SUBCHAPTER 3. PERMITPROVISIONS AND APPLICATIONS

PART 1. GENERAL PROVISIONS

252:515-3-5. Duration of permit

(a)Lifeofsite. Permitsshallbeissuedforthelifeofthedisposalfacility,subjecttothelimitationsof(b)ofthisSection.

(b)Commencementofconstructionandoperation. DEQmayspecifytimelineswithinpermitsforcommencementofconstructionandoperationofnewdisposalfacilities.

(c)Cessationofoperations. If a permitted activedisposal facilityceasestoacceptwastefor 30daysormorewithoutpriornoticetotheDEQ,thefacility isdeemedtobeintheprocessoffinalclosure.

(d)Suspendedoperations. Development oroperationsofadisposalfacilitymaybesuspended.Todoso,theowner/operatormust:

(1)providepriorwrittennoticetotheDEQoftheintenttosuspenddevelopmentoroperations;

(2)renewsuchnoticeannuallysuspension of development or operations beyond one year in duration requires DEQ approval and annual renewal;

(3)ifsitedevelopmentoroperationsremainsuspendedformorethanoneyear, without DEQ approval to continue suspension, the facility is deemed to be in the process of final closure and must performclosureandpost-closureactivitiesinaccordancewiththeapprovedclosureandpost-closureplans,andSubchapter25ofthisChapter;and

(4)iffinancialassuranceisrequired,postfullfinancialassuranceinaccordancewithSubchapter27ofthisChapterandtheapprovedcostestimates.

(e)Resuming operations. If facility operations cease pursuant to (c) or (d) of this Section, then prior to resuming such operations, the permit must be modified if, in the opinion of the DEQ, the permit does not comply with all current laws and regulations.

SUBCHAPTER 21. USED TIRE PROCESSING, CERTIFICATION, PERMITS ANDCOMPENSATION

PART 1. GENERAL PROVISIONS

252:515-21-2. Definitions

Thefollowingwordsandterms,whenusedinthisSubchapter,shallhavethefollowingmeaning,unlessthecontextclearlyindicatesotherwise:

"Act"meanstheOklahomaUsed TireRecyclingAct,27AO.S.§2-11-401etseq.

"ErosionControlInstaller"or"ECI"meansaperson,corporationorotherlegalentitywhohasobtainedapermitorotherauthorizationfromtheUnitedStatesArmyCorpsofEngineersoralocalConservationDistricttoprovideservicesforerosioncontrolprojects.

"OTC"meanstheOklahomaTaxCommission.

"Processing"or"usedtireprocessing"meansthedefinitionfoundat27AO.S.§2-11-401.1(16).However,inanerosioncontrol,bankstabilizationorotherusedtireconservationproject,itmeanstheproperinstallationofusedtiresobtainedfromtiredealersorprioritycleanuplistsitesintheprojectorstructureinaccordancewiththeconditionsofthepermitorotherauthorizationfromtheUnitedStatesArmyCorpsofEngineersoralocalConservationDistrict.

"Recycling" means,inthecontextofusedtires:

(A)theincorporationofusedtiresintoagriculturalusesrecognizedbytheOklahomaDepartmentofAgriculture,Food,andForestry;

(B)theincorporationofusedtiresintocivilengineeringstructuresorthecreationofnewproductsorsaleableby-productsfromtirematerials,withpriorapprovalofsuchprojectsby DEQ;

(C)theuseofprocessedtiresforenergyorfuelrecovery;or

(D)theuseofusedtiresbypermittedfacilitiesinaccordancewiththeAct,theserulesandthefacility'spermit.

"Reusable tire" means a tire that has been previously used on a vehicle, not currently mounted on a vehicle, but can be legally placed into service for vehicle use in Oklahoma.

"Usedtire"meansanunprocessedwholetireortirepartthatcannolongerbeusedforitsoriginalintendedpurposebutcanbebeneficiallyreusedasapprovedbytheDepartment.

252:515-21-5. Special collection efforts

(a)Usedtirefacilityselection. ForspecialcollectioneffortsidentifiedinOAC252:515-21-4,DEQwillcontactusedtirefacilities, andtirederivedfuelfacilities(TDF)andentitiesthatinstallerosioncontrolprojects,[hereinafterreferredtoas"qualifiedapplicantsforcollectionandtransportation",(QACT)]onarotatingbasisandidentifythelocationoftheusedtires,thenumberoftirespresent,andacontactnameandphonenumber.

