CONDITIONS OF ENTRY

Promoter: Transport Accident Commission (ABN 22 033 947 623) of 60 Brougham Street, Geelong, Victoria, 3220.

Entry and Eligibility

  1. Information on how to enter, the mechanics of entry, and prizes forms part of these Conditions of Entry.
  2. Entry into the competition is deemed acceptance of these Conditions of Entry.
  3. Entry is only open to persons who at the time of submitting their entry:
  4. are residents of Victoria;
  5. are members of a Victorian tennis club
  6. Any entrants under the age of eighteen (18) years old must be accompanied by a parent or legal guardian.
  7. The parent or legal guardian as mentioned in Condition 4 consents to the full list of Terms and Conditions and;
  8. The parent or legal guardian understands and consents to the rules of play pertaining to Fast4 Tennis and consents to the underage entrant playing opponents over the age of eighteen (18) years old, and;
  9. There will be no concessions or advantages provided to the underage entrant of which the parent or legal guardian understand and consents to.
  10. Directors, staff and the immediate family[1] of the Promoter, Graffiti Group, Tennis Australia and any other company or organisation connected with organising this competition are ineligible to enter.
  11. The competition opens at 9:00am (AEST) on Monday 7th December 2015 and closes at 17:00 (AEST) on Friday 5th January 2016(Competition Period).
  12. Entry is by internet only via
  13. To enter the competition, Eligible Entrants must, during the Competition Period:
  14. nominatetheir two (2) most skilled club members; one male and one female who will represent their club in the competition;
  15. Nominated club members must not have been penalised or convicted for driving under the influence of alcohol or drugs or suspended or disqualified from driving for any reason in the two (2) years before 1 December 2015.

  17. submit information on behalf of their two nominated club members: including: First name and surname, DOB, address, state, post-code, email address, mobile phone number; and
  18. tell the Promoter in 25 words or less how you can play an important role in reducing road trauma to win $5000 for your local tennis club.
  19. Only one (1) entry per Eligible Entrant is permitted. Any subsequent entry after the first valid entry is received will be deemed invalid.
  20. Entries must be received by 17:00 (AEST) on Friday 5th January 2016
  21. An entry is deemed to be received at the time of receipt by the Promoterat not at the time of transmission. Entries received will be considered final by the Promoter. Entries which are partially or wholly incomplete, inaccurate, erroneous, ineligible or incomprehensible will automatically be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
  22. The use of any automated entry software or any mechanical, electronic or other means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  23. Costs associated with accessing the competition website remain an entrant’s responsibility and may vary depending on the internet service provider used. Contact details entered incorrectly on the competitionwebsite by an entrant will automatically deem an entry invalid.

Prize draws

  1. Each valid entry entered during the Competition Period will be entered into the draw.
  2. 22 valid entries (Victorian Tennis Clubs) will be selected to participate in the ‘Win $5000 for my club competition’
  3. The draws to determine the22 valid entries will take place at Graffiti Group, Level 2, 16 Palmer Parade, Cremorne, Victoria, 3121.
  4. Winning entrants will be notified by telephone and in writing (mail or email) within two (2) business days and informed of their nominated session time.
  5. The Promoter’s decision is final and no correspondence will be entered into.
  6. Entrants whose entries are drawn must confirm their eligibility to be awarded, and ability to take, the prize by 10:00am (AEST) on Monday 18th January 2016 otherwise their entry will be deemed invalid.
  7. The Promoter may conduct a further draw at the location identified at condition 16 at 10:00am (AEST) on Monday18th January 2016to distribute any prizes unclaimed by the date specified under condition 18 whether because the entrant has not responded to a notification under condition 18 or in the event of an invalid entry/entries or an ineligible entrant/sor if an entrant/s is unable to accept a prize or declines to participate in a prize. This requirement is subject to any written directions or requirements given under relevant legislation.
  8. A prize must be taken by the winner on the date specified at condition 18 otherwise the prize is forfeited. No extension or variation of the dates nominated by the Promoter will be permitted. Any element of a prize not taken in accordance with this condition 22 will be deemed to be forfeited. A prize cannot be used in conjunction with any other tickets, discounts or special offers.
  9. All additional costs not expressly stated, but which may be incurred in acceptance of a prize are the responsibility of a winner. Such additional costs include, but are not limited to, meals, beverages, spending money, transport to and from the venue, and any other transfers.
  10. Winners and their nominated club members must conduct themselves in a friendly, courteous and respectable manner at all times during their participation in a prize.
  11. Acceptance of and participation in a prize (including but not limited to entry into the venue) is subject to any prevailing terms and conditions of the venue, event organisers and any ticket suppliers (including but not limited to applicable age restrictions, ground security and ticketing), and in particular, health, behaviour, age, safety and responsible consumption of alcohol requirements.
  12. No compensation will be payable if a winner, or their nominated club members, are unable to use any element of a prize as stated for whatever reason, including refusal of entry or ejection from the venue or participation in certain activities for health, age, behaviour, safety or responsible consumption of alcohol reasons. If a winner and their nominated club membersfail to participate in a prize in the manner required, as stated in this condition and in the reasonable opinion of the Promoter, their entry into the competition and the balance of the prize will be forfeited with no compensation payable.
  13. Tickets are not replaceable if lost or stolen. Tickets cannot be sold, scalped, auctioned, raffled, pledged, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. Tickets obtained through any of these methods will not be honoured by the Promoter or any prize supplier.

