STANDARD CONDITIONS:

  1. The permittee shall comply with all the general conditions and prohibitive discharge standards as set forth in the City of Blackfoot sewer use ordinance.
  1. Access to the permittee facility shall not be denied to the City of Blackfoot or it’s representatives for the purpose of:
  2. Performing inspections as to pertaining to waste discharges;
  3. Communicating inspection information;
  4. Sampling the waste discharge for billing, compliance or monitoring purposes;
  5. Coping records.
  6. Taking pictures as needed to document processes as to pertaining to waste discharges.
  1. The permittee shall:
  1. Retain and preserve for three years all records, books, documents, memorandums, reports, correspondence relating to monitoring, sampling and chemical analyses;
  1. Retain and preserve all records pertaining to matters subject to enforcement or litigation.
  1. All analysis shall be required to follow chain of custody procedures. The user shall record the following information:
  2. The exact place, date, time, the person collecting and shipping the samples;

B.The dates the analysis were performed

C.The person performing the analysis;

D.The analytical techniques or methods used;

  1. The results of the analysis;
  2. The name and location of the lab performing the analysis.
  1. Samples and measurements taken to meet the requirements of the IWA shall be representative of the typical volume and nature of the facility discharge and shall be collected and preserved in accordance with 40 CFR part 136 and amendments. Alternative procedures must have City approval prior to use.
  1. The diversion or bypass of any discharge from any pretreatment facility is prohibited. Any diversion or bypass shall be reported immediately to the City of Blackfoot WPC, 2025 Riverton Road, Blackfoot, Idaho83221 or 208-785-8616.
  1. Any person who, knowingly makes any false statement on any report or other required document, renders any monitoring device or method inaccurate or otherwise violates provisions of the City sewer use ordinance, and EPA’s pretreatment regulatory requirements shall be liable to enforcement in accordance with the City of Blackfoot sewer use ordinance.
  1. The permittee shall make every attempt to assure the sample information reported is accurate and presented in a legible manner.
  1. Falsifying or withholding information may result in punishment and relief by the City of Blackfoot pursuant to criminal and civil law.
  1. Except for information deemed confidential under the City of Blackfoot sewer use ordinance, all reports required by this agreement shall be available for public inspection.
  1. The permittee is subject to fines, enforcement action, surcharges, and other costs resulting from their discharge in excess of those specified in this document, the City of Blackfoot sewer use ordinance, or other agreements.
  1. A minimum of Ninety-days (90) prior to the expiration of this permit, the user shall submit an application for a new permit by completing a wastewater discharge application or a new data disclosure form.

SPECIAL CONDITIONS AND COMPLIANCE SCHEDULE:

  1. Hazardous material or materials regulated by the Resource Conservation and Recovery Act (RCRA) shall be disposed of in accordance with that act.
  1. The permittee shall not reduce the concentration of regulated pollutants by dilution or attempt to substitute partial treatment for full treatment where treatment is required.
  1. The IWA and right to discharge may be revoked at any time after inspection, monitoring, sampling or other analysis determined that the permittee is in violation of any Federal, State or Local laws, including the City of Blackfoot Sewer Use Ordinance. The discharge of slug loads and/or accidental spills is also grounds for fines or revocation and termination of this permit.
  1. The permittee’s pretreatment facility, sampling, and monitoring devices must be properly operated, maintained, and maintenance records kept for at least three years.
  1. To prevent the accidental discharge of toxic pollutants into the City’s wastewater collection system, the permittee shall develop and submit to the City of Blackfoot within 60 days of the effective date listed on page 1, an Accidental Spill Prevention Program. EPA’s Region X’s Guidance Manual for the Development of an Accidental Spill Prevention Program should also be implemented as a guide in developing a Spill Prevention Plan. If an Accidental Spill Prevention Program has already been submitted to the City of Blackfoot, it must be updated and resubmitted when processes are changed.