(b)Timelineforcollection. TheQACTshallprovideDEQwithdocumentationtodemonstratewhetherornotthecountyinwhichthetiresarelocatedhasphysicallybeenservicedinthatquarter.TheQACTshallcollectthetiresatthelocationidentifiedandotherwiseservicethatcounty,asfollows:

(1)priortotheendofthequarter,ifthecountyhasnotbeenphysicallyservicedduringthatcalendarquarter;or

(2)priortotheendofthenextcalendarquarter,ifthepreviousquarter'sserviceiscurrent.

(c)Specialpickup. UpontherequestoftheExecutiveDirector,DEQmaynotifytheQACTtocollectcertaintireswithinseven(7)daysorreportthestatusofthespecialpickupbacktoDEQ.

(d)Collection efforts fromtiredumps or landfills and community-wide clean upevents.

DEQmayrequireaQACTtocollectfromtiredumpsorlandfillsonthePCLorfromcommunity-widecleanupeventsapprovedbyDEQ.

(1)DEQmayassigncollectioneventstoaQACT,whichshallcollectthetireswithinthetimeperiodspecified.

(2)TheQACTshallcertifytoDEQthenumberoftirescleanedupfromthecollectionevent.

PART 5. USED TIRE TRANSPORTATION

252:515-21-51. Used tiremanifests

(a)Manifestrequired.Anypersonwhotransportsmorethan10usedorusedreusabletiresoverOklahomaroadstoorfromdestinationswithinthestatemusthaveamanifestdocumentingtheproperdispositionofthetires.Allpartiesmustfullycompleteandsignthemanifest.Designatedcopiesmustbegiventoeachusedtiregenerator,transporter,andreceivingfacilityreflectedonthemanifest.

(1)Usedtirereimbursementmanifest. AUsedTireReimbursementManifestmustbeusedfortransportationofusedtirestoausedtirefacilityentitledtoreceivecompensationfromthefund.Amanifest,numberedinsequencesothateachhasauniqueidentifyingnumber,shallbeprovidedbytheusedtirefacility.

(2)Used tiretrackingmanifest. AUsedTireTrackingManifestmustbeused fortransportationofusedand reusabletirestoanylocationotherthanausedtirefacility.Amanifest,numberedinsequencesothateachhasauniqueidentifyingnumber,shallbeprovidedbytheusedtiregeneratorortransporter.

(b)Accuracyofmanifestsandtireweights.ManifestsshallbecompleteandaccurateinalldetailsandaccompaniedbyweightticketsfromcertifiedscaleswhichshowtheweightoftheloadcollectedandtransportedoracceptedforprocessingbytheQACT.

(c)Inaccurate,incomplete,orinsufficientmanifest. DEQmaynotcertifyQACTsfortireswhichareprocessedifthemanifestsforthosetiresareincomplete,unreadable,notdatedandsignedbyallparties,notaccompaniedbyaweightticket,orinanyotherrespectcannotbereliedupontoshowthatthetireswerecollected,transportedandprocessedpursuanttotheAct.

(d)Signatory.

(1)Generator. Theusedtiremanifestshallbesignedby thegeneratoroftheusedand reusable tires,alltransporters,andthereceivingfacility.

(2)Usedtiredump. Ifthetiresarefromatire dump,thelandownerorauthorizedrepresentativeshallsignthemanifestasthegenerator.Ifthelandownerisunknownorunavailableorresidesoutofstate,DEQmayauthorizeanothersignatorypriortotheremovalofanyusedtires.

(e)Recordkeeping. Within30daysofreceiptoftheusedtires,acompletedcopyofthemanifestshallbereturnedtotheusedtiregenerator.Copiesofthemanifestshallbemaintainedbythegenerator,transporter,andreceivingfacilityforaperiodoffiveyears.

PART 7. COMPENSATIONFROM THE USED TIRE INDEMNITY FUND

252:515-21-71. Eligibility requirements

(a)Eligibleusedtiresforprocessing. ThefollowingusedtiresareeligibleforcompensationfromtheFund:motorvehicletirespursuanttoSection1-134ofTitle47oftheOklahomaStatutes; semitrailer tires pursuant to Section 1-162 of the Oklahoma Statutes; trailer tires pursuant to Section 1-180 of Title 47 of the Oklahoma Statutes; vehicle tires pursuant to Section 1-186 of Title 47 of the Oklahoma Statutes; motor vehicle tires pursuant to Section 1120 of Title 47 of the Oklahoma Statutes; trailer or semitrailer tires pursuant to Section 1133 of Title 47 of the Oklahoma Statutesforwhichafeehasbeenassessedbyatiredealerormotorlicenseagent; tiresusedon implementsofhusbandry andagriculturalequipmentthatarenotmorethanfourteen(14)incheswideandforty-four(44)inchesindiameter seventy-two (72) inches in total diameter and not more than thirty (30) inches wide;

(b)Tirescollectedunderastate tireprogram. AnyusedtirecollectedinaccordancewiththerequirementsoftheOklahomaUsedTireRecyclingActisnotconsideredtobediscarded.Atirethatcanbeused,reusedorlegallymodifiedtobereusedforitsoriginalintendedpurposeand is not defined as reusable shallnotbeausedtire.

