THANK YOU, GOOD MORNING, UM, WE WILL START OUR PUBLIC PARTICIPATION, WE HAVE FIRST, JOHN NICKELSON, YOU WISH TO SPEAK ANT THE CITY OF--ABOUT THE CITY OF DAYTONA BEACH.

DAYTONA BEACH.

YOU ARE ON. YOU ARE ON. ALL RIGHT, 413 [ INAUDIBLE ] AVENUE, STARTING, I AM A BIT O FENDED THAT THE COUNTY--OFFENDED THAT THE COUNTY DOES NOT ALLOW PUBLIC FOR DISSIPATION AT THE CITY COUNCIL MEETING. THE CITY OF DAYTONA BEACH DID IT THE SAME WAY. I THOUGHT THERE WAS A RULING THAT SAID THAT THE PUBLIC HAD A CHANCE TO PEEK. I UNDERSTAND THAT PUBLIC PARTICIPATION IS ENCOURAGED, BUT ONLY AT COUNTY COUNCIL MEETINGS.

THAT IS INCORRECT. ON ISSUES THAT COME BEFORE THE COUNTY COUNCIL, YOU CAN SPEAK ON THOSE ISSUES.

CORRECT, BUT YOU CANNOT SPEAK ABOUT GENERAL THINGS, WHICH YOU USED TO DOT IN THE PAST--USED TO DO IN THE PAST. BUT AT ANY RATE, I SPOKE AT THE CITY COMMISSION MEETING LAST NIGHT IN DAYTONA BEACH AND IT IS AN ONGOING PROBLEM, ONE, THE VIOLATION OF THE SUNSHINE LAW. THE CRs IS FROM THE STATE, THROUGH THE COUNTY, AND THE COUNTY THEN, ADMINISTRATES IT THROUGH THE CITIES: THE [ INAUDIBLE ]CRA HAS EVERY PROBLEMS, ONE OF WHICH IS THE SUNSHINE LAW. AT ONE PUBLIC MEETING THE SHAREMAN SAID THAT VIRGINIA, YOU KNOW HOW TO VOTE, WE DISCUSSED IT THIS MORNING AT THE GATEWAY. THE ATTORNEY PRESENT SAID IT IS NOT A VIOLATION OF THE SUNSHINE LAW BECAUSE THEY TALKED ABOUT THE MEETING AT A RESTAURANT. I BELIEVE IT IS A VIOLATION. I WOULD ASK YOU TO LOOK INTO IT OR ASK YOUR ATTORNEY TO LOOK INTO IT AND SEE IF A METEROLOGIST METEROLOGIST TO GO WAS--IF A MEETING WAS HELD TO PREDETERMINE VOTES. TWO, UM, SEVERAL YEARS AGO, AN AUDIT WAS ASKED FOR, $1 MILLION WAS DETERMINED, 27 VIOLATIONS, ONE OF WHICH WAS $1 MILLION TO BE RETURNED TO THE MAIN STREET. THERE HAS BEEN NO DOCUMENTATION THAT IT HAS. I WOULD LIKE TO VERIFY AND THEY ROW FUSE TO VERIFY IT. THIRD, I THINK IT IS ILLEGAL TO SPEND FUNDS OUTSIDE, SO WHAT JIM HAS DETERMINED, THEY DUMPED ALL OF THE CRA FUNDS INTO ONE POT. THE MANAGER OF THE CRA SAID BECAUSE MAIN STREET HAS EXCESS MONEY, THEY ARE USING THOSE FUNDS TO HELP SUPPORT THE OTHERS. I THINK THAT IS ILLEGAL. UM, THIRD, OR FOURTH, UM, WE HAVE RESTAURANTS IN THE CRAs THAT DO NOT SERVE FOOD. UM, WE PASSED AN ORDNANCE, IF THEY HAVE $10,000 OF WORTH OF EQUIPMENT, WE WILL ALLOW THEM A LICK OR LICENSE AND NOW WE HAVE THREE RESTAURANTS THAT CAN-- LIQUOR LICENSE AND NOW WE HAVE THREE THAT DO NOT SERVE FOOD. AND WE HAVE THE UNEQUAL ZONES IN DAYTONA BEACH. WHEN WE DID THE ZONES AT THE TEN YEAR CENSUS, ZONES FIVE AND SIX WERE 10% OVER THE MEDIUM. THOSE ARE OUR--MEDIAN. THOSE ARE THE GROWING AREAS, I THINK AT SOME POINT, WE SHOULD NOT WAIT TEN YEARS UM, TO RECTIFY THAT. --TO RECTIFY THAT. WE DID THAT EVERY YEARS AGO. CHARLES WHICH ARE RICHARDSON ZONE HAD 6000 VOTERS ANT ZONE NEXT TO IT HAD 16,000 VOTERS. LASTLY, ON THE BRIDGE, LOVE IT EXCEPT FOR THE FISHING PIERS. THEY ARE VERY SMALL. THANK YOU.

