State League Registration and Nomination Form
CONDITIONS OF PARTICIPATION
In consideration ofSoftball New South Wales ("SNSW") accepting my registration to participate in the 2016State League (“the Event”) and, if appropriate, my nomination to represent NSW in national competitionsI acknowledge and agree that:
1)“SNSW” for the purposes of this declaration means and includes Softball New South Wales Incorporated, its subsidiaries, its members (including Associations and Clubs), and their respective directors, officers, members, servants or agents.
2)This document can not be amended. If I do amend it my registration will be null and void and I will not be permitted to participate in the Event.
3)In participating in the Event I will be bound by the rules of the sport of softball, the SNSW Rules and Regulations and any policies of SNSW which exist from time to time. I can inspect each of these documents by viewing these on the SNSW website – or by contacting SNSW upon reasonable notice.
4)I acknowledge that once I sign this form I am bound to the nominated team for the duration of the 20…State League competition.(If two forms are received in the SNSW office the first dated and signed form will be accepted).
5)Warning: Competitive softball can be inherently dangerous. Serious accidents can and often do happen which may result in me being injured. I have voluntarily read and understood this Warning and accept and assume the inherent risks in competitive softball.
6)Exclusion of Liability: Except where provided or required by law and such cannot be excluded, I agree that it is a term of my participation that SNSW is absolved from all liability however arising from injury or damage however caused (whether fatal or otherwise) arising out of my participation in the Event.
7)Release and Indemnity: In consideration of SNSW accepting my registration I:
a)release and forever discharge SNSW from all Claims that I may have or may have had but for this release arising from or in connection with my participation in the Event; and
b)indemnify and hold harmless SNSW to the extent permitted by law in respect of any Claim by any person including but not only another participant in the Event arising as a result of or in connection with my participation in the Event.
In this clause “Claims” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising but does not include a claim in respect of any action, suit, etc made by any person entitled to make a claim under a relevant SNSW insurance policy or under the SNSW Rules and Regulations.
8)Fitness to Participate: I declare that I am and must continue to be medically and physically fit and able to participate in the Event. I am not and must not be a danger to myself or to the health and safety of others. I will immediately notify SNSW through my Team Management of any change to my fitness and ability to participate. I understand and accept that SNSW will continue to rely upon this declaration as evidence of my fitness and ability to participate.
9)Pregnancy: I acknowledge that the SNSW Regulations require me to notify my Team Management of the fact that I am pregnant immediately upon becoming aware of such circumstance, and I agree to comply with this requirement.
10)Damages:I understand that I am responsible financially for all damages that I cause to the NSW Softball Centre that are not game related. eg Smashed doors, damage to dugouts etc
11)State Teams/Squads Selection: By ticking the box below, I agree to nominate for selection to a 20….. NSW State Team. In so doing, I acknowledge that:
(a)I agree to abide by the terms and conditions of the Policy, SNSW Rules and Regulations;
(b)there may be some personal expense involved in attending the camps and competitions as outlined in the Policy;
(c)I specifically agree that in the case of any appeal I will follow the appeals procedure in the Policy and will not pursue any action in the civil courts in relation to selection; and
(d)by signing this form I warrant that I am eligible for selection and in particular that I am a current member of SNSW.
12)I warrant that all information provided by me in this form is true and correct.
13)SNSW has a Privacy policy and that the information that I have provided below is necessary for the Objects of SNSW. I acknowledge and agree that the information will only be used for the Objects of SNSW and to provide me with services associated with participation in the Event. I understand that I will be able to access my information through SNSW upon reasonable notice. If the information is not provided my registration may be rejected.
14)I have read, understood, acknowledge and agree to the above declaration including the warning, exclusion of liability, release and indemnity.
