CALL TO ORDER
Chairman Ricker called the meeting to order at 9:00 a.m.

REGULAR SESSION
APPROVAL OF APRIL 20, 2010 COMMISSION MEETING MINUTES
It was moved by Vice Chairman Roberts, and seconded by Commissioner McMahon that the minutes of the May 18, 2010 Commission meeting be approved as amended. Motion carried. Commissioner Betts did not vote due to his absence at the May 18, 2010 meeting.
REPORT OF THE STATE FIRE MARSHAL
Agency’s Activity for the month of May is as follows: investigations 64– (criminal 27- /accidental 30– undetermined 7-); arrests 3-: inspections 829– (health care 8-/deputy 225/day care 21/ - tech services –293 “QAP-282”); complaints-21; plan reviews 271-; PRUF revenue collected $121,260 year to date $1,482,797; total overtime hours worked 471.0-; time off in hours (Deputies) 131.0 (vacation 40.5- /compensatory leave 59.5- /sick leave 86.0- /holiday 142.5/holiday (floating) 15.0- /Section 25 Supplement 112.5/compassionate 15.0)
INFORMATIONAL ITEMS
Personnel Issues
John Reedy, Fire Protection Specialist II, has returned to work on June 7th and is working full duty.
Employee Years of Service Awards have been presented to Kelly Cykosky – 5 Years, Michael Moran – 15 Years, and William Goins – 20 Years.
James Bunkley was recognized for his 30 Years of State Service. The Commission presented him with a resolution and wishes him the best upon his retirement on June 30, 2010.

Fire Death Update
Fire Marshal Ingle reported on recent fire deaths. The total of fire deaths in 2010 has reached nine. Out of these nine fire deaths, only one had a working smoke alarm present. Fire Marshal Ingle has looked at the potential causes of these fire deaths. Some of these fires were caused by the misuse of an electrical cord, handicap or elderly individual’s home at the time of fire and were unable to escape without assistance, and accidental.
DFIRS Report 2009
Total State participation in compliance with the DFIRS reporting is at 79%. The following departments remain delinquent with their reports.

FIRE MARSHAL/FIRE SCHOOL
NFPA Fire Inspector I/DSFS – OSFM Plan Review Class
Fire Marshal Ingle reported that the Plan Review Class went very well and was an eye opener to the students that attended. Fire Marshal Ingle and Director Newnam agreed that it was a very good class and accepted well by the students. Six students attended the NFPA Fire Inspector I class.

Director
· Ambulance Inspections – January – May
Director Newnam stated that ambulance inspections are increasing and the Commission will be kept apprised of inspections taking place.
o 18 Fire Companies – 29 units, 6 Privates – 15 units, Total Inspections 44, with re-inspections total 66. This is an increase over the inspections in same time-frame 2009
· Planning and Evaluation Staff meeting will be held the week of June 21 – 25 at Dover Downs.
· Student Injuries were reported during the Haz. Mat. Response Skills class. Students as well as an Instructor were treated for heat related stress.
· Director Newnam presented Draft 5 of the proposed ambulance regulations for the Commission’s review.
· Director Newnam requested an Executive Session to discuss two applications for EMT-B that may require a hearing before the Commission in order for certification to be granted.
· Director Newnam discussed the bid for the Driver Training Simulator. It would include three units including a 48’ Trailer. The bid came in at $700,000.00.
· Director Newnam once again has to justify the commuting to and from home use of staff vehicles for Fire School employees to Fleet Management.
Staff Activities
· Mike Lowe and Steve Martin attended the NFPA Conference in Las Vegas.
· Mike Lowe assisted the Parksley Fire Company with their 75th Anniversary.
· Jim King attended a Federal Graded Nuclear exercise at DEMA.
· JoAnn DiDonato completed Rope Rescue I Course.
· Bill Baker attended a Safe Boating Dinner at DNREC.

