ORDINANCE OF THE MARIN COUNTYBOARD OF SUPERVISORS
PROHIBITING U-TURNS AT ELISEO DRIVE AND VIA LA CUMBRE INTERSECTION, GREENBRAE
THE BOARD OF SUPERVISORS OF THE COUNTY OF MARIN does hereby ordain as follows:
SECTION I.Pursuant to Section 22113 of the California Vehicle Code, local authorities may prohibit turn movements at intersections or between any designated intersections. Motorists from westbound Sir Francis Drake Boulevard often turn onto Eliseo Drive and then making U-turns at the Eliseo Drive/ Via La Cumbre intersection to avoid queues at the Eliseo Drive/Sir Francis Drake intersection. This bypass traffic impacts the neighborhood along Eliseo Drive and in the vicinity of the Eliseo Drive/Via La Cumbre intersection. Traffic operations at the Sir Francis Drake Boulevard/Eliseo Drive intersection are also impacted since the bypass traffic re-enters Sir Francis Drake Boulevard westbound or drives across the intersection to access the Bon Air Shopping Center. It is therefore in the interest of public safety that U-turns be prohibitedas set forth in Section II.
SECTION II.It is hereby determined and declared that U-turns be prohibitedat the northbound approach of the Eliseo Drive and Via La Cumbre intersection.
SECTION III.EFFECTIVE DATE, PUBLICATION, AND SEVERABILITY
The Board of Supervisors of the County of Marin does hereby further ordain the following:
1.Effective Date and Publication. This ordinance shall be, and is hereby declared to be, in full force and effect when appropriate signs giving notice thereof are erected upon the street, and the ordinance shall be published once before the expiration of fifteen days after its passage, with the names of the Supervisors voting for and against same, in the Marin Independent Journal,a newspaper of general circulation, published in the County of Marin.
2.Severability. If any term, provision, or portion of this ordinance is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining portions of this ordinance shall continue in full force and effect unless amended or modified by the County.