THANK YOU, SIR.

I LIVE AT 66 [ INAUDIBLE ] IN DE-BERRY, FLORIDA. I WOULD LIKE TO POINT OUT SOME DISHONESTY ABOUT THE VOLUSIA CITY COUNCIL, IT SAYS REQUEST TO APPEAR BEFORE THE COUNTY COUNCIL. WHERE ARE THEY? WHERE ARE THEY? THIS THREE MINUTES MEAN NOTHING, IT SHOULD BE WHEN THE WHOLE, ENTIRE COUNCIL IS IN SESSION. I REQUESTED THAT THE COUNTY COUNCIL QUIT BEING DISHONEST. AT ANY RATE, WHAT I HAVE TO SAY IS THE SUN RAIL HAD AN OPEN HOUSE IN DE-BERRY LAST SATURDAY. I WOULD LIKE TO CALL SUN RAIL STUN RAIL BECAUSE OF THE COST AND THE PROMISES THAT IT HOLDS. THE REPRESENTATIVE WAS THERE BUT GUESS WHO FAILED TO SHOW UP? REP RE-REASON SIEVES OF THE RAIL VEHICLE CODE, THEY--REP RE-REASON SIEVES OF THE--REP RE-REASONTIVES OF THE RAIL--REPRESENTATIVES OF THE RAILROAD, PLUS THE REST OF THE WINNERS THAT MADE MONEY ON THE 1.4 3-0 YELL--$1.3 MILLION COST. BUT THE MOST IMPORTANT THING, IF YOU WILL RECALL, THE DOWNS PROJECT IS. THAT WAS ABOUT FOUR OR FIVE YEARS AGO, NOW WHO KILLED THE DOWNS PROJECT IN IT WAS A $20 MILLION PRIVATE INVESTMENT AND WHO KILLED IT? DAYTONA DID, THEY CAME IN THERE AND INDYMENATED THAT CITY OUT OF THAT $20 MILLION, PRIVATE, PRIVATE INVESTMENT. THEY ARE THE ONES THAT KILLED IT. DAYTONA KILLED IT. NOW DAYTONA HAS THE NERVE TO WANT TO COME IN HERE AND HAVE PEOPLE LIKE ME THAT PAY TAXES, PAY $20 MILLION FOR A GIFT FOR THE MULTIMILLIONAIRES FROM THE SPEEDWAY, LISA FRANCE KENNEDY.

LET'S KEEP PERSONALITIES OUT OF IT. YOU MAY TALK ABOUT THE PROJECT.

LISA FRANCE KENNEDY IS WORTH $872 MILLION.

I STILL REQUEST--

NO, NO, SHE IS WORTH, THAT IS NOT AN ATTACK ON HER. I AM GLAD SHE IS. BUT THE POINT IS THAT SHE IS COMING IN HERE AND TRYING TO PUSH $20 MILLION OUT OF THE POCKETS OUT OF THE TAXPAYERS AND THE PEOPLE DO NOT PAY TAXES IN VOLUSIA COUNTY AND THE KENNEL CLUB DESTROY THAT HAD PROJECT, AND THE SAME PEOPLE ARE COMING IN HERE AND WANTING $20 MILLION, FREE GIVE AWAY MONEY. AND I THINK IT IS A DISGRACE. THANK YOU.

THANK YOU.

TURN IT BACK ON.

THERE ARE NO OTHER PUBLIC PARTICIPATION. SO WE WILL UM, RECONVENE AT 9:00 A.M.

MR. BYRON, CAN YOU COME FORWARD AND EXPLAIN THE NEW PROCESS, PLEASE?

