If at any time housing is less than full, the Residence Life Office reserves the right to move the remaining residents or to fill the vacancies.
If a Resident Assistant resigns, is terminated, or is reassigned, the roommates of the Resident Assistant will also be relocated to another apartment or reassigned to available open spaces on campus.

TERMS AND CONDITIONS OF OCCUPANCY
The resident agrees to abide by all Mercyhurst University rules and regulations listed in the University Catalog, the Student Conduct Code, the Student Handbook, and other Mercyhurst University publications.
The occupancy period runs from Tuesday, August 28, 2012to Thursday, May 16, 2013. Graduating seniors may stay until noon on Monday, May 20, 2013. All personal belongings must be removed from housing at the end of the occupancy period. The Residence Life Office will dispose of any belongings left by residents in accordance with the Confiscation Policy.
All first-and second- year students who are not designated as “commuters” by the Admissions Office are required to live in college housing. The costs of housing at Mercyhurst University are outlined on the front of this contract. Scholarships that include housing costs will cover the standard 3 person Briggs & Lewis apartment cost. Any additional costs beyond this rate (e.g. townhouses, Wayne Street apartments) are the responsibility of the student.
If a housing deposit is on file, it will be refunded to the student’s account after the student graduates or withdraws from the University at the end of the occupancy period. If the student’s account has an outstanding balance, the housing deposit will be applied to the balance and only the remaining portion of the deposit will be returned to the student. Damages to the living space, outstanding student conduct fines or community restitution, or pending disciplinary action may affect the student’s refund of all or part of the housing deposit.
Residents who need to leave the University for an extended period of time but who intend to return during the occupancy period (e.g. academic hiatus, medical hiatus, etc.) will be charged 1/3 the normal housing rate to hold a specific housing assignment.
If, after submitting this contract, the student decides to leave campus housing at any time or withdraws from the University, the student will be responsible for a $500 breach-of-contract charge. If a student withdraws or leaves the University during a term within the occupancy period, housing and board charges (excluding the housing deposit as it has been forfeited) are refunded according to the following schedule.

Calendar days 9-15...... 80% refunded
Calendar days 16-22...... 70% refunded
Calendar day 23 and later...... 0% refunded
Each resident will complete and sign a Residence Condition Report at the start of any occupancy. This report will be used at the end of occupancy to determine whether any damage was done to the residence. If no resident takes responsibility, each resident in that residence will be charged equally for damages. The smallest, most reasonable group of residents will be charged for damage to public or shared living areas within the building if it cannot be determined which resident(s) caused the damage.
If you will be requesting a residence hall accommodation based on a documented disability, please contact Residence Life at prior to housing sign-ups.
Once assigned to housing, residents may not move assignments without the prior approval of an Assistant Director of Residence Life. The Director of Residence Life reserves the right to move, consolidate, or add residents to apartments or townhouses without the approval of any resident. Residents may not refuse administrative room changes.
If a Resident Assistant resigns, is terminated, or is reassigned, the roommates of the Resident Assistant will also be relocated to another apartment or reassigned to available open spaces on campus.
FEES: $75 improper checkout fee (not completing proper paperwork, occupancy space not clean, etc.); $50 charge for keys not turned in at the end of occupancy; $25 charge for replacement of lost keys during occupancy.
The college reserves the right to alter the terms of this contract. Should the terms be altered, residents will be notified in writing.

NOTE: The parent/guardian signature is strongly recommended but is not mandatory. While it is recommended that parents or guardians review this agreement and discuss its contents with the signing student, it is the student’s signature that constitutes a binding agreement between the student and the University.
This contract is kept on file, and copies are available upon request.
