"4.10Introductionofchanges

4.10.1Employer'sdutytonotify

(a)Whereanemployerdecidestointroducechangesinproduction,program,organisation,structureortechnology,thatarelikelytohavesignificanteffectsonemployees,theemployershallnotifytheemployeeswhomaybeaffectedbytheproposedchangesand,whererelevant,theirunionorunions.

(b)'Significanteffects' includesterminationofemployment,majorchangesinthecomposition,operationorsizeoftheemployer'sworkforceorintheskillsrequired;theeliminationordiminutionofjobopportunitiesorjobtenure;thealterationofhoursofwork;theneedforretrainingortransferofemployeestootherworkorlocationsandtherestructuringofjobs:

ProvidedthatwheretheAwardmakesprovisionforalterationofanyofthemattersreferredtohereinanalterationshallbedeemednottohavesignificanteffect.

4.10.2Employer'sdutytoconsultoverchange

(a)Theemployershallconsulttheemployeesaffectedand,whererelevant,theirunionorunionsabouttheintroductionofthechanges,theeffectsthechangesarelikelytohaveonemployees(includingthenumberandcategoriesofemployeeslikelytobedismissed,andthetimewhen,ortheperiodoverwhich,theemployerintendstocarryoutthedismissals),andthewaystoavoidorminimisetheeffectsofthechanges(e.g.byfindingalternateemployment).

(b)Theconsultationmustoccurassoonaspracticableaftermakingthedecisionreferredtoinclause4.10.1.

(c)Forthepurposeofsuchconsultationtheemployershallprovideinwritingtotheemployeesconcernedand,whererelevant,theirunionorunions,allrelevantinformationaboutthechangesincludingthenatureofthechangesproposed,theexpectedeffectsofthechangesonemployees,andanyothermatterslikelytoaffectemployees,providedthatanyemployershallnotberequiredtodiscloseconfidentialinformation,thedisclosureofwhichwouldbeadversetotheemployer'sinterests.

4.11Redundancy

4.11.1Consultationbeforeterminations

(a)Whereanemployerdecidesthattheemployernolongerwishesthejobtheemployeehasbeendoingtobedonebyanyone,andthisisnotduetotheordinaryandcustomaryturnoveroflabour,andthatdecisionmayleadtoterminationofemployment,theemployershallconsulttheemployeedirectlyaffectedandwhererelevant,theirunionorunions.

(b)Theconsultationshalltakeplaceassoonasitispracticableaftertheemployerhasmadeadecision,whichwillinvoketheprovisionsofclause4.11.1(a)andshallcoverthereasonsfortheproposedterminations,measurestoavoidorminimisetheterminationsand/ortheiradverseaffectsontheemployeesconcerned.

(c)Forthepurposeoftheconsultationtheemployershall,assoonaspracticable,provideinwritingtotheemployeesconcernedand,whererelevant,theirunionorunions,allrelevantinformationabouttheproposedterminationsincludingthereasonsfortheproposedterminations,thenumberandcategoriesofemployeeslikelytobeaffected,thenumberofworkersnormallyemployedandtheperiodoverwhichtheterminationsarelikelytobecarriedout:

Providedthatanemployershallnotberequiredtodiscloseconfidentialinformation,thedisclosureofwhichwouldbeadversetotheemployer'sinterests.

4.11.2Transfertolowerpaidduties

(a)Whereanemployeeistransferredtolowerpaiddutiesforreasonssetoutinclause4.11.1theemployeeshallbeentitledtothesameperiodofnoticeoftransferastheemployeewouldhavebeenentitledtoiftheemployee'semploymenthadbeenterminatedunderclause4.7.

(b)Theemployermay,attheemployer'soption,makepaymentinlieuthereofofanamountequaltothedifferencebetweentheformeramountstheemployerwouldhavebeenliabletopayandthenewloweramounttheemployerisliabletopaytheemployeeforthenumberofweeksofnoticestillowing.

(c)Theamountsmustbeworkedoutonthebasisof:

(i)theordinaryworkinghourstobeworkedbytheemployee;and

(ii)theamountspayabletotheemployeeforthehoursincludingforexample,allowances,loadingsandpenalties;and

(iii)anyotheramountspayableundertheemployee'semploymentcontract.

4.11.3Transmissionofbusiness

(a)Whereabusinessis,whetherbeforeorafterthedateofinsertionofthisclauseintheAward.transmittedfromanemployer(transmittor)toanotheremployer(transmittee),andanemployeewhoatthetimeofsuchtransmissionwasanemployeeofthetransmittorofthebusiness,becomesanemployeeofthetransmittee:

(i)thecontinuityoftheemploymentoftheemployeeshallbedeemednottohavebeenbrokenbyreasonofsuchtransmission;and

(ii)theperiodofemploymentwhichtheemployeehashadwiththetransmittororanypriortransmittorshallbedeemedtobeserviceoftheemployeewiththetransmittee.

(b)Inclause4.11.3, 'business' includestrade,process,businessoroccupationandincludesapartorsubsidiary(whichmeansacorporationthatwouldbetakentobeasubsidiaryundertheCorporationsLaw,whetherornottheCorporationsLawappliesintheparticularcase)ofanysuchbusinessand 'transmission' includestransfer,conveyance,assignmentorsuccessionwhetherbyagreementorbyoperationoflawand 'transmitted' hasacorrespondingmeaning.

4.11.4Timeoffduringnoticeperiod

(a)Whereadecisionhasbeenmadetoterminateanemployeeinthecircumstancesoutlinedinclause4.11.1(a),theemployeeshallbealloweduptooneday'stimeoffwithoutlossofpayduringeachweekofnoticeforthepurposeofseekingotheremployment.

