Eskom reserves the right to award a tender to a supplier who may not be the highestscoring or highest ranked supplier, for the purpose of maximising recognition of Black Ownership, Black management control, skills development and/or preferential procurement in line with Section (2)(1)(f) of the PPPFA.

Local procurement has the capacity for positive impact through skills development, job creation and the overall increase in capacity and capability of local suppliers.

  1. OBJECTIVE CRITERA: ( POST EVALUATION)

The objective criteria for this transaction is according to section (2)(1)(f) of the PPPFA and will be used in awarding the tender not to the highest scorer. It includes the following:

  1. Local Content local to site
  2. Skills development.
  3. Job creation.

OJECTIVE CRITERIA:

Preference for this tender will be given to Suppliers based in South Africa.

The above will be measured by:

The supplier to provide proof of address of his/her business location

2. SKILLS DEVELOPMENT:

Successful suppliers shall develop skills per task order for development.These candidates shall be sourced from local to site (i.e. where the actual work is taking place) as shown in the SD&L Compliance Matrix (Figure 1) below. The purpose is to provide these candidates with skills and workplace experience in order to increase the opportunity for them to be employable within the industry. The supplier may develop the candidates directly, through their supply network or through the SETA accredited training providers. Tenderers are encouraged to propose Skills Development initiatives in terms of the Skills required for this project as indicated below. This will form part of the contractual obligation with the successful contractor.

The above will be measured by:

The SD&L Compliance Matrix (Figure 1) below together with a detailed training plan with milestones as to when the training will commence and be completed will be required from the successful supplier(s) at tender stage. This programme will be monitored and audited as per the agreement between the supplier(s) and SD&L Monitoring and Reporting team.

  1. JOB CREATION:

Suppliers shall propose the number of jobs to be created as a direct result of this contract. Suppliers must also propose the number of jobs to be retained as a direct result of this contract. Proposals shall be made in the SD&L Compliance Matrix (Figure 1) below.

  1. BBBEE/PREFERENCE POINTS:

Eskom is expected to do business with B-BBEE accredited suppliers and to provide statistics related thereto to government in terms of its shareholder compact with the Eskom Shareholder and comply with PPPFA.

Suppliers are required to submit a valid B-BBEE certificate as part of the tender in order to obtain preference points.

A supplier that does not submit a valid B-BBEE certificate or submits an expired B-BBEE certificate for purposes of evaluations will score zero for their B-BBEE status level of contribution.

If the successful supplier did not submit a valid B-BBEE certificate or the B-BBEE certificate has expired, Eskom must reserve the right within the RFx, to request the certificate prior to contract award or not to contract with a supplier that does not have a B-BBEE certificate, an obligation to submit such certificate within a period to be agreed to by the contracting parties should be established in the contract as well as the rights or remedies that Eskom will have in the event that the supplier fails to meet such obligation.

Note: The 2007 B-BBEE codes of Good Practice will remain applicable until 30 September 2014, after which the amended 2013 Codes of Good Practice will become applicable within Eskom, and integrated accordingly into Eskom’s Procurement Policy (32-1033), and Procedure (32-1034).