Prizes

  1. 22 Eligible Entrants (Victorian Clubs) will each nominate their best two (2) club members; one male and one female to play against an opposing Eligible Entrant (Victorian Club) and their two (2) best club members; one male and one female. Each Eligible Entrant willbe selected and receive:
  2. an invitation for three (3) games of Fast4 Tennis: 1 x Men’s singles, 1 x Female’s Singles and 1 x mixed doubles for two (2) club members who will play against an opposing Victorian Club on the TAC People’s Court located at Birrarung Marr, Batman Avenue, Melbourne, Victoria, 3001 during an allocated period from Monday 18th January 2016 to Thursday 28th January 2016.
  3. The winning pair will be determined by which pair won two out of the three Fast4 games.
  4. In the event the first two Fast 4 matches; Men’s Singles and Women’s Singles is won by the same club, the third game of mixed doubles will still be played as a dead rubber.
  5. Each 22selected Eligible Entrants (Victorian Tennis Clubs) will receive:
  6. an entry into the major prize draw to win $5000 for their club.
  7. Each 11 winning pairs will receive:
  8. two (2) tickets to the Australian Open evening session at Rod Laver Arena on the same date they played their Fast4 Tennis matches.
  9. The 11 unsuccessful pairs of the Fast4 Tennis matches will receive:
  10. an Australian Open merchandise pack

The 22 Eligible Entrants are awarded an allocated session date at the nominated time of 3.30pm AEST. Eligible Entrants cannot request specific times or dates. Should the winner not be able to attend their winning session the Promoter will do all that they can in order to assist an agreeable change, however if this cannot be agreed upon the winner will have to forfeit their win. The Promoters decision is the final decision and no further communication will be engaged.

  1. On the day of the event:
  2. all winners must present at the People’s Court located at Birrarung Marr, Batman Avenue, Melbourne, 30 minutes prior to their scheduled start time to register;
  3. all winners must wear clothing suitable for a 60-90minute Fast4 tennis session including trainers with non-marking soles;
  4. all winners must comply to the rules of Fast4 Tennis;
  5. an official scoreboard, umpire and ball kids will be available during the course of each Fast4 match.
  6. Weather contingency and ‘no-shows’:
  7. Based on inclement weather, Graffiti Group will determine and communicate to participants if play will be cancelled for the subsequent day.
  8. If play is cancelled by Graffiti Group, both Victorian Tennis Clubs for that day will go into the draw to win $5000 for their club. The two (2) Rod Laver Arena tickets and two (2) merchandise packs will not be awarded and will be distributed at random in the TAC Lookout activation zone located at Birrarung Marr.
  9. If a team does not show up on the day, the opposing team will automatically win the two (2) Rod Laver Arena tickets and two (2) merchandise packs. The opposing team will have the opportunity to play a friendly singles Fast4 match on the People’s Court.
  10. If both teams on any particular day do not present for play, the two (2) Rod Laver Arena tickets and two (2) merchandise packs will be distributed at random in the TAC Lookout activation zone and the Fast4 session will be replaced with the Speed Serve activity.