(b)Iftheemployeehasbeenallowedpaidleaveformorethanonedayduringthenoticeperiodforthepurposeofseekingotheremployment,theemployeeshall,attherequestoftheemployer,berequiredtoproduceproofofattendanceataninterviewortheemployeeshallnotreceivepaymentforthetimeabsent. Forthispurposeastatutorydeclarationwillbesufficient.

4.11.5NoticetoCentrelink

Whereadecisionhasbeenmadetoterminateemployeesinthecircumstancesoutlinedinclause4.11.1,theemployershallnotifyCentrelinkassoonaspossiblegivingallrelevantinformationabouttheproposedterminations,includingawrittenstatementofthereasonsfortheterminations,thenumberandcategoriesoftheemployeeslikelytobeaffected,thenumberofworkersnormallyemployedandtheperiodoverwhichtheterminationsareintendedtobecarriedout.

4.11.6Severancepay

(a)Inadditiontotheperiodofnoticeprescribedforordinaryterminationinclause4.7,andsubjecttofurtherorderoftheCommission,anemployeewhoseemploymentisterminatedforreasonssetoutinclause4.11.1(a),shallbeentitledtothefollowingamountsofseverancepay:

(b)'Weeks' Pay' meanstheordinarytimerateofpayfortheemployeeconcerned:

Providedthatthefollowingamountsareexcludedfromthecalculationoftheordinarytimerateofpay:overtime,penaltyrates,disabilityallowances,shiftallowances,specialrates,faresandtravellingtimeallowances,bonusesandanyotherancillarypayments.

4.11.7Superannuationbenefits

AnemployermaymakeanapplicationtotheCommissionforrelieffromtheobligationtomakeseverancepaymentsincircumstanceswhere:

(a)theemployerhascontributedtoasuperannuationschemewhichprovidesaparticularbenefittoanemployeeinaredundancysituation;and

(b)theparticularbenefittotheemployeeisoverandaboveanybenefittheemployeemightobtainfromanylegislativeschemeprovidingforsuperannuationbenefits(currentlythefederalSuperannuationGuaranteelevy)oranawardbasedsuperannuationscheme.

4.11.8Employeeleavingduringnotice

Anemployeewhoseemploymentisterminatedforreasonssetoutinclause4.11.1(a),mayterminatesuchemploymentduringtheperiodofnotice,and,ifso,shallbeentitledtothesamebenefitsandpaymentsunderthisclausehadsuchemployeeremainedwiththeemployeruntiltheexpiryofsuchnotice:

Providedthatinsuchcircumstancestheemployeeshallnotbeentitledtopaymentinlieuofnotice.

4.11.9Alternativeemployment

Anemployer,inaparticularcase,maymakeapplicationtotheCommissiontohavethegeneralseverancepayprescriptionamendediftheemployerobtainsacceptablealternativeemploymentforanemployee.

4.11.10 Employeeswithlessthanoneyear'sservice

Clause4.11shallnotapplytoemployeeswithlessthanoneyear'scontinuousserviceandthegeneralobligationonemployersshouldbenomorethantogiverelevantemployeesanindicationoftheimpendingredundancyatthefirstreasonableopportunity,andtotakesuchstepsasmaybereasonabletofacilitatetheobtainingbytheemployeesofsuitablealternativeemployment.

4.11.11 Employeesexempted

Clause4.11shallnotapply:

(a)whereemploymentisterminatedasaconsequenceofmisconductonthepartoftheemployee;or

(b)toemployeesengagedforaspecificperiodortask(s);or

(c)tocasualemployees.

4.11.12 Employersexempted

(a)SubjecttoanorderoftheCommission,inaparticularredundancycase,clause4.11shallnotapplytoanemployerincludingacompanyorcompaniesthatemployemployeesworkingatotaloffewerthan550hoursonaverageperweek,excludingovertime,MondaytoSunday.The550hoursshallbeaveragedovertheprevious12months.

(b)A 'company' shallbedefinedas:

(i)acompanyandtheentitiesitcontrols;or

(ii)acompanyanditsrelatedcompanyorrelatedcompanies;or

(iii)acompanywherethecompanyorcompanieshasacommonDirectororcommonDirectorsoracommonshareholderorcommonshareholderswithanothercompanyorcompanies.

4.11.13 Exemptionwheretransmissionofbusiness

(a)Theprovisionsofclause4.11.6arenotapplicablewhereabusinessisbeforeorafterthedateoftheinsertionofthisclauseintotheAward,transmittedfromanemployer(transmittor)toanotheremployer(transmittee),inanyofthefollowingcircumstances:

(i)wheretheemployeeacceptsemploymentwiththetransmitteewhichrecognisestheperiodofcontinuousservicewhichtheemployeehadwiththetransmittor,andanypriortransmittor,tobecontinuousserviceoftheemployeewiththetransmittee;or

(ii)wheretheemployeerejectsanofferofemploymentwiththetransmittee:

(A)inwhichthetermsandconditionsaresubstantiallysimilarandnolessfavourable,consideredonanoverallbasis,thanthetermsandconditionsapplicabletotheemployeeatthetimeofceasingemploymentwiththetransmittor;and

(B)whichrecognisestheperiodofcontinuousservicewhichtheemployeehadwiththetransmittorandanypriortransmittortobecontinuousserviceoftheemployeewiththetransmittee.

(b)TheCommissionmayamendclause4.11.13(a)(ii)ifitissatisfiedthatitwouldoperateunfairlyinaparticularcase,orintheinstanceofcontrivedarrangements.

4.11.14 Incapacitytopay

AnemployerinaparticularredundancycasemaymakeapplicationtotheCommissiontohavethegeneralseverancepayprescriptionamendedonthebasisoftheemployer'sincapacitytopay.".
