INSTRUCTIONS

Offerors shall provide their responses to the Statement of Work and their approach to providing the required services in the associated questions. If there is a question that the Offeror feels is not applicable, the Offeror shall explain why.

2.  BACKGROUND

The City has wide and diverse needs for Landscaping and Grounds Maintenance. The City’s first citywide landscaping contract was awarded in 2012, but individual Department contracts remained. The City now seeks a more comprehensive contract(s) to combine the following current contracts:

Some may be extended to prevent coverage gaps between current expiration dates and establishment of new contracts.

The City anticipates usage of this contract(s) to begin on a rolling basis as current contract terms expire instead of beginning all at once.

3.  SCOPE OF WORK

Contractor shall supply all labor, equipment, materials, transportation, incidentals and disposal necessary to provide ground and landscape maintenance and repair services, as well as other specified services, in accordance with the terms, conditions and specifications contained in this document. Work frequency may be emergency, project-related, regular grounds and landscape maintenance services or any combination. Work may be on City, private residential or commercial property.

Department-specific Exhibits control over this Scope of Work. In the absence of direction otherwise given in Department-specific Exhibits, Contractor shall follow the specifications given in this Scope of Work.

Departments will choose appropriate contractors according to the services and Department Size Range award(s). If the Department is a Department specifically identified in the Scope, Contractor shall perform the Management Plan for the pricing as indicated in Contractor’s offer and award. If the Department is not specifically identified in the Scope and/or Exhibits, Contractor shall perform like quality to that Contractor offered and was awarded for the Department’s Size Range.

In the event a Department begins using a Contractor but grows or contracts in number of sites to a Department Size Range other than what Contractor was awarded, the Department may stay with Contractor at the Department’s sole option.

4.  DEFINITIONS

4.1.  Contract Representative – means City’s specified contact, or his/her designee, for the site where the Work is being performed. This means there will be at least one Contract Representative for each Department and, in some cases, for each site.

4.2.  Subcontractor - means any party holding a contract, express or implied, with Contractor delegating or assigning, in whole or in part, the making or furnishing of any material or any service required for the performance of this Scope of Work.

4.3.  Regular Services – means regularly occurring Grounds Maintenance and Landscape Maintenance, each as described in this document.

4.4.  Work – means the tasks and services generally described in this document or specifically requested by Contract Representatives, which include but are not limited to labor, materials, supplies, equipment, services.

Offerors shall indicate whether the Offeror Accepts the definitions listed in the above Section 4 or if the Offeror Takes Exception to any of the definitions listed in the above Section 4.
Offerors who Take Exceptions shall provide a rationale for each exception and provide alternative language for the City’s consideration.

5.  CONTRACTOR WARRANTIES AND REPRESENTATIONS

For the Work categories Contractor is awarded:

5.1.  Contractor will provide in connection with the Work the standard of care, skill, and diligence normally provided by a contractor in the performance of similar Work and warrants that all such Work shall be performed in accordance with sound and accepted industry standards and practices.

5.2.  Contractor is able to furnish the labor, equipment, materials, transportation, incidentals and disposal required to complete the Work and to perform the obligations required by this contract. Contractor has sufficient experience and competence to do so and is properly insured and licensed to perform the Work.

5.3.  Contractor is financially solvent, able to pay its debts as they mature, and possesses sufficient working capital to complete the Work and perform Contractor’s obligations required by this contract.

6.  GENERAL SPECIFICATIONS

6.1.  Licensing and Compliance. Contractor shall be responsible for its staff or agents assigned as part of the resultant contract to be in compliance with all federal, state, county and local licensing, employment and other related laws, codes, ordinances and regulations.

Contractor will execute the Work in accordance with all applicable federal, state and local laws, statutes, regulations, rules and ordinances, as amended from time to time which include but are not limited to the following:

·  American National Standards Institute (ANSI)

·  Occupational Safety and Health Administration (OSHA)

·  International Society of Arboriculture (ISA)

·  Tree Care Industry Association (TCIA)

·  Maricopa Association of Governments (MAG)

·  City of Phoenix Building Codes and specification

·  City of Phoenix Fire Code

·  All applicable state, federal and local laws, standards and ordinances

6.2.  Uniforms. All staff assigned as part of this contract shall wear a uniform identifying the name of Contractor. The site supervisor will wear a badge clearly identifying them as such.