(c)Qualifiedapplicants. Thefollowingareeligibletoreceivecompensationfromthefundonlyfortheprocessingorrecyclingofthoseusedtiresreferredtoin(a)ofthissection:

(1)usedtirefacilities;

(2)ErosionControlInstallerswho,asalandowneroronbehalfofalandowner,haveobtainedapermitorotherauthorizationfromtheUnitedStatesArmyCorpsofEngineersoralocalConservationDistrictfortheuseofusedtiresforerosioncontrol,riverbankstabilization,orotherconservationprojectsonthepropertyofthelandowner;and

(3)(2)tirederivedfuelfacilities;and

(4)(3)unitsoflocalorcountygovernmentswhohaveaDEQapprovedplantobaleusedtiresforuseinengineeringprojects.

(d)Collectionandtransportation. Qualifiedapplicantsareeligibletoreceivecompensationfromthefundonlyforthecollectionandtransportationoftheusedtiresreferredtoin(a)ofthissection.

(e)PCLandcommunity-wide cleanupeventrequirement. Atleast3%to6%oftheusedtiresforwhichcompensationwillberequestedmustcomefromtiredumpsorlandfillsidentifiedonthePCLandfromcommunity-widecleanupeventsinthestateofOklahoma.TheQACTshallnotreceivecredittowardthe3%to6%requirementuntilthecollectioneffortsareapprovedbyDEQ.

(f)Apportionment. IftheUsedTireRecyclingIndemnityFund(Fund)containsinsufficientfundsinany monthtosatisfy theeligiblereimbursementsundertheAct,DEQshallapportionthepaymentsamongthequalifiedapplicantsaccordingtothefollowingformula.DividethetotalamountoftheFundavailablefordisbursementbythetotalauthorizedreimbursementsrequestedbythequalifiedapplicants.Theresultisexpressedasapercentage.Multiplythispercentagebytheamountrequestedandauthorizedforeachqualifiedapplicant,resultingintheapportionmentforthatqualifiedapplicant.

(g)AdditionalCompensation. DEQshallallocateanyremainingmoniesinthefundtoremediatetiredumps or for projects to increase market demand for products made from Oklahoma used tires.CostsmaybedeterminedbycostestimatesorunitcostsdevelopedbyDEQ.UsedtirefacilitiesorTDFfacilitiesthatremediatetiredumpsassignedbyDEQmayrequestreimbursementfromtheUsedTireRecyclingIndemnityFunduponcompletionoftheremediationasdeterminedbyDEQ.

(h)Accrued Funding. Accrued funding for the purposes specified in (g) of this section shall not exceed Five Hundred Thousand Dollars ($500,000.00). Once Five Hundred Thousand Dollars ($500,000.00) is reached, any additional funds shall be distributed as additional compensation according to 27A O.S. § 2-11-401.4 (G).

252:515-21-72. Ineligible for compensation

(a)Previouscompensation. AnypersonthathasreceivedcompensationfromthefundforprojectsidentifiedinPart9or11ofthisSubchaptershallnotbeeligibletoreceiveothercompensationfromthefundforcollection,transportationordeliveryofusedtiresinconjunctionwiththesameproject.

(b)Certainusedtires. Thefollowingusedtiresarenoteligibleforcompensationfromthefund:

(1)usedtiresnotinstalledintheapprovedprojectbyErosionControlInstallersidentifiedinOAC252:515-21-71(a)(2);

(21)usedtiresprocessedforTDFfacilitiesidentifiedinOAC252:515-21-71-(a)(3)butarenotinready-to-useconditionwhenreceivedbysuchfacilities;

(32)usedtiresnotusedintheapprovedprojectbyunitsoflocalorcountygovernmentsidentifiedinOAC252:515-21-71(b)(43);

(43)processedorrecycledusedtireslistedbytheOTCinOAC710:95-5asbeingineligibleforcompensation;and

(54)processedorrecycledusedtiresthatoriginatedoutsidethebordersoftheStateofOklahoma.

