Call to Order

The regular Town Board Meeting of Supervisors was called to order at 7:05 p.m.; followed by the Pledge of Allegiance.

Roll Call

Clerk Marilyn S. Larson called the roll with Chairperson Cecil Logterman and Supervisors; Jim Terpstra, Dale Wheelock, Kevin Schutt, Dan Kilkenny, Rick Logterman, and Town Attorney Kim Howarth were present. Others Present: Bob Williams, Eric Sladek, Sgt. Ken Brand, Ken Truckey, Liz Baumann, Kurt Zipp, Justin Schuenke, George Bashaw, Bill Henry, Rebecca LeMire, Bill Vance, and others.

Assurance of Proper Notice

Marilyn S. Larson assured those present the Town Board Meeting for Tuesday, December 6, 2016 was properly noticed.

Approve of November 1, 2016 Regular Town Board Minutes

Supervisor Wheelock moved to approve the November 1, 2016 Meeting Minutes; seconded by Supervisor Kilkenny; carried 5-0.

Treasurer’s Report for the month of November 2016

Supervisor Kilkenny moved to approve the November 2016 Treasurer’s Report subject to annual audit; seconded by Supervisor Schutt; carried 5-0.

Standing Committee

Treasurer Rick Logterman explained the Finance Committee recommendation to invest $509,422.11 which includes interest and principal from Land Fill I & II and Reserve Fund I & II with Johnson Bank Investment at the rate 1.74 maturities and 3.0 coupon. Discussion amongst Supervisors. Supervisor Kilkenny moved to approve the recommendation of the Finance Committee; seconded by Supervisor Terpstra; carried 5-0. Supervisor Kilkenny moved that the treasurer and attorney look into Morgan Stanley Investments regarding possible new investments; seconded by Supervisor Terpstra; carried 5-0.

Plan Commission

Supervisor Kilkenny reported no meeting.

Park Commission & Recreation Commission

Supervisor Wheelock reported no meeting .

Darien Family Connections

Supervisor Wheelock commented the new format seems to have smaller print; otherwise the Clerk reported everything is going well.

Public Works

Superintendent Bob Williams reported all the plows are on the trucks; and the new truck 17 worked very well in the first snow. Bob is completing all the minor maintenance on all the trucks.

Fire/EMS Liaison Report

Supervisor Terpstra reported he attended the Fire Department Board Meeting; the Fire Department preformed team building skills using their extrication equipment.

EMS Chief Eric Sladek reported.

Darien Fire Chief Report

Fire Department Justin Schuenke reported the fire department has received 20 calls in the past 30 days. The Memorial Garden is completed and the 2nd half of the fire inspections will be completed in a couple of weeks.

Citizen’s Comment

Mark Radtke was concerned regarding the drop EMS calls. Kurt Zipp would like to see the Town and Village work together to create a Fire/EMS Commission. Town Clerk mentioned the State President recount was successful for the Town of Darien; there were no new changes.

Unfinished Business

Discussion and possible action on potential purchase of Lenov Idea Pad Mix Tablets (8) for Town Supervisors

Supervisor Kilkenny moved to approve the proposal for purchase of eight Lenov Idea Pad Mix Tablets for the Town Supervisors for the amount of $5,351.80; seconded by Supervisor Schutt; carried.

Update on the Darien Town Hall Addition

Chairperson Cecil Logterman reported that the Building Committee met along with Angus Young and went over the inside and outside of the proposed addition. Angus Young will be sending the addition out for bids in January 2017.

