4.  Rulemaking -- OAC 252:100 Air Pollution Control

The proposed changes to Section 47 of Subchapter 39 replace the existing ARACT (Alternate Reasonably Available Control Technology) requirement for control of VOC emissions from coating operations at aerospace sources in Tulsa County with the requirements contained in the EPA Guideline Series: Control of Volatile Organic Compounds Emissions from Coating Operations at Aerospace Manufacturing and Rework Operations, December 1997. As part of this action, the Department proposes to revoke the source-specific ARACT plans for several facilities.

5.  Rulemaking – OAC 252:510 Municipal Solid Waste Landfills

The proposed new and amended Sections are designed to implement recent statutory changes within the Oklahoma Solid Waste Management Act. These changes will implement requirements regarding landfill vegetation and landfill borrow areas.

6.  Rulemaking – OAC 252:520 Solid Waste Management

The proposed new and amended Sections are designed to implement various statutory requirements, including landfill vegetation, landfill soil borrow areas, waste tire baling permits, incentive payments for use of landfill methane gas, and timelines for review of biomedical waste facility certificates of need.

7.  Opportunity for Public Comment on Proposed Rules – OAC 252:510/515/520 Municipal Solid Waste Landfills/Solid Waste Management

The DEQ has proposed that Chapters 510 (Municipal Solid Waste Landfills) and 520 (Solid Waste Management) of the Oklahoma Administrative Code be revoked, and that Chapter 515 (Regulations for the Management of Solid Waste) be concurrently adopted. Chapter 515 is the result of a comprehensive review and rewrite of existing rules, and involves the merging of Chapters 510 and 520. The required public notice of these proposals announced the opportunity for public comment at this Board meeting (as well as at the April 18, 2002 Solid Waste Management Advisory Council meeting). However, the DEQ requests that formal action on the proposals be continued to the November 19 Board meeting, so that proposed Chapter 515 can be slightly revised to account for very recent statutory changes concerning tires.

* Specification of proposed adoption by emergency rulemaking, by permanent rulemaking, or by both, is based on the recommendations of the respective advisory councils. Adoption or amendment of rules as emergency rulemaking requires a finding by the Board that a compelling extraordinary circumstance warrants the seeking of emergency certification, so that the rules will take effect immediately upon the Governor's signature. Absent a finding and certification of emergency, rules adopted today will not become effective until May or June of 2002.