PROHIBITED DISCHARGE STANDARDS

  1. GENERAL PROHIBITIONS: No user shall introduce or cause to be introduced into the POTW any pollutant or wastewater which causes pass through or interference. These general prohibitions apply to all users of the POTW whether or not they are subject to categorical pretreatment standards or any other National, State, or local pretreatment standards or requirements.
  1. Specific Prohibitions: No permittee shall introduce or cause to be introduced into the POTW the following pollutants, substances, or wastewater:
  1. Pollutants which create a fire or explosive hazard in the POTW, including, but not limited to, waste streams with a closed-cup flash point of less than 140F (60C) using the test methods specified in 40 CFR §261.21;
  1. Wastewater having a pH less than 5.0 or more than 11.0, or otherwise causing corrosive structural damage to the POTW or equipment;
  1. Solid or viscous substances in amounts which will cause obstruction of the flow in the POTW resulting in interference, but in no case solids greater than two inches (¾”) in dimension.
  1. Pollutants, including oxygen-demanding pollutants (BOD, etc.), released in a discharge at a flow rate and/or pollutant concentration which, either singly or by interaction with other pollutants, will cause interference with the POTW;
  1. Wastewater having a temperature which will inhibit biological activity in the treatment plant resulting in interference, but in no case wastewater which causes the temperature at the introduction into the treatment plant to exceed 104F (40C) unless the Approval Authority, upon the request of the POTW, approves alternate temperature limits;
  1. Petroleum oil, non-biodegradable cutting oil, or products of mineral oil origin, in amounts that will cause interference or pass through;
  1. Pollutants which result in the presence of toxic gases, vapors, or fumes within the POTW in a quantity that may cause acute worker health and safety problems;
  1. Trucked or hauled pollutants, except at discharge points designated by the City.
  1. Noxious or malodorous liquids, gases, solids, or other wastewater which, either singly or by interaction with other wastes, are sufficient to create a public nuisance or a hazard to life or health, or to prevent entry into the sewers for maintenance or repair;
  1. Wastewater which imparts color which cannot be removed by the treatment process, such as, but not limited to, dye wastes and vegetable tanning solutions, which consequently imparts color to the treatment plant's effluent, thereby violating the City’s NPDES permit. Color (in combination with turbidity) shall not cause the treatment plant effluent to reduce the depth of the compensation point for photosynthetic activity by more than ten percent (10%) from the seasonably established norm for aquatic life;
  1. Wastewater containing any radioactive wastes or isotopes except as specifically approved by the Superintendent in compliance with applicable State or Federal regulations;
  1. Storm water, surface water, ground water, artesian well water, roof runoff, subsurface drainage, swimming pool drainage, condensate, de-ionized water, non-contact cooling water, and unpolluted wastewater, unless specifically authorized by the Superintendent;
  1. Any sludge, screenings, or other residue from the pretreatment of industrial wastes or from industrial processes;
  1. Medical wastes, except as specifically authorized by the City;
  1. Wastewater causing, alone or in conjunction with other sources, the treatment plant's effluent to fail a toxicity test;
  1. Detergents, surface-active agents, or other substances which may cause excessive foaming in the POTW;
  1. Any liquid, solids, or gases which by reason of their nature or quantity are or may be sufficient, either alone or by interaction with other substances, to cause fire or explosion or be injurious in any other way to the POTW or to the operation of the POTW. At no time shall two (2) successive readings on an explosion meter, at the point of discharge into the system (or at any point in the system), be more than five (5%) percent nor any single reading over ten (10%) percent of the lower explosive limit (LEL) of the meter.
  1. Grease, animal guts or tissues, paunch manure, bones, hair, hides or fleshings, entrails, whole blood, feathers, ashes, cinders, sand, spent lime, stone or marble dusts, metal, glass, straw, shavings, grass clippings, rags, spent grains, spent hops, waste paper, wood, plastics, gas, tar asphalt residues, residues from refining or processing of fuel or lubricating oil, mud, or glass grinding or polishing wastes.
  1. Any substance which will cause the POTW to violate its NPDES and/or other disposal system permits.
  1. Any wastewater, which in the opinion of the Superintendent can cause harm either to the sewers, sewage treatment process, or equipment; have an adverse effect on the receiving stream; or can otherwise endanger life, limb, public property, or constitute a nuisance, unless allowed under special agreement by the City (except that no special waiver shall be given from categorical pretreatment standards).
  1. The contents of any tank or other vessel owned or used by any person in the business of collecting or pumping sewage, effluent, septic tank waste, or other wastewater unless said person has first obtained testing and approval as may be generally required by the City and paid all fees assessed for the privilege of said discharge.
  1. Any hazardous wastes as defined in rules published by the State of Idaho or in Federal Regulations 40 CFR Part 261.
  1. Persistent pesticides and/or pesticides regulated by the Federal Insecticide Fungicide Rodenticide Act (FIFRA)

Pollutants, substances, or wastewater prohibited by this section shall not be processed or stored in such a manner that they could be discharged to the POTW.
