3Details of any defaults, judgements, petitions, prosecutions or other adverse credit incidents against the proposer, its Directors/Principals and/or associated businesses.

4Copies of Head - and Sub-Leases if appropriate and available.

Declaration

I/We the undersigned hereby apply for an advance from ("the Lender") upon mortgage of the property referred to in this Application. I/We declare that the information given in this application is true and complete and shall form the basis of any advance which may be made by the Lender. I/We undertake to be responsible for all surveyors’ fees and legal fees, costs and disbursements incurred by or on behalf of the Lender in connection with the Application whether or not it proceeds.

I/We agree that:

1No statement, warranty, representation or omission made or implied by persons being or purporting to be the Lender's agent, nor the payment of any Survey. Arrangement or other Fees or any part thereof shall in any way bind the Lender to grant an Advance. The Lender may decline this proposal in its sole discretion and without giving its reasons for doing so.

2I/We declare that:

(a)the proposer (if a corporation) has not at any time presented or had presented against it a winding-up petition or a petition for an administration order nor has a receiver at any time been appointed over the whole or any part of its assets;

(b)none of the directors of the proposer (if a corporation) or none of the partners in the proposer (if a partnership) or none of the proposers (individuals) has at any time committed any act of bankruptcy or had a receiving order or a bankruptcy order made against ‘him/her’ or been convicted of any criminal offence (other than minor-traffic offences).

3The report and valuation to be prepared by the Lender's surveyors are for the confidential information of the Directors and Officers of the Lender in fixing the amount (if any) to be advanced.

4The Lender may make such status inquiries as it deems necessary.
