Special Called Council Meeting – August 11, 2011

Mayor Thomas L. Hardesty called the special called council meeting to order at 6:30 p.m. with the following council members present: Alan Matthews,Donna Eaton, Shane Suttor, Frank Page, and Jon Swindler. Absent: Mike Zoeller.

City Employees Present:Wendy Rutledge and Robert Schutte

City Attorney: Frank Chuppe

Councilmember Eaton gave the invocation.

All present pledged allegiance to the flag.

Minutes/ Regular Meeting July 21, 2011

Councilmember Matthews moved to approve the minutes of the regular meeting on July 21, 2011 as read by council members prior to the meeting. Seconded by Councilmember Page.

All voted “aye” and motion carried.

Appointment – Mayor Hardesty recommended Jim Cleveland be appointed to the Historic District Commission to complete the unexpired term of Valorie Hundley. The term will expire June 30, 2012.

Councilmember Swindler moved to approve the appointment. Seconded by Councilmember Eaton.

All voted “aye” and motion carried.

Ordinance – An Ordinance of the City of Shelbyville Levying Annual Assessment for the Clear Creek Subdivision Public Improvement Bonds – 1st Reading – Frank Chuppe

Frank Chuppe, City Attorney, read an ordinance of the City of Shelbyville levying the annual assessment for the Clear Creek Subdivision Public Improvement Bonds. The amount per lot for 2012 is $2,069.42.

It was introduced for first reading by Councilmember Suttor. Seconded by Councilmember Matthews.

Municipal Order No. 2011-08-11 – Making a Portion of Fourth Street a One Way Street

Upon the recommendation of Mayor Hardesty and Jennifer Herrell, City Engineer/Superintendent of Public Works, it is hereby ordered that a portion of Fourth Street shall be changed to a one way street with traffic flowing in a southerly direction.

Councilmember Matthews moved to approve the Municipal Order. Seconded by Councilmember Page.

All voted “aye” and motion carried.

Resolution – Charlie Frazee presented the KIPDA Regional Hazard Mitigation Plan to the council for adoption. The Mitigation Plan needs to be updated every 5 years. If not updated and there was a disaster, the city would not be reimbursed money spent on clean-up.

Councilmember Suttor made the motion to pass. Seconded by Councilmember Swindler.

All voted “aye” and motion carried.

Request Zone Change - 73 acres at Harrington Mill Road

Mayor Hardesty recommended to council that 73 acres at Harrington Mill Road and Freedom’s Way be changed from Ag to I-1. This property backs up to the Industrial Park and has excellent railroad frontage.

Councilmember Matthews moved to allow Mayor Hardesty to send a letter to Triple S Planning and Zoning to start the zoning change process. Seconded by Councilmember Suttor.

All voted “aye” and motion carried.

Department Reports

Robert Schutte, Police Chief, reported that the Horse Show ran smoothly. There were no issues reported. He also reported they had ground breaking for the new police garage.

Mayor’s Report

Mayor Hardesty reported he and Jennifer Herrell are preparing a “Safe Route to School” grant on behalf of the Shelby County School Board.

Mayor Hardesty thanked all city employees who volunteered at the Horse Show and helped to make it a success.

The county is in the process of revising the district map.

Jail Hill Bridge will be closed the week of August 15-19 to vehicles. It will eventually be open for pedestrian and bike traffic.

At 6:55p.m. Councilmember Page moved to go into closed session for the discussion of a personnel issue and possible acquisition of property. Seconded by Councilmember Swindler.

NO ACTION TAKEN

At 7:55 p.m. Councilmember Matthews moved to end the closed session. Seconded by Councilmember Page.
