINANCE 32007-4 COMMONLY KNOWN AS THE VILLAGE OF SOUTH CHARLESTON INCOME TAX ORDINANCE.

VI CLERK'S REPORT

The clerk placed quarterly reports into the packets. The reports consisted of FUND STATUS, REVENUE STATUS, APPROPRIATION STATUS, CASH SUMMARY BY FUND and the RECONCILIATION.

Clark Schaeffer and Hackett visited the office on Wednesday September 16th. The clerk made copies of all the reconciliations for the auditor. The auditor discussed what part of 2008 could be audited at the next audit. The clerk was directed to publications on the state auditor website that pertained to a checklist of audit items. The auditor also gave the clerk some information that could be studied to check on what kind of investments the village could legally be involved in.

R.I.T.A will hold court for tax non filers on January 5, 2010.

The clerk has been working with the interim police chief concerning the police budget.

A resolution to move money from line item to line item will be ready for the next meeting.

An appeal was turned down by ODJFS on an unemployment matter and another appeal has been filed.

VIII COMMISSIONER COMMENTS

Commissioner McKinney had no comments. Vice President White asked about the status of the web site. Mr. Rice noted that Mr. Terrell is still trying to get the website running. Two websites actually exist at this time. The web site may have to be reconstructed. Vice President White also noted that maybe in the spring the fence at the cemetery could be painted.

President Hines discussed the situation at the Catholic Church on the drainage issue. The drainage issue involves several properties and he was questioning who would be responsible. Mr. Peifer stated that with the tile as old as it is, that prescriptive rights exist. The village will try to use a camera in the tile to see where the blockage exists.

Mr. Peifer raised the issue of nominating a person to the CFA board. The Clark County Convention Facility has the right to levy the hotel and motel tax. The funds would support the convention facilities. All municipalities have the right to nominate a member. Mr. Hines asked for suggestions and will submit a name of a person on Friday.

IX PUBLIC COMMENTS

Mr. Dave Finchum asked the commission to prioritize the drainage issue. Mr. Hines noted that it will be looked at very soon.

Mr. Tillman asked if there were any know flood plain issues other that Gilroy Ditch. Mr. Rice noted that there didn't appear to me any other flood plains.

Mr. Finchum noted a drainage problem at James Court. Mr. Hines noted that if more property is purchased for the cemetery, drainage issues will have to be addressed.

XII MOTION TO ADJOURN

Vice President White called for a motion to adjourn. Commissioner White seconded the motion and with a vote of 3/0 the meeting adjourned at 7:30 PM.
