ReductioninForce

Section1. General

  1. Inmakingthenecessarycorporationreductionincertifiedteachingstaffpositions,theBoardshallfirstdosothroughnaturalattrition(i.e.,retirements,leavesofabsence,resignations,etc.). If this is not possible, and it is necessary to reduce the number of teachers, the Superintendent, or designee, will first meet with the EAEA to discuss the proposed reductions.
  1. In the event of a reduction in force or recall after layoff, the following criteria will be considered:
  1. Certification
  2. Teacher status ( Determine Established group)
  3. Performance
  4. Years of experience

Section2. Procedure

  1. Teacherswill be placed in two groups: Group 1. Established Teachers (IC 20-28-6-8(a) hired before July 1, 2012 and, at any time before July 1, 2012 enters into a teacher’s contract for further service with the school corporation. Group 2 Teachers (hired after July 1, 2012) that never had tenure.
  2. Selection will be from Group 2 teachers and may be based on performance.
  3. In cases where teachers are placed in the same performance category, any of the following items may be considered (as defined by IC 20-28-9-1.5(b):
  1. The attainment of either additional content area degrees beyond the requirements for employment; or additional content area degrees and credit hours beyond the requirements for employment, if required under an agreement bargained under IC 20-29
  2. The assignment of instructional leadership roles, including the responsibility for conducting evaluations underIC 20-28-11.5.

c. The academic needs of students in the school corporation.

Section3. Notification Procedure

Teachers on the recall list will be notified of available positions in their areas for which they are licensed and highly qualified. If notified, it shall be by personal contact and in writing. The teacher shall submit a letter of interest and resume to the Director of Human Resources for consideration. All documents shall be submitted within three(3) days of notification. Temporary assignments (filling in for another teacher on leave) may be offered to a teacher on recall, but no teacher shall be removed from the recall list for refusing to accept a temporary assignment.

Section3. RecallList–ActiveStatus

A teacher released because of reduction in force shall not have a break in service for a period of one (1) year. After one (1) year on recall, his/her name shall be removed from the recall list unless an extension is requested by the teacher to remain on the recalllist for a second year. The request from the teacher must be in writing and sent to theDirector of Human Resources, prior to March 31 of the first year on recall.
