DEVELOPMENT PROPOSED: / Retention of unauthorised change of use to growing/storage of Christmas Trees for sale in winter and storage and distribution of palm trees during the summer. Retention of unauthorised polytunnel 9.14m long, 4.26m wide and 2.28m high.

Ribble Valley Borough Council hereby give notice that permission has been granted for the carrying out of the above development in accordance with the application plans and documents submitted subject to the following condition(s):
1. / Unless explicitly required by condition within this consent, the development hereby permitted shall be carried out in complete accordance with the proposals as detailed on drawings:
Proposed Site Plan and Elevations: 5497-P02
Tracking System Plan: 5497-P03
Proposed Site Usage Plan: 5497-P04A
Proposed Entrance Plan: 5497-P05
Reason: For the avoidance of doubt since and to clarify which plans are relevant to the consent.

2. / Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended or re-enacted) and the Town and Country Planning (General Permitted Development)(England) Order 2015 (as amended or re-enacted) and the Town and Country Planning (General Permitted Development) (England) (Amendment) Order 2016 (as amended or re-enacted) the use of the land shall be in strict accordance with approved site usage plan (5497-P04A) and shall be restricted to the growing /storage of Christmas Trees and distribution of Palm Trees (Sui Generis) and for no other purpose.
Reason: For the avoidance of doubt and to ensure that the development remains compatible with the character of the area in accordance with Policies DMG1 and DMG3 of the Ribble Valley Core Strategy.
3. / No loading/unloading shall be undertaken on the highway in association with the use(s) hereby approved.
Reason: To ensure the proposed use and associated operations do not compromise the safe operation of the highway network or pose risk or cause hazard to other highway/road users in accordance with Policy DMG3 of the Ribble Valley Core Strategy.
4. / Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 there shall not at any time in connection with the development hereby permitted be erected or planted or allowed to remain upon the land hereinafter defined any building, wall, fence, hedge, tree, shrub or other device over 1m above road level.
For the avoidance of doubt the visibility splay(s) to be the subject of this condition shall be those as indicated on approved drawing 5497-P02.
Reason: To ensure adequate visibility at the street junction or site access in accordance with Policy DMG3 of the Ribble Valley Core Strategy.
5. / The proposed access from the site to Clitheroe Road shall be constructed to a (minimum) width of 4.5 m and this width shall be maintained for a minimum distance of 4m measured back from the nearside edge of the carriageway.
Reason: To enable vehicles to enter and leave the premises in a safe manner without causing a hazard to other road users in accordance with Policy DMG3 of the Ribble Valley Core Strategy.
6. / No further deliveries to/from the site shall be received/undertaken until the access, turning area and gate details (5497-P02, 5497-P03 and 5497-P05) hereby approved have been laid out, completed and made available for use. The approved details shall be retained thereafter unless otherwise agreed in writing by the Local Planning Authority.
Reason: Vehicles reversing to and from the highway are a hazard to other road users in accordance with Policy DMG3 of the Ribble Valley Core Strategy.

7. / Before the access is used for vehicular or delivery purposes, that part of the access extending from the highway boundary for a minimum distance of 5m into the site shall be appropriately paved in tarmacadam, concrete, block paviours, or other materials to be approved by the Local Planning Authority in partnership with the Highways Authority prior to installation.
Reason: To prevent loose surface material from being carried on to the public highway thus causing a potential source of danger to other road users in accordance with Policy DMG3 of the Ribble Valley Core Strategy.
8. / No part of the development hereby approved shall commence until a scheme for the construction of the site access and the off-site works of highway improvement has been submitted to, and approved by, the Local Planning Authority in consultation with the Highway Authority.
Reason: In order to satisfy the Local Planning Authority and Highway Authority that the final details of the highway scheme/works are acceptable before work commences on site in accordance with Policy DMG3 of the Ribble Valley Core Strategy.
9. / Rainwater from any roof or covering to the polytunnel shall drain wholly within the existing site and shall not be allowed to discharge onto the adjacent adopted public highway network. (Section 163 of the Highways Act 1980 - Prevention of water falling on or flowing on to the highway).
Reason: In the interests of highway safety and reduce the risk of flooding in accordance with in accordance with Policies DMG3 and DME6 of the Ribble Valley Core Strategy.
10. / All tree protection shall be carried out in strict accordance with the submitted Arboricultural Constraints Appraisal dated October 2017. The specified tree protection measures shall remain in place throughout the construction phase of the development and the methodology hereby approved shall be adhered to during all site preparation/construction works.
Reason: To ensure the adequate protection of trees/hedging of landscape and visual amenity value on and adjacent to the site or those likely to be affected by the proposed development in accordance with Policy DMG1 of the Ribble Valley Core Strategy.

1. / For rights of appeal in respect of any condition(s)/or reason(s) attached to the permission see the attached notes.2. / The applicant is advised that should there be any deviation from the approved plan the Local Planning Authority must be informed. It is therefore vital that any future Building Regulation application must comply with the approved planning application.

Whether or not this was used, the Local Planning Authority has endeavoured to work proactively and positively to resolve issues and considered the imposition of appropriate conditions and amendments to the application to deliver a sustainable form of development.