Hard hats shall be worn in construction areas or as directed by the City. Earplugs and safety glasses should be worn as conditions warrant.

6.3.  Keys, Gate and Utility Box Key Control. Contractor is responsible for the series of keys assigned to Contractor. Contractor shall report all lost or stolen keys to the Contract Representative as soon as the loss is discovered. If not found, Contractor will be charged $25 for replacement keys.

6.4.  Storage. Contractor shall provide for all storage at off-site locations, delivering to site only sufficient equipment and materials to complete daily tasks. Unless otherwise stipulated in the contract, roll offs for trash may be kept at service locations if approved by the appropriate Contract Representative.

6.5.  Site Disturbance. Contractor shall make every effort to minimize tire marks and compaction of the soil due to driving and parking on non-paved areas.

6.6.  Use of City Facilities. Contractor’s use of City phones, indoor facilities for breaks and/or lunches is prohibited.

6.7.  Local Office. Contractor shall maintain a local office with a competent Contractor representative who can be contacted during normal working hours. A local office is one that can be reached from within the City without a toll call.

6.8.  In the Event of Contractor Sale. Notwithstanding Standard Terms and Conditions, Paragraph 5.2, Assignment – Delegation, in the event Contractor is sold, within three (3) days of the final sale date, Contractor shall notify the Buyer of Record of this fact in writing and shall include the contact information of the new owners.

7.  CONTRACTOR PERSONNEL AND SUPERVISION

Contractor will establish and maintain crews capable of performing the work per the specifications and provisions of the contract. Crews will be dedicated to this contract only while onsite and will report to the Contract Representative. The ability of these crews to successfully maintain the schedule created by the Contract Representative and Contractor may have a bearing on the continuation of Contractor’s work at the site.

Contractor shall provide onsite supervision to assure competent performance of the work during the scheduled hours. Contractor shall quickly and successfully address any safety, disciplinary, rules violation or performance issue of assigned contractor personnel.

7.1.  Single Point of Contact. Contractor will provide a single point of contact to the City to function as the contract superintendent and will be available during working hours for coordination with the City. This individual will be able to:

·  address overall contract questions/concerns,

·  fully understand the scope of work and specific contract requirements,

·  be familiar with the topography and crews at all work sites, and

·  have authority to act on behalf of Contractor in any situation.

7.1.1.  Minimum Experience and Qualifications:

·  Minimum of five years local region landscape maintenance experience (minimum of three years’ experience in arid-region plant materials);

·  Certified by the Arizona Landscape Contractors’ Association in landscape maintenance and installation or currently enrolled (certification required within one (1) year of the start of the contract) in the Arizona Certified Landscape Professional Program;

·  Registered and Certified Applicator with a Qualifying Party and hold a Business License by the Arizona Department of Agriculture Office of Pest Management. Applicators should be licensed in Ornamental & Turf, and Right of Way at a minimum;

·  Fluent in the English language.

7.2.  Field Supervision. In addition to the single point of contact, Contractor will assign and make available one field supervisor (site supervisor) for each site during working hours for coordination with the City. At a minimum, field supervisors shall have:

·  Minimum of three years landscape maintenance experience;

·  Minimum of one year experience in arid-region plant materials;

·  Minimum one year supervisory experience;

·  Certified by the State of Arizona Office of Pest Management in structural pest control, ornamental, and weed control;

·  Certified by the Arizona Landscape Contractors’ Association in landscape maintenance/ installation or currently enrolled (certification required within one (1) year of the start of the contract) in the Arizona Certified Landscape Professional Program; and

·  Fluent in the English language.

7.3.  Irrigation technicians. At a minimum, irrigation technicians shall have:
