MINUTES

call to order

The meeting was called to order by Mr. Bass at 9:05 a.m.

ROLL CALL

Members present: Fred Bass, Todd Parker, Dr. Tim Schowalter, Bob Kunst and Dan Foster.

Other present: Kevin Wofford, LDAF, Harry Schexnayder, LDAF, Tyrone Dudley, LDAF, Lindsey Hunter, LDAF Counsel, Michael Vallen, Hearing Officer, Kristen Lemoine, LDAF.

AMENDMENTS TO THE AGENDA

APPROVAL OF THE MINUTES

Mr. Kunst asked to correct the minutes to reflect that the correct date of the LPMA Summer Convention to be held on July 8-10 in Biloxi.

Mr. Schexnayder suggested that the minutes be changed to reflect proposed rule changes related to treatment of hollow block in the minimum specifications section and the recommendation by LPMA.

Motion: Mr. Parker made a motion to approve the minutes with changes. This motion was seconded by Mr. Schowalter and passed unanimously.

Old Business

Mr. Wofford mentioned being short staff because of employees taking the early retirement, also because of budget cuts; the staff will be shorthanded for a few months.

LABELS FOR REVIEW

Altriset, Syngenta

Dr. Bob Cartwright presented the Altriset label changes.

Motion: Mr. Dan Foster made a motion to approve the label changes as requested by Syngenta. Mr. Kunst accepted an amendment to that motion, that for Louisiana, Syngenta include a technical sheet. This motion was seconded by Bob Kunst and passed unanimously.

Mr. Schexnayder mentioned that this product was originally a Dupont product that has now been bought by the Syngenta company. The Potpourri list of approved termiticides will need to be updated to reflect this change in manufacturer.

Polyguard, Termite Barrier

Mel Kyle presented the label and information for Polyguard, Termite Barrier which is a particle (rock) barrier. The company claims that the small particle size and shape of the rock prevents termites from being able to tunnel through it and gain entry into homes.

The committee made a recommendation that Polyguard should work with LSU and different pest control companies for field testing and collection of efficacy data. The committee approved the testing because it does not have to be approved by EPA. New contracts will have to be done. When the company can produce data to support their claims, the label can be resubmitted for approval at a later date.

Motion: None.

Red Eye Termite Monitoring Station

Keith Gross presented the monitoring system

This unit has to be used in conjunction with a full treatment. Separate contracts will have to be produced. The injection port in the Red Eye is for post treatment of termites and termite tunnels that have attacked the Red Eye.

Motion: Bob Kunst made a motion that without the port it can be used in Louisiana with separate monitoring contracts regulated under the rules and regulations. The port can be installed when the rules change. This motion was seconded by Mr. Parker but opposed by Dan Foster. The motion passed.

NEW BUSINESS

LPMA, Jeff Porter

Mr. Porter attended the Prostate Cancer Awareness night at LSU Box Stadium on April 21, 2015. He reminded everyone (males) to have your prostate checked annually.

April 22, 2015, in the House of Agriculture Committee, LPMA will be supporting three bills that LDAF is supporting.

  • HB 269: Authority for licensing and certification for people in the industry and revoking that authority.
  • HB 275: Adds Pre K facilities to the pesticide in school law.
  • HB 285: Authorizes permission to increase the fees for contracts for WDIR from $8 to a maximum of $16. Also, the bill proposes to eliminate the Research Committee body of the Structural Pest Control Commission but the keep the function for termite research funding and commission approval of the research.

The next LPMA Legislative Reception will be May 20, 2015 at the Pentagon Barracks from 5-7:30.

The LPMA Summer Convention is to be held on July 8-10 in Biloxi Mississippi at the IP The association hopes to have a good attendance and participation.

The Summer Institute is scheduled for July 20-August 4, Mondays & Tuesdays for pest control professional at LSU Entomology Department Lab.

Contract Review Committee Report, Bob Kunst

Mr. Schexnayder asked Mr. Kunst to provide the report for the Contract Review Committee.

The Contract Review Committee addressed the contracts from Bug Pro and Arrow Pest Control. They did not receive a recommendation from the committee and were asked to be sent back to companies to comply with the minimum state standards and the requirements that we have in the Rules and Regulations.

Mr. Kunst stated that the Standardize Repair Addendum section concerning arbitration changed. A new arbitration clause was put in place.

Motion: Mr. Kunst made a motion to accept the committee report as discussed, read and submitted. This motion was seconded by Dr. Schowalter and passed unanimously.

Mr. Bass called for a short break. Mr. Bass called the commission back to order. All were present.

Mr. Bass turned the meeting over to Mr. Vallen.

ADJUDICATORY HEARING

Mrs. Lindsey Hunter presented the cases.

Ronald Smith, Case No. 1819 – Mr. Smith stipulated to 3 violations of LRS 3:3226 A8 and 4 violations of LRS 3:3371 A1. Exhibit 1: Charge letter and green Card accepted by Mr. Vallen.

The department entered into a stipulation with Mr. Smith on $1000.00 per violation for a total of $7000.00. $3500.00 was suspended for a probation period of 1 yr. The remaining fine, $3500.00, will be paid in 10 month instalments of $350 starting 06/01/2015. During probation he cannot violate any portions of the Structural Pest Control Law, including failure to pay the fine in Case No. 1819. If the fine for Case No. 1819 is not paid within the allotted time period, the suspended portion will become due without further action by the department.

Motion: Mr. Schowalter made a motion to accept the recommended stipulation as read. This motion was seconded by Mr. Foster and passed unanimously.

James Chadwick Robinson, Case No. 1824 – continued by the department

Mr. Vallen turned the meeting over to Mr. Bass.