General

  1. The 22 eligible teams selected to compete in the competition will go into a random draw to win $5000 for their Victorian Tennis Club:
  2. The random draw will take place at 3.30pm Saturday 30th January 2016 on the People’s Court located at Birrarung Marr.
  3. All eligible major prize draw winners will be invited to participate in the random draw. In the event an Eligible Winner cannot attend, a person nominated by Graffiti Group will act on their behalf.
  4. Each team will be provided with a tennis ball to write their Tennis Club name on. Each 22 tennis balls, will be placed in a prize barrel where a person nominated by Graffiti Group will randomly select one ball.
  5. The ball selected as per Condition 34c will determine the major prize winner of the $5000.
  6. Graffiti Group will contact the winning Victorian Tennis Club as selected by Condition 34c, on Monday February 1st, 2016to arrange payment into the nominated bank account.
  7. Prizes are not transferable or exchangeable.
  8. If the prize is unavailable for any reason the Promoter reserves the right to substitute the prize for a prize of equal or greater value subject to any relevant legislation or other requirements.
  9. The Promoter accepts no responsibility for any tax implications that may arise from any prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST.
  10. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the competition and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid.
  11. The Promoter reserves the right to request the entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the entrant’sidentity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the entrant in entering the competition, before issuing a prize.
  12. Each entrant consents to the Promoter accessing their driving and driver’s licence history in order to confirm their eligibility to enter the competition and be issued a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an entry or entrant has not been verified or validated to the Promoter’s satisfaction then all the entries of that entrant will be ineligible and deemed invalid.
  13. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any entrant from the competition if the Promoter reasonably believes they have:
  14. tampered with the entry process;
  15. submitted an entry which is not in accordance with these Conditions of Entry;
  16. engaged in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of the competition.
  17. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.A prize will only be awarded following any winning entrant validation and verification that the Promoter requires in its sole discretion.
  18. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the competition website or the information on the competition website, or to otherwise undermine the legitimate operation of this competition may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter in full for those losses, damages and costs payable as a debt due on demand.
  19. It is a condition of accepting a prize that the participantsmay be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.
  20. If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value may be awarded in lieu, subject to any written directions made under applicable legislation.
  21. If this competition is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the competition and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes, subject to any written directions made under applicable legislation.
  22. The Promoter excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the competition. This includes, but is not limited to loss and/or damage arising from:
  23. technical malfunctions, delays or failures, including those resulting from accessing any materials related to this competition and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this competition as a result of any technical malfunctions, delays or failures;
  24. theft, unauthorised access or third party interference;
  25. lost or damaged entries, prize claims or prizes; and/or
  26. acceptance and/or use of any prize.
  27. By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in a 30-60minute game of Fast4 Tennis and release the Promoter, Graffiti Group, Tennis Australia, City of Melbourne and Melbourne and Olympic Park Trust and any other company or organisation connected with organising this competition, their related bodies corporate, affiliates, officers, agents and employees from an against all liabilities loss, loss and damage of any kind arising at any time out of or in connection with the acceptance of and participation in the prize. Without limiting the foregoing the released parties are not liable for any loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the 30-60 minute game of Fast4 Tennis or any other aspect of the prize. Participantsacknowledge they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting this prize.
  28. As a condition of entering this competition, an entrant consents to, in the event they are a winner, the Promoter using the entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the competition (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a winner, the entrant will participate in all reasonable promoted activities in relation to the competition as requested by the Promoter and its agents.
  29. In consideration for the Promoter awarding any prize elements to the winner the winner hereby assigns to the Promoter all rights, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation to the Works and the winner will not be entitled to any fee for such use.
  30. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter.
  31. The Promoter and Graffiti Group on behalf of the Promoter collect personal information about an entrant for the primary purpose of including the entrant in the competition and, where appropriate, awarding prizes. If the personal information requested is not provided, the entrant cannot participate in the competition and is deemed ineligible.
  32. In addition to the above primary purpose an entrant also agrees that the Promoter and Graffiti Group on behalf of the Promoter may:
  33. in the event the entrant is a winner, publish or cause to be published the entrant winner’s name and locality in any media, as required under the relevant lottery legislation.
  34. use the information for research, survey or educational purposes including to contact the entrant in the future for this purpose or to provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
  35. An entrant can gain access to, update or correct any personal information held by the Promoter and Graffiti Group on behalf of the Promoter by contacting Candice McDonald at the Transport Accident Commission, 60 Brougham Street, Geelong Victoria, 3220. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
