Road Safety (Vehicles) (Fees Amendment) Regulations 2007

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (Vehicles) Regulations 1999—

(a)to maintain the existing fees for heavy vehicle registration for a further 2 months;

(b)to increase certain fees by 25%;

(c)to amend the definition of hybrid vehicle and provide for a reduction in registration fees for hybrid vehicles;

(d)to convert vehicle registration fees to fee units.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Commencement

r. 3

(1)These Regulations, except regulations 6, 8, 9, 11 and 12 come into operation on the day on which these Regulations are made.

(2)Regulations 6, 8, 9, 11 and 12 come into operation on 1 July 2007.

4Principal Regulations

In these Regulations, theRoad Safety (Vehicles) Regulations 1999[1] are called the Principal Regulations.

5Definitions

In regulation 105(1) of the Principal Regulations, in the definition of hybrid vehiclefor "petrol and electricity" substitute"electricity and one or more other fuel type or types".

6Fees for registration and renewal of registration of heavy vehicles

In regulation 235(1) of the Principal Regulations, for "1 July 2007"substitute "1 September 2007".

7Registration fee reduction for hybrid vehicles

After regulation 236(1) of the Principal Regulations insert—

"(1A)The fee payable for registration or renewal of registration of a hybrid vehicle for a period of 12 months is—

(a)nil, if the fee determined in accordance with subregulation (1) would be $50 or less; or

(b)the fee determined in accordance with subregulation (1) less $50, in any other case.

Note

A hybrid vehicle is a vehicle equipped to run on electricity and one or more other fuel type or types—see regulation 105.".

8Fees for transfer of registration

In regulation 237(1)(b) of the Principal Regulations,for "$5.20"substitute "$5.30".

9Search and extract fees

(1)In regulation 238(2)(a) of the Principal Regulations for "or a motor car trader" substitute ", a motor car trader, the relevant corporation within the meaning of the Melbourne City Link Act 1995 or the Freeway Corporation within the meaning of the EastLink Project Act 2004".

(2) In Schedule 5 to the Principal Regulations—

(a)in items 1 and 2, for "$7.50"substitute"$7.60";

(b)in item 3, for "$14.20"substitute"$14.50";

(c)in items 4 and 5(i), for "$7.50"substitute"$7.60";

(d)in item 5(ii), for "$14.20"substitute"$14.50".

10Refund of fees

After regulation 239(2) of the Principal Regulations insert—

"(2A)If the registration or renewal of registration of a hybrid vehicle takes effect on or after 1May 2007, the Corporation must refund the difference (if any) between the fee paid for the registration or renewal of registration and the fee determined in accordance with regulation 236(1A).".

11Fees for registration and renewal of registration

In Schedule 4 to the Principal Regulations––

(a)in clause (3)(b) for "$168.60" substitute"1568 fee units";

(b)in item 2(b) of the Table for "$7.20" substitute"$7.30".

12Miscellaneous fees
