MINUTES

Members Present:Mayor Pro-Tem Saralyn Price, Aldermen: Janet Banks, Phillip Wight, and Mike Eveland

Staff Present: Manager Nathan Clark, Attorney Craig Justus, Public Works Director Mike Mehaffey, Chief Scott Sutton and Town Clerk Vickie Best

Meeting Called to Order

Mayor Pro-Tem Price called the meeting to order at 5:30 p.m. on Tuesday August 18, 2015 in the Town Hall Boardroom.

Acquisition of Real Property

A donation of $75,000 is in escrow at Attorney Gavin Brown’s office to be used in the event the Town can purchase the property located at 4521 Soco Road (Portion of PIN# 7676-88-8849). The property abuts Jonathan Creek and consists of 1.3 acres. The donation comes from the new property owners located across Jonathan Creek from the property in question. They wish to see parkland there rather than a vacant grown up lot—or worse.

A few items in the agreement if the purchase is approved and the donation is accepted by the town:

  • The land formerly known as the BBQ Shack will be used as parkland.
  • The property shall remain parkland as long as the Donors or their primary heirs (children only) retain ownership of 69 Natures Way.
  • If large structures are built, such as a bathroom pavilion and /or playground, that it be built on the western half of the property.
  • At a minimum, the Town plans to offer this space as maintained open space by providing regular yard maintenance.

It is the Town’s intent to transform this parcel into a park similar to Parham Park. The purpose of said acquisition is to transform the property into a passive park.

The Town will seek the donors input as the park moves forward.

After four counter offers, the Franklin Family will accept $150,000 ($75,000 Donation & $75,000 Town Funds). The Franklin Family asked that they have naming rights for the park.

The Town will have right of refusal in the unlikely event that the name does not reflect the Town’s goal.

A survey and title search will be conducted and the closing on the property will take place within 30-days.

The Town’s portion of the cost will come from the General Fund.

ALDERMAN BANKS MADE A MOTION TO AUTHORIZE MANAGER CLARK TO MOVE FORWARD IN PURCHASING THE PROPERTY. MOTION CARRIED UNANIMOUSLY.

Closed Session

ALDERMAN WIGHT MADE A MOTION TO ENTER CLOSED SESSION AT 5:43 P.M. FOR THE PURPOSE OF DISCUSSING ATTORNEY-CLIENT PRIVILEGE G.S. 143-3188.11 (A) (3).

ALDERMAN BANKS MADE A MOTION TO COME OUT OF CLOSED SESSION AT 6:08 P.M. MOTION CARRIED UNANIMOUSLY.

ALDERMAN EVELAND MADE A MOTION TO ADJOURN AT 6:09 P.M. MOTION CARRIED UNANIMOUSLY.
