INTRODUCTION TO

SUBDIVISION SERIES

The codes listed in this section are those most frequently used for subdivision and parcel map guarantees, preliminary condominium reports and preliminary subdivision reports. The subdivision and parcel map guarantee forms are set forth in the California Forms Manual.

This section also includes some write-ups used in preliminary reports issued for the Division of Real Estate. The preliminary report form is contained in the California Forms Manual.

SU 1 Tax Payment Required

___: The above mentioned taxes must be paid in full prior to recordation of said tentative map.

Comment: Item for subdivider’s preliminary report.

SU 2 Payment of Taxes -- Current Fiscal Year

Note No. : Both installments of taxes for this fiscal year and any prior years must be paid in full before the map can be recorded. Said taxes should be paid through this office instead of by mail, or the recording of the map may be delayed for verification by the tax collector that the payment was made.

SU 3 Tax Payment Required When Map Records After

September 30 and Before January 1

Note No. ___: If the map of the above tract is to be recorded after September 30 and prior to January 1, a tax bond will not be necessary, but both installments of taxes for the current fiscal year must be paid in full before the map can be recorded. Said taxes should be paid through this office instead of by mail, or the recording of the map may be delayed for verification by the tax collector that the payment was made.

SU 4 Tax Bond Required -- Amount To Be Determined

Note No. : If the map of the above tract is recorded after January 1st, and prior to November 1st a tax bond must be submitted to the Board of Supervisors of the county guaranteeing payment of taxes that are a lien against the land but are not yet payable.

You will be advised of the amount of said tax bond when the information is available.

SU 5 Amount of Tax Bond Required

Note No. : The tax bond in favor of the county guaranteeing payment of taxes referred to below should be in the amount hereinafter stated. The bond must be signed by the same parties signing the map of said tract (have corporate seal affixed if applicable), and all signatures must be acknowledged by a notary public.

SU 6 Record Title Changes Prior to Recordation of Tract Map

Subparagraph

: This report is based upon the record title at the date hereof. If the subject property is further conveyed or encumbered, the signatures of such interest holders will be required as parties necessary to execute the record map and approve or offer required dedications. When the map is ready for checking by the city and/or county, please forward an additional copy to this office.

Comment: This information is usually set forth in the preliminary report prepared for the subdivider.

SU 7 Signatures May Be Omitted

The signature of may be omitted from the recorded Map if its/their name(s) and the nature of its/their respective interest is endorsed on said Map under Section 66436 (c)(1) or (c)(3) of the Government Code.

SU 8 Requirement for Trustee or Beneficiary to Sign

: In the event the above Deed of Trust is not reconveyed prior to the recording of the final subdivision map of said land, the signature of either the trustee or beneficiary of said Deed of Trust must be set forth on the title page of said map in accordance with Section 66436 (a)(2) of the Government Code.

SU 9 Subdivision Within One Mile of State Highway

Note No. : In the event said property is within one mile on either side or both sides of any state highway, a copy of the tentative map of said property must be submitted to the district office of the Division of Highways of the State Department of Public Works. (Section 66455 Government Code).

SU 11 Condominium Plan -- As Built Certificate Letter

: The requirement that the Company be provided with a certificate from the civil engineer who signed the Condominium Plan, stating the improvements as constructed are in conformance with the units and air spaces defined and designated in the Condominium Plan prior to the issuance of any title insurance.

Comment: This certification is required in those instances when the Condominium Plan lacks a statement by the civil engineer that the units are constructed in conformance with the recorded plan.