GOOD MORNING ABILITY TO GO CHAIR AND MEMBER OF THE COUNTY COUNCIL. MEMBERS OF THE CITIZENS THAT ARE HERE, AND ON THE INTERNET, I AM DAVE BYRON, THE DIRECTOR OF THE DEPARTMENT OF COMMUNITY SERVICES. I WANTED TO TALK TO THE COUNTY COUNCIL THIS MORNING ABOUT A CHANGE IN THE PROCESS OF UM, PROCLAMATIONS THAT HAVE BEEN REQUESTED. THEY ARE REQUESTED IN A NUMBER OF DIFFERENT FORMS, THEY COME THROUGH TO THE STAFF AND TO THE COUNCIL MEMBERS, AND SO FORTH. AND SO INSURE THAT ALL COUNCIL MEMBERS ARE IN AGREEMENT WITH THE PROCLAMATIONS THAT COME OUT FROM THE FULL COUNCIL, WE ARE CHANGING THE PROCESS TO SOME DEGREE. SO WHAT WE ARE DOING IS WE HAVE CREATED A PRESENCE ON THE COUNTY WEBSITE, UNDER THE COUNTY COUNCIL TAB AND ALSO IN THE DROP DOWN MENU. AND AS THEY COME IN TO THE STAFF, THE STAFF WILL PREPARE THE PROCLAMATIONS AS IF THEY WERE TO BE APPROVED AND WE WILL KEEP THAT RUNNING LIST AND PRESENT IT TO YOU AT EVERY MEETING. AND SO THE PROCLAMATIONS THAT HAVE COME IN AND HAVE NOT BEEN APPROVED BY THE COUNTY COUNCIL, WHICH WE WOULD LIKE TO HAVE YOU APPROVE THIS MORNING AND WE'LL MOVE FORWARD WITH THOSE. AND IF THERE IS A PROCLAMATION THAT NOT ALL COUNCIL MEMBERS AGREE WITH, THAT WILL BE PRESENTED BY THE COUNTY CHAIR. SO THE PROCLAMATIONS THEAVE HAVE FOR YOUR--THAT WE HAVE FOR YOUR CONSIDERATION, KIND OF GIVING THE STAFF A GO FORWARD, WELCOME HOME VIETNAM VETERAN'S DAY, THAT HAS BEEN DONE, WE SENT YOU AN E-MAIL AND ASKED IF THAT WAS OKAY. WATER CONSERVATION MONTH, WHICH IS IN APRIL, THAT HAD BEEN REQUESTED BY WATER AN UTILITIES AT THE THE COUNTY. VOLUNTEER MONTH, REQUESTED BY THE UNITED WAY OF VOLUSIA, FLAGLER, TO RECOGNIZE THE IMPORTANCE OF PEOPLE VOLUNTEERS. KOREAN WAR VETERANS DAY, IT WAS REQUESTED BY THE VFW. THAT PROCLAMATION IS FOR YOUR CONSIDERATION. VERONICA [ INAUDIBLE ] DAY, THIS HAS BEEN REQUESTED BY THE CHAIR TO HONOR AN ELEMENTARY SCHOOL STUDENT ON THE POSTER CONTEST WINNER. RELAY FOR LIFE, THAT HAD BEEN REQUESTED BY THE AMERICAN CANCER SOCIETY. SO THOSE PROCLAMATIONS HAVE BEEN PREPARED FOR YOUR CONSIDERATION, THEY ARE LISTED UM, AS AN I SUPPLEMENT TO THE A--AS A SUPPLEMENT TO THE AGENDA, AND WE ALSO HAVE THREE WHICH HAVE COME IN AND BEEN REQUESTED BUT HAVE NOT BEEN PREPARED BECAUSE WE ARE TRYING TO GET THE INFORMATION, AND THAT IS [ INAUDIBLE ] DAY, THAT HAD BEEN REQUESTED BY PHYLLIS HAS HE RECEIVES AN AWARD FOR COMMUNITY SERVICE. JILL [ INAUDIBLE ] DAY, THE SAME THING, REQUESTED BY PHYLLIS. CHEF'S APPRECIATION DAY, IT WAS REQUESTED BY AN OKAY PARK RESIDENT, IT--BY AN ORANGE PARK RESIDENT, IT TIES IN WITH PINK TIE. AND THEN VOLUNTEERS AT VOLUSIA ELEMENTARY. SO AGAIN, IT IS A DIFFERENT PROCESS FOR US BUT THEY ARE LISTED AS THEY COME IN AND WE ARE GOING TO UPDATE THE LIST, UM, AND THEN PRESENT IT TO YOU AT EVERY MEETING. IF THERE WAS A PROCLAMATION THAT IS ON THE LIST THAT ONE OF YOU YOU WOULD HAVE A CONCERN ABOUT, PLEASE CALL ME OR PAT, AND WE WILL TAKE IT FROM THERE. SO WITH THIS PROCESS, WE PRESENT TO YOU TODAY, WE ARE SEEKING YOUR APPROVAL.

THANK YOU, I BELIEVE WE NEED A MOTION. I HAVE A MOTION BY MS. DENYS TO APPROVE. SECONDED BY MR. WAGNER. I THINK I WILL HOLD BACK ON THAT ONE. IS THERE ANY OBJECTION TO THE MOTION? PARDON ME? OKAY, I AM SORRY, DISCUSSION.