New Business

2017 Sexually Oriented Business License Horizon, Consulting, LLC d/b/a Show Palace

Liquor License – Horizon Consulting, LLC, d/b/a Show Palace, Agent Steve Polhlabel

Cigarette License - Horizon Consulting, LLC, d/b/a Show Palace, Agent Steve Polhlabel

Supervisor Kilkenny moved to bring Neela into the conversation; seconded by Supervisor Wheelock; carried; 5-0. Chairperson Cecil Logterman explained to Neela since they have stated a new business as opposed to a simple name change the cost for their 2017 SOB license will $5,000. The Town Clerk explained to the Board of Supervisors that background check was done on the manager at Horizon Consulting, LLC and the Darien Fire Chief and Building Inspector have stated to the Clerk that there is nothing to prevent this business from receiving their 2017 SOB license. Supervisor Kilkenny moved to approve 2017 Sexually Oriented Business License to Horizon Consulting, LLC, approve a Liquor License to Horizon Consulting, LLC d/b/a Show Palace, Agent Steve Polhlabel and approve Cigarette License to Horizon Consulting, LLC d/b/a Show Palace; seconded by Supervisor Schutt; carried 5-0.

2017 Mobile Home Park Renewal License – W7955 Creek Road, Delavan, WI 53115

Henry from Kehoe –Henry Associates represented the Mobile Home Park located at W7955 Creek presented a current mobile home park site plan, filed a renewal application signed by the applicant, $425 renewal fee, and submitted a copy of their surety bond. The Darien Fire Department and Building Inspector both have inspected the Mobile Home Park and advised they are in compliance with Town Ordinances. Supervisor Kilkenny moved to approve the 2017 Mobile Home Park License located at W7955 Creek Road, Delavan, WI.; seconded by Supervisor Wheelock; carried. Vote 5-0. Bill Henry explained there are no more openings in the current mobile home park located on Creek Road in Darien.

Operator’s License – Jennifer Gabowski; sponsored by County Station and Jessica Springhorn sponsored by Whiskey Ranch

The Town Clerk informed the Town Board that the background checks were completed on Jennifer Gabowski and Jessica Springhorn and were approved. Supervisor Kilkenny moved to approve and operator’s license to Jennifer Gabowski and Jessica Springhorn; seconded by Supervisor Schutt; carried 5-0.

Review proposed EMS & Fire Ordinance Chapter 5 & 7

Town Attorney explained all the hiring and firing will be done by the Fire/EMS Commission and it was suggested by the Village Attorney that no members of the Town or Village Boards be on the Commission. Discussion amongst Supervisors. No action taken.

Discussion of the state of EMS & Fire Department with the possibility of action to withdraw from the Joint EMS & Fire participation or any present or future participation with the Village of Darien

Supervisor Terpstra explained he has seen no improvement in the current EMS Department. The Fire Department seems to be working well together. The Town has cooperated with the Village of Darien on many projects including: park, public works, fireworks, and library. It was discussed in October between both boards that the two current chiefs would stay in place until the Fire/EMS Commission was created. In October both boards voted to create this commission. Supervisor Terpstra that we owe to our citizens to do the right thing. Supervisor Terpstra moved to authorize Town Attorney Howarth to look in the matter of dissolving the Fire/EMS between the Village and Town of Darien and report back to the Town Board in January; seconded by Supervisor Wheelock; discussion to follow.Chairperson Cecil Logterman handed out a packet with emails from the Village of Darien, Village Attorney, and Town Attorney. Discussion amongst Supervisors. Supervisor Terpstra explained the Town pays 58.2% and the Village pays 41.80% to public safety. Chairperson Cecil Logterman explained he has people to appoint to the Fire/EMS Commission and his desire to make this into one department with; one chief. Supervisor Terpstra does not have an issue with chapters 5 & 7; he wants to know the Town’s options how to revoke the Town and Village agreement. Town Attorney Howarth was authorized to look into Supervisor’s issues. Supervisor Terpstra withdrew his motion and Supervisor Wheelock withdrew this second. Supervisor Kilkenny moved to continue with chapters 5 & 7 and Chairperson to authorize the discussion with the Village and the Town Attorney will be prepared to address Supervisor Terpstra’s concerns in January; seconded by Supervisor Wheelock; carried 5-0.

Adjournment & Voucher Approval

There being no further business to come before the Town of Darien of Supervisors; Supervisor Kilkenny moved to adjourn at 8:07 p.m.; seconded by Supervisor Schutt; carried; 5-0.