PART 9. EROSION CONTROL, RIVER BANKSTABILIZATION AND OTHERCONSERVATION PROJECTS[Revoked]

252:515-21-91. Permit

Permitsorotherauthorizationsfortheuseofusedtiresinerosioncontrol,riverbankstabilizationorotherconservationprojectsmaybeobtainedfromtheUnitedStatesArmyCorpsofEngineersoralocalConservationDistrict.

252:515-21-92. Eligibility requirements

(a)Useofpropertires.Annually,atleast3%to6%oftheusedtiresforwhichcompensation

willberequestedmustcomefromtiredumpsidentifiedonthePCLorfromcommunity-widecleanupeventsinthestateofOklahomaandinstalledinaccordancewiththisPartandthepermitorotherauthorizationfromtheUnitedStatesArmyCorpsofEngineersoralocalConservationDistrict.

(b)Used tirecollection.

TheErosionControlInstaller(ECI)shallcomplywith27AO.S.§2-11-401.4(C)(3)(b).

(c)Projectcompletionreport.Uponcompletionoftheproject,theECIshallsubmitaprojectcompletionreporttoDEQ,certifyingtheprojectwascompletedinaccordancewiththeapproveddesignplans.Thereportshallincludethefollowing:

(1)thename,addressandtelephonenumberoftheapplicant;

(2)thetiredumpfromwhichtirescame,ifany,andDEQidentificationnumber;

(3)identificationofthecommunity-widecleanupeventfromwhichtirescame,ifany;

(4)quantityoftiresremovedfromthetiredumporcommunity-widecleanupevent,bytiretype;

(5)nameandlocationoftheapprovedproject;

(6)quantityandtypeoftiresdeliveredtoandinstalledattheproject;

(7)acopyofthepermitorotherauthorizationissuedbytheUnitedStatesArmyCorpsofEngineersorlocalConservationDistrict;

(8)acopyoftheplantingplandevelopedinconjunctionwithandapprovedbytheDivisionofForestryoftheOklahomaDepartmentofAgriculture,Food,andForestry;

(9)verificationthelandowneragreestocompletetheplantingplandescribedin(8)ofthisSubsection;

(10)documentationtoverifycompliancewith(d)ofthisSection,ifapplicable;and

(11)otherinformationrequiredbyDEQ.

(d)Properdisposal.TheECIshalldisposeofanyusedtiresnotneededfortheprojectatapermittedusedtireprocessingorotherusedtirerecyclingfacility,orapermittedsoliduseddisposalfacility.

(e)DEQinspection.Aftersubmittaloftheprojectcompletionreport,DEQshallinspecttheprojectandtheprojectfiletodeterminecompliancewiththeAct,therulesinthisSubchapter,andprojectplans.

(f)Projectcomplete.If theprojectiscomplete,DEQshallnotifytheECIinwriting,withcopiestotheOklahomaDepartmentofAgriculture,Food,andForestry,andtheUnitedStatesArmyCorpsofEngineersorlocalConservationDistrict,asappropriate.

(g)Projectincomplete.If anyaspectoftheprojectisnotcomplete,DEQshallgivewrittennotificationofthedeficienciestotheECI,whoshallrespondaccordingly.Insuchcases,partialcompensationmaybeauthorizedinaccordancewithOAC252:515-21-74.

(h)Recordkeeping.RecordsrequiredbythisPartshallbemaintainedbytheECIforaperiodoffiveyearsaftercompletionoftheproject.

SUBCHAPTER 27. COST ESTIMATES AND FINANCIALASSURANCE

PART 1. GENERAL PROVISIONS

252:515-27-1. Applicability

(a)AllsolidwastedisposalfacilitiesaresubjecttotherequirementsofthisSubchapterexcept:

(1)transferstations,processingfacilities,orcompostingfacilities, other than composting facilities,thatprincipallymanagemunicipalsolidwastethe following facilities, only if they principally manage solid waste: transfer stations, processing facilities, and non-commercial composting facilities;

(2)yardwastecompostingfacilities;

(3)landdisposalfacilitiesinpost-closureasoftheeffectivedateofthisChapterthatwerenotrequiredtohavefinancialassuranceatthetimeofclosure;and

(4)unitsofStateorFederalgovernmentswhosedebtsandliabilitiesarethedebtsandliabilitiesofaStateortheUnitedStates.

(b)Afacilityidentifiedin(a)(1),(a)(2),or(a)(3)ofthisSectionrequiredtoundertakeacorrectiveactionprogrammayberequiredtoestablishandmaintainfinancialassuranceinaccordancewiththisSubchapter.
