Dear Mr Starky

I am writing to reply to your request for information which the Trust received by email on 18.9.08.

The Trust has dealt with your request as a formal request for information under the Freedom of Information Act 2000.

The answers to your questions are enclosed.

Can you tell me if a company by the name of "The Campaign Company"

registration number 04275708 has undertaken any work for your

organisation since 23/08/2001?

Yes

If so, what was the nature of the work undertaken, was the work

satisfactory or met its targets and what was the total cost for the

undertaking of this work?

Two recruitment drives, five candidate induction workshops and one board development session. Total cost to date is £27,364.

If said company has undertaken more than one piece of work with

your organisation can you give information for each case

individually?

As above. Whether the work was satisfactory is a matter between the Trust and the company concerned and subject to an exemption under part 2 of the Act – section 43 commercial interests. (see notes below)

Yours faithfully

David Tomney

Notes:

Commercial Interests

The Trust is claiming an exemption under the Freedom of Information Act 2000 for some of the information requested.

While we supply you with information about the nature of the work undertaken for the Trust as a public body we are unable to supply you with any kind of satisfaction rating for the work provided as that is commercially sensitive information.

For this information the Trust claims an exemption under Part II (Section 43 Commercial Interests) of the Freedom of Information Act 2000.

In relation to this prejudice based exemption, as required, the Trust has applied the Public Interest Test and has found that the public interest in withholding the information is greater than the public interest in disclosing information on the grounds:

Disclosure would/could:

  • Prejudice the economic and commercial interest of Kettering General Hospital NHS Trust which might otherwise prevail
  • Damage or prejudice ongoing relations between Kettering General Hospital NHS Trust and third parties
  • Prejudice the position of Kettering General Hospital NHS Trust in maintaining its competitiveness as a Public Authority and as a Business Partner.

This completes the Trust response to your request, but please note:

If you are not satisfied with the Trust's response you may ask for an independent internal review by writing to the Freedom of Information Act Complaints lead at Kettering General Hospital, Rothwell Road, Kettering, Northants, NN16 8UZ.

If you remain dissatisfied after this internal review of the Trust's decision you may wish to make an approach to the Information Commissioner.

Please note that the Information Commissioner is a regulator, not an ombudsman. He will make an assessment as to whether or not the provisions of the Freedom of Information Act 2000 have been complied with. He can issue an enforcement notice to the Trust ordering it to comply with your request.
