We agree to abide by the exhibitor rules and regulations herein described for the Better Business Bureau Senior Celebration & Consumer Expo all of the terms of which are made part thereof by this reference incorporated herein, receipt of which is hereby acknowledged. I understand that booth space may not be sublet and there are no other, either oral or written, agreements between myself, and the Better Business Bureau.

We hereby agree to pay the BBB Consumer Education Foundation a 50% deposit for the use of said booth(s) space(s), with the balance due before October 1, 2010. We hereby agree that if the balance due is not paid in full by October 1, 2010 we forfeit both the deposit and booth space. If reservation is submitted after September 13, 2010, the contract must be accompanied by payment in full.

The Better Business Bureau of Southeast Texas agrees to furnish the following:

1 – 8’ back drapes 2 – 3’ side drapes 1 – Standard 120 electrical outlet (if requested)

Rules and Regulations

Who May Exhibit

The agreement must have a complete description of products/services to be exhibited. Only one business may be represented in any one booth. The BBB reserves the right to decline any request for a booth if in its judgment the products or services to be shown or demonstrated are detrimental to the theme of the Senior Celebration & Consumer Expo.

Space Assignment

Exhibit space is assigned based upon the following: date of receipt of application, contract and deposit and/or any other factors where applicable. The BBB reserves the right to arrange the booth floor plan in the best interest of the show. Exhibitors requesting additional space after initial application, will be assigned space on a date received and space available basis. The BBB has the right to limit the number of multiple booths. Exhibitors will be responsible for set up and removal of their own booth(s).

Deposits

A deposit check for 50% of the booth cost must accompany each application. All show space must be paid in full no later than October 1, 2010; otherwise, exhibitor forfeits both deposit and booth space. All applications received after September 13, 2010 must be accompanied by full payment.

Cancellations and Refunds

In the event of cancellation by the exhibitor prior to September 10, 2010, deposits are refundable. Balance less deposit is refundable if canceled on or after September 10, 2010. All cancellations must be in writing.

Insurance

Exhibitors shall carry their own insurance to cover exhibit material against damage and loss; and public liability insurance against injury to the person and property of others. The BBB shall not be obligated to carry any insurance for the benefit of exhibitors.

Show Hours

Show hours are from 8:30 A.M. – 2:30 P.M., Thursday, October 14, 2010.

Set Up and Dismantling Exhibits

Exhibitors may set up from 2:00 P.M. – 6:00 P.M., Wednesday, October 13, 2010 or from 7:00 A.M. – 8:00 A.M. Thursday, October 14, 2010. Security will be provided during the night of October 13. No one will be allowed to move in prior to 2:00 P.M. October 13, since electrical lines are being set up during that time. Exhibitors will have from 2:30 P.M. – 6:00 P.M. Thursday, October 14 to dismantle and remove exhibits.

General

These Rules and Regulations are to be construed as part of the agreement between the exhibitor and the BBB. The BBB reserves the right to interpret all matters and questions not covered by these Rules and Regulations. These Rules and Regulations may be amended at any time by the BBB and all amendments shall be equally binding on the original Rules and Regulations. Written notice will be given by the BBB to those exhibitors affected.

Booth Height and Structure Restrictions

A 12’ booth height restriction exits. However, approval can be obtained from the BBB to have a 15’ maximum height, freestanding structure. Request must be made no later than six weeks prior to the show. Booth structure must be freestanding, i.e.: should not be attached or suspended from the venue ceiling, the sides of any other booth, or to the booth structure. This restriction applies to your booth structure itself, the decorations therein, and/or any signage above your booth. Consideration shall be given to the visible appearance of your booth from all sides, as well as the safety of the booth structure.

Booths Must Be Manned At All Times During The Show

Products can be sold during the show providing they are not large and cumbersome items that would disturb traffic flow for other exhibitors. No food or beverage items can be sold from exhibitor’s booth space. Only small wrapped candies and cookies may be distributed free of charge. No other food or drinks may be given away.

Absolutely no early shut down-all booths must remain open until 2:30 P.M. Once the general public has left the building, exhibitors may dismantle their booth(s).

Non-Liability

It is expressly understood and agreed by each exhibitor, his agents and his guests that neither the BBB, nor its employees nor its contractors shall be liable for loss or damage to the goods or properties of exhibitors. At all times, such goods and properties remain the sole possession and custody of the exhibitor. On signing the Booth Reservation Form, exhibitor releases and agrees to indemnify the BBB, its managers, officers, members, sponsors, employees and agents, and save them harmless from any suit or claim for property damage or personal injury by whomsoever sustained, including exhibitor and its agents or employees, on or about the exhibitor’s participation in the exposition, including such damage or injury resulting in part from the negligence of one or more of the aforementioned indemnities. In the event it becomes necessary for the BBB to employ an attorney at law to enforce any of the provision of this Agreement, the Exhibitor agrees to pay a reasonable attorney’s fee and all court costs.