Director Newnam reported that he will be taking annual Leave, June 17, July 2-3.
REPORT OF THE BLS MEDICAL DIRECTOR
Dr. Matthews gave a report on the status of the CPAP program.
Dr. Matthews gave the Commission an update on the BLS Protocol Review Committee and the proposed changes.
REPORT OF DEPUTY ATTORNEY GENERAL
Deputy Attorney General Reardon discussed House Bill 464 as submitted by the Commission to the Joint Sunset Committee. The bill was introduced with the “Conflict” and “Public Member” language.
It was moved by Vice Chairman Roberts, seconded by Commissioner Roberts to have a Title 16 Committee meeting on Thursday, June 17, 2010 with the DVFA to support House Bill 464 and allow members to accept modification to Section 6602(e). The Title 16 Committee will support House Bill 464 in its amended form. If a quorum of Commissioner’s is in attendance an official motion will be made at that time. Motion carried.
Deputy Attorney General Reardon announced that she will be leaving the Commission as our counsel and will be replaced by Elio Battista whom has worked with the Commission recently on several matters. The Commission expressed their gratitude for her commitment to many causes and the 200% that she gives to her work.

Roland Leathrum
The Commission recessed from its regular business to recognize Roland Leathrum for his commitment and hard work while serving on the Audit Committee for the Commission. Mr. Leathrum is moving out of state and is wished lots of luck and many blessings.
REPORT OF EXECUTIVE SPECIALIST
Sherry Lambertson, Executive Specialist to the Commission reported the following:
· Closed Complaints: 0905, 1005, and 1006.
· Correspond with the National Registry regarding EMT-B Certification.
· Continue updates for the First State Financials system. Security Forms have been submitted for Sherry, Chairman, and Vice Chairman.
· Execute and Process Risk Watch Contract. Waiting for response from A.I. DuPont Hospital for Children.
ACTION ITEM
Bowers Volunteer Fire Company/Magnolia Volunteer Fire Company Boundary Agreement
It was moved by Vice Chairman Roberts, seconded by Commissioner McMahon to accept the Bowers/Magnolia boundary agreement as presented to the Commission today. Motion carried.
It was moved by Commissioner Betts, seconded by Vice Chairman Roberts to go into Executive Session for the purpose of discussing an EMT applicant. Motion carried. The Commission entered Executive Session at 11:06 a.m.
EXECUTIVE SESSION
It was moved by Commissioner Murray, seconded by Commissioner McMahon to go out of Executive Session. Motion carried. The Commission exited the Executive Session at 11:46 a.m.

Authorize Hearing
It was moved by Commissioner McMahon, seconded by Commissioner Murray to authorize Sherry to set a hearing for EMT-B applicants if a request is received in writing by the applicants. Send a hearing notice that advices them of their rights. The hearing will be set for July. We must have a 20 day notice for the hearing. If they do not respond with enough notice, the hearing will be scheduled for August. Motion carried.
GENERAL INFORMATION
Title 16 Committee
The Title 16 Committee has a scheduled meeting for Thursday, June 17th at 7:00 p.m.. The Committee will keep the Commission apprised of the movement of legislation.
Standards Committee
Commissioner Sharp reported that the Standards Committee continues to meet and is progressing well. As they continue to meet in the future, each of these items from the fire service will be addressed.

MISCELLANEOUS INFORMATION
Definition of Scratch
A Commissioner was asked to define what a scratch is. A scratch is defined in statute and not by regulation. The Commission discussed bringing in all three county dispatch centers to determine exactly how they process a scratch.

Vice Chairman Roberts reported that he attended the Monthly Fire Prevention Commission Meeting, New Castle County Fire and Ambulance Advisory Committee Meeting, SFPC/DVFA Title 16 Committee Meeting, Meeting with Executive Director of Sunset Committee at Legislative Hall, Special SFPC Meeting, Memorial Service DVFA Monument, and Paramedic Graduation at New Castle County.

Commissioner McMahon reported that he attended the Monthly Fire Prevention Commission Meeting, New Castle County Fire Chief’s Meeting, Memorial Service for 2nd Vice President Frampton’s son, Graduation Ceremony for New Castle County Paramedics, Fire Open House at Troop 2, and FMO Jurisdictional Meeting at New Castle County Office.
