SELLER’S PET CONTRACT, SHOW QUALITY DOG
THIS AGREEMENT, made and entered into this ______day of ______, 20____, between the following prospective buyer(s) (hereinafter “BUYER”), andDeborah Phillips 124 Coot Davis Road, Jacksonville, NC 28540 (hereinafter “seller”), relates to the following dog, and under the following terms and conditions. Buyer agrees the Dog in this contract is being purchased as an AKC limited pet registration. Registration will transfer to full registration after the dog passes OFA hip and elbow certifications at 24 months old.
The subject Dog is, to the best of the Seller’s, knowledge potentially a show quality puppy. The Seller cannot guarantee the dog will be show quality until the age of 2 (two) years. The Buyer is purchasing a pet puppy, with show quality potential.

(F) Title and ownership of the dog and limited registration papers for said Dog shall not be given and shall not accrue to Buyer until all payments have been made in full and Buyer has complied with all the terms and conditions of this agreement.
(G) NAME : The BUYER may choose any “CALL NAME” that he chooses; but the registered AKC, first name must start with the Litter Letter exactly as Von Philhaus Rottweilers has specified.
(H) KENNEL NAME: The said dog must carry the Von Philhaus kennel name.
The name on the litter contract must be the same as on this contract and cannot be changed except by Von Philhaus Rottweilers. AKC requires the dog name to match the litter paperwork held by the breeder for audits.
4. SHIPPING
(A) Shipping “said dog” in the USA (except Hawaii) fees are as follows: Plane fare, Crate, Health Certificate is to be paid by the BUYER. Air fare, crate, and health certificate is subject to change at any time due to store costs, veterinarian increases, and fuel costs.
(1) Hawaii has quarantine and extra vaccinations, tests, and fees required, are paid by the BUYER.
5. REPRESENTATIONS AND WARRANTIES
(A) Puppy must be micro chipped for all warranties by a veterinarian or the breeder only. The BUYER must provide the SELLER the microchip number for the AKC records.
(1) Seller represents that as of the date of this agreement, the subject Dog is, to the best of the
Seller’s knowledge is healthy and free of communicable diseases.
(2) If Buyer is picking up puppy, Buyer shall have seventy two (72) hours, from the date of this contract, in which to have the dog examined by a veterinarian. If the said dog has a communicable disease, the Seller offers to pay up to 100.00 of the veterinary bill. If the said dog has Parvovirus at the time of examination and within seventy two (72) hours of contract, the Buyer can return the puppy and get a full refund.
(3) When Buyer agrees when the puppy is shipped though an airlines, the veterinarian health certificate releases the Seller from any liability other than genetic hereditary issues.
(B) The subject Dog is best to Seller’s knowledge free of hereditary diseases. Seller offers a hereditary warranty to only hereditary diseases that are listed on the OFA website relating to the Rottweiler. We warranty OFA hips until 6 months of age. The puppy must be x-rayed by a licensed experienced veterinarian with the AKC number and microchip embedded in the x-ray photo for proof. The warranty for cardiac (SAS) disease, eye disease, and thyroid is until 12 months old. If the dog is not tested by 12 months of age, the warranty is void. OFA accepts cardiac, eye, and thyroid at 12 months old. Read section 7(e) and 7(f).
(1) If the dog has any diseases noted in section 5B by the age of 1 year, the seller requests a written letter of the type of disease from the licensed veterinarian, and a copy of the veterinarian’s evaluation and bill. Upon verification by microchip that the dog was checked or tested by a licensed veterinarian, and did FAIL the OFA certifications guidelines, Buyer shall keep the dog purchased and is offered another puppy of the same sex at half price. No money is refunded in whole or part.

6.BUYER’S RESPONSIBILITIES
(A) The Dog shall be spayed / neutered at the Buyer’s expense, at the age of twenty four (24) months. Upon the event of any breeding of Dog before spaying/neutering,Seller shall be entitled to the sum of $1000.00 within (30) thirty days of the birth of the puppies. Seller will not remove the limited registration to full registration. Read section 7(e).
(B)If Buyer is unable or unwilling to keep the Dog forany reason, Buyer shall notify Seller, and the Dog shall be returned to seller if the dog cannot be re-homed. If the dog is re-homed the buyer must send written notice of the new owners name, address, phone, and vet information. The Dog shall never be given to any SPCA, Shelter, Dog pound, or animal shelter of any kind.
7.RECOMMENDATIONS FOR CARE AND TREATMENT OF DOG
Buyer agrees to keep the Dog in good health and proper weight and fitness, and to provide annual veterinary examinations, current vaccinations, teeth cleaning, and worming, proper feeding and housing, controlling the Dog’s lead when off the premises and to avoid loss by theft, running away or otherwise, and to give prompt attention to the physical welfare of the Dog.
(a) When outside, the Dog shall not be kept on a chain, cable or tie out, but shall be kept in a kennel.
(b) Spike or pinch collars shall be used properly, Dog should receive obedience training by a certified trainer, socialized regularly, nails trimmed short, heartworm test and heartworm preventative, flea and tick preventative, and clean water.
(c) Dog will receive all vaccines, included but not limited to; Distemper, Measles, Hepatitis, Letpospirosis, Parainfluenza, Bordetella, Canine Provovirus, Rabies, and Coronavirus when due. If required in the State or County. Do not over vaccinate. Each State and County is different.
(d) Dog should be fed premium Dog food such as “Victor Grain Free” or equivalent food, but to keep our warranty we require the “said dog” to be fed a Model Raw Prey diet / raw natural diet. Supplements are not the same. NO EXCEPTIONS.
(e) If said dog is spayed before the age of twenty four (24) months, health warranties are void. Spay / neutering a dog early can cause hormone deficiencies and improper growth.
Note: Research has proven that 75% of animal diseases and improper bone growth can be attributed to dietary deficiencies; a good diet must provide a correct balance of protein, calcium, fats, vitamins, trace minerals, carbohydrates.
(f) Note: All Hip and elbow dysplasia is not hereditary. Hip prelim check is valid a 6 months of age. Hips and elbows can become bad from environmental issues such as food or damage. Slipping, falling, far jumps, and stairs will damage a hip and elbow. If your dog passes prelim at 6 months of age your dog will have good hips and elbows, providing you watch and feed your dog properly.

8.BREACH – TERMINATION
This Agreement is limited to the Seller and Buyer and shall not be transferable to another party, except in the case of death of either Seller or Buyer. In such event, their respective heirs, executors or administrators may succeed their interests.
If dog is returned, and the Dog is deathly sick, neglected, emaciated, showing signs of severe dog fight, large wounds, or anything my veterinarian would consider neglect, because of the failure of the Buyer to take care of the Dog, we will NOT returned the dog. The Dog will become re-homed.
